The income reported as stated on form I-864, I-864A is insufficient to overcome the public charge grounds of inadmissibility for visa issuance. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. For more information visit https://nvc.state.gov/aos and https://www.uscis.gov/i-864p. A consular officer will decide if you meet these requirements at the time of the interview. Note: You, as the sponsor, and any other sponsors household members and joint sponsors, must provide updated or additional evidence for the applicant to present at the time of their interview such as: * Other income * Assets * Proof of current employment Note: You submitted documentation to the National Visa Center through the Consular Electronic Application Center CEAC. You can continue to upload documents to CEAC up until the date of your visa interview.

i can’t remember the timeline when i posted something and had some negative comments.
well here is an update,
received the approval letter,
affidavit of support paid and documents done and uploaded,
IV paid and processed
now waiting and curious to know how long before medical and interview

Thats fine, we are not in a hurry, we just doing everything as it comes day by day, and i think cases are different from each others

We just walked out USCIS Office, explained to her what i told everyone here, we gave her a letter withdrawing form i 485, then gave us a letter explaining the refund process, also gave her the new form i-824, reviewed it and sealed it, gave us a letter that they have the form and said just wait for letter in the mail for interview date.

Thank you all for the quick responses, i was able to talk to someone at USCIS yesterday, they informed me that yes we made a mistake for filling I-485 but when I was reading the NOA for the approved I-130, they will be refunding us the $1225, he also made us an appointment for Today 12/28/2022 at the USCIS office here so we can go ahead and submit I-824, my father in law filled out I-824 and faxed it to us, and finished it. Again thank you all

This case is a mess. Get your MIL to sign up here and we can help her fix it.
She needed to file a simple I-130 for overseas relative which would go to NVC/State Dept after approval. Somewhere she stated that her husband is already in the US. That needs to be fixed in writing. On paper it looks like your FIL is here illegally now because she said he is here and there is no record of him entering.
On I-130 part 4 # 45 its a NO

My Mother in law filled a petition for my father in law, my mother in law is here, green card holder, filled a I-130 petition for alien relative which is my father in law, got approved and received NOA saying should submit I-485.

Thats what the letter says to fill out, father in lw in philippines filled it out, sent it here to us in the US then we sent to USCIS..

We filled for I-130 Petition for Alien Relative, received approval notice, then filled I-485, now came back with RFE needing a I-94 Arrival/Departure Record, he has never set foot here in America. Is this normal? What do i do?

i130 spouse visa
Received a letter back in July about completing the DS-260, uploading civil documents, and required documents, and also paid fees, department of state website shows everything completed and no errors, all of this was submitted back in July of 2023.
Does anyone know what the wait time for the applicant to receive something from nvc to schedule interview and medical?
Will they send a letter via mail to set up
schedule or will it be an email?
