Filed today. Found the online process to be super simple and now the rest of the process is out of my hands. A lot less stressful than filing the 129 six-years ago.

Not true, based on what we see here on VJ.  Lawyers often cause additional delays and expenses.  VisaJourney is a DIY site, and most of us have done our entire processes without paid legal help.

What if you requested a withdraw for the first k-1 before it was approved, would you still need a waiver for a second filing?

LostRonin reacted to Unlockable in is AOS a qualifying life event for insurance?
For benefits through your employer they usually only gives you 30 days after the life event (marriage, baby). Sounds like this may be a case where the OP is past the 30 days. I don't think AOS qualifies but it may very well be for some insurers. Regardless, I doubt anyone here will know as we don't know the OP's employer or healthcare provider.
    OP,
It is best to contact your employer's healthcare provider and see if your wife obtaining a permanent resident status qualifies.

LostRonin reacted to KULtoATL in first we must to meet together ?
As per other VJers who have responded, you'll need to have met in person within the last 2 years preceding your filing date. I'm not sure which country you're from but if you're from a high fraud country, it's recommended that you meet with your US citizen petitioner for more than one time. Location wise, you can meet anywhere in the world.

Additionally, photos together are a secondary evidence. Your petition package needs more than just photos. There are USCIS form, required supporting documents, current fee and other supporting documentation that you think will help illustrate a bona fide relationship with your US citizen petitioner.

To get a feel of the process and what's needed, check out the following with caution as the sample forms shown aren't up to date but all other information are still applicable and useful:

    K-1 guide http://www.visajourney.com/content/k1guide

    K-1 flowchart http://www.visajourney.com/content/k1flow

Always download and use the latest version forms from USCIS website and check the latest fee there too. For new petitions, the current fee is $535 and form G-325A is no longer needed as it has been incorporated into the latest I-129F.

And to answer your other question, no, you don't just submit the petition one month before the interview because you won't even know when's the interview till after one in scheduled post-NOA2. It doesn't work like a B2 tourist visa application. Based on current processing times, it takes approximately 3 months for a I-129F to get either a NOA2, denial or RFE. In some cases, it might take more than 3 months and RFE would also add time to your process. If you're lucky, maybe it's under 3 months.

My personal advice is that you and your petitioner familiarise yourselves with the process and requirements prior to filing a petition to ensure that your submission is as complete as possible, and that you know what to expect i.e. this is not an instant approval one month process or further evidence might be asked from you.

Please note that after I-129F/K-1, there would be AOS + EAD + AP, removal of conditions and finally ROC. It's a long road ahead. It doesn't stop at you guys getting married. With K-1, do not buy your one-way flight ticket to move to the US until you have your visa in hand. It is also more prudent and less stressful to get married at the courthouse first and then to plan your actual wedding/reception at a subsequent date. Again, that's just an opinion and decision is still in yours and your petitioner's hands. All the best

With US immigration, always consider yourself the rule, not the exception.

Immigration rules aside, why would anyone plan to marry and moved thousands of miles to live with someone they've never met in person?

even if they file after the i94 expires they do not need the i130 if they were at least married before it expired. the only times it is needed if they entered on a k1 was if they did not get married in 90 days.

He worked illegally while here. Even if it was help. A relative can be denied a visit because they are coming to help with a child. Look it up. It has happened before. Also, he was abusing his time in the US with his visitor visa. What the border officer did was correct. Now the only thing left for you to do is do it the right way and file for a fiance visa if you are a citizen. If not, then go there, get married, then file for a spousal visa.

Again, I am not bitter. It is 68 degrees today with plenty of sun. Just had a BBQ brisket sandwich and Iced Tea.

    Good luck to you.

You have gotten the only route left for you to follow to get him back to you.  That said,  you will find little empathy from ppl on this site (that are going the legal route -and all the waiting that entails) for a situation you got yourself into that could have been easily avoidable.

Awesome that's good to hear. My fiancée is also flying into Chicago. She thinks she's excited to see snow and looks forward to the cold weather. I don't think she's going to be too excited when the reality of what real cold is like

I attended an annual event at a friend's place over the weekend. One of his wife's friends brought her boyfriend. He was a fellow vet, so we struck up a conversation, during which he told me that he works for immigration. He stated one of the things that has gotten them behind is a change in form (I don't remember details). He also said they have authorized a bunch of overtime recently.
