    Actually illegal IS the same status as overstay (you are confusing illegal with undocumented), the only difference is that an overstay is forgiven for immediate relative of US citizens. It is not forgiven for anyone doing any other type of adjustment of status. When you are talking about reforming the system, removing the automatic forgiveness of overstay for IR categories would certainly be an incentive for more people to start following the law properly, and it would likely reduce the incentives for green card marriages as well.

    The embassy is closed today on account of Labor Day. Same with NVC.
     
    The English part of the forms was not as clear. It just said that the visa was in the passport. No visa packet. The same letter in Portuguese was much clearer stating that there was no sealed (lacrado) package with this case. After going over the Portuguese documents, we decided that it had to have been digitally uploaded.
     
    Even so, we will confirm with the embassy. My wife made friends with others who had their interviews that week. She called them and they all received the same thing. Passport with visa in it and no sealed package to be opened by CBP officers.

    I commend you for doing immigration the right way. Your assumption that you surrender your LPR rights upon moving out of the country (without surrendering your gc) was an honest mistake.  Geowrian generally gives good advice in this forum so follow one of the lines of advice above. Good luck!
     
    Also, thanks for giving the full story. So often people come onto the story only giving bits and pieces of their story requiring others to fill in the blanks.

    1. You will probably never receive the torusit visa again. Even after the ban is over your chances will be tiny. You already cheated the US immigration once and they will not forget that.
    2. In theory yes, in practise doubtful. 
    3.  Doubtful the lawyer will help. 
    4. Someone correct me but since you're over 21 your green card holder parents can't sponsor you. BUT your US citizen sibling can. It will take over a decade though. 
    5. It will not lift a ban. You will need to wait it out. 
     
    Well this happens when you break the law and you knew very well that you should not overstay. Now face the consequences. As a Canadian you had it easier than the rest of the world when it comes to visiting US and you ruined it.

    I-130 was approved on the 28th of Feb, 2018. Today my wife went for an interview for a tourist visa and got approved to visit. She told them that the NVC was backed up with petitions and that it would be another 6 or 7 months before she would probably get an interview so she wanted to visit.They gave it to her!!!

    Apologies, I did not you were the USC. Next question. This is an I-130 and you are living abroad. Have you met the established residency requirements? You can look them up on the internet. This is similar.
