    Do you realize that you can only file for divorce where you claim residency? If you were granted a divorce in India without your wife's involvement, then you created a mess for yourself.

    You should have no problem in getting into the US. You MUST file for ROC upon divorce. The 2 years validity on your green card is conditional on your marriage.

    Hello everybody, I have two years green card conditional based on marriage of us citizen cr1, my question is now I travelled back to my home country and I divorced her there and got my divorce certificate with me, my green card still valid for one more year, I do understand that after the year pass I can not renew it based on the fact that I divorced her, but my question is now I have been away in my country for a month and plan to get back to the us to take care of some property, when I return to the us will they stop me in the in the airport and not let me in cause we got divorced? or as long as my green card still valid that doesn't matter? does the divorce stop the two years conditional green card and wont allow u in at the airport? I got the divorce stamped in the us embassy to be used in the us for her.

  2. Here's my story and I desperately seek your advice. I'll try to keep it short and precise.

    I've been in F1 status which got terminated. My previous employer produced fraudulent document (without my consent) and USCIS knows about it, now the fault is mine, and I don't think I can prove it otherwise.

    Fast forwarding, USCIS terminated my status, and asked to leave United States. My H1B also got denied. I had a labor approved and my priority date is current. I'm also scheduled to get married in about a month, so leaving is not an option. However, USCIS haven't sent me any NTA either.

    So I spoke with multiple lawyers and after lots of advices, I decided to retain a lawyer and filed for AOS right away with my approved labor mentioning section 245. The lawyer said only way I could get 485 approved is through a hardship waiver.

    While filing 485, I did mention Yes in one of the questions and provided an explanation that I was unaware that I was violating any law. Now it's been more than a couple of months, I have had my fingerprint taken, but no updates so far.

    Now I'm neither legal or illegal here, and I have no idea how long we have to bear this ordeal.

    Any suggestion, possible outcome, or even unlikely solution is truly appreciated.

  3. The K1 petition expires after 4 months from the date of NOA2. Almost always the CO's extend it.The K1 expiry date doesn't matter much.Now,the CO's do not deny the visa unless they have solid proof of something.They send back your case to the NVC and tell you that they are working on it and they give you 180 days for a result but in majority of cases they let this 180 days pass and then tell you to apply again.Now you need to tell us what were the Red Flags in your case last time?

  4. Today my fiancée had his K1 Visa interview at the embassy in New Delhi. This is the second go around.

    The CO asked just a few questions did not ask for anything except my I134 and gave him a letter saying:

    "Dear---- Please bear with us as your case undergoes necessary admin processing we will contact you when we are finished..." It said absolutely nothing about 221G processing

    They did NOT keep his passport. Will they ask for it later if this gets approved ? Keep in mind USCIS will expire my petition 6/23/16. We have spend hundreds of dollars so far and absolutely no definitive answers or K1 visa approval

    Has anyone experienced this and what does it mean?

    I don't understand why they can't just say a simple yes or no. Why do the leave us hanging?

    Sorry to hear that.Looks like the outcome will be the same like last time.I advised you to involve your congressman last time you posted about it.Did you ever contact them?I truly wish and hope that they issue a K1 Visa.

  5. Hi everyone. I got my interview for my greencard last April 29, 2016 and was approved. I even received a letter from USCIS saying that my case was approved. But 3 weeks had passed and still I havent received any greencard from the mail. Anyone with the same experience? Is there something should I be worried about? Your replies would really help. Thank you in advance!?

    Hope,USPS did not loose your mail.If they did then you will be in trouble. Btw make friends with the postman.It's possible that it is on the way and you will get it very soon.

  6. This reminds me of the discussion that followed the rose and towel story from a few years ago.

    Not being on the K-1 path, I am not very familiar with the rules although we did research it before deciding CR-1 was better for our situation. Anyway, is there any requirement to the length of the meeting? The rule is that you have to have met once in the last two years. Personally I wouldn't call spending 25 hours with someone having "spent time with" someone. But it looks like it satisfies the visa requirement. How short a meeting is too short? What if they only spent 10 minutes together?

    It satisfies the requirement for approval of their petition.Considering the fact that young guys and girls from Philippines marrying much older USC and later on getting divorce,the CO would wanna see more proof of relationship.
