Sorry about your situation.
Time for the cold hard truth. This is so screwed up because of you. You choose to file a birth certificate with false information. Now, you are choosing not to correct it. As long as you are falsely listed as the father, the US Embassy will insist on a CRBA and US passport. If you file with a birth certificate that you know has false information, then you will be committing a crime since you would be signing the applications under oath and penalties of perjury. DO NOT MAKE A FALSE CLAIM TO US CITIZENSHIP.
A DNA test proving you are not the father is not going to help get him a visitor visa. It just proves you are not the biological father and his birth certificate is inaccurate.
Get the birth certificate fixed. The US Embassy has already advised you to do this. Don't mess around with the US Embassy, you will not like the results. Everything has been documented. They know. It will be in their databases.
You know what you have to do. There is nothing else you can do. Anything else will further the fraud and screw things up further.
Be smart about this. The US Embassy already knows he has a birth certificate with false information. Since the US Embassy already knows, you need to do the smart thing and follow their suggestions.

You may not use the J1 visa with the intent of getitng married and adjusting status.
If you use the spousal visa, you can work immediately.
Do not use bad language and denigrate advice given, that is against the TOS. There is a difference between being able to find work, and being able to get an employer to sponsor a visa.

Like Ash said, if you receive any means tested benefits, such as welfare, the government can sue the sponsor for compensation of the moneys given to you. In case the sponsor can't pay it back, they will then sue the co-sponsor for that amount. This is valid until you become a citizen.
You can, and should, read up on all the guides here, flowcharts, comparisons, etc, heck, even sample forms, to get an idea of what you're in for. You can also do the same at the USCIS website and look at the forms, and the form instructions. And read threads on here, even if you don't reply, including the stickies - there is such a wealth of knowledge in the posts on VJ. It may seem daunting at first, and that there are so many detail;s to figure out, but tons and tons of members have successfully gone through the journey from visa to naturalization on their own, with no recourse to lawyers, just with the help they have gotten on here. It's totally doable as DYI.

I'm not sure I understand completely. Are you saying once you hit the 6 month mark after submitting your K-1, that you are automatically going to write your congressmen? Just to get your case "expedited" so to say? If so I disagree with this tactic. Hold off for if/when you really need their help. And just opening a case inquiry for no reason other than trying to game the system hurts the rest of us in the long run.

Yes nice to see a President actually doing something I'm just surprised more countries aren't on the list.
And yes I do still believe people are totally overreacting over this issue instead of looking at why these countries can't come in right now since it not a permanent ban. I will never agree on this topic with 90% of people in here also why I stay away from the Trump threads.

I've met Muslims who are not from Iran, Iraq, Syria, Libya, Somalia and Sudan. I've also met both Christians and Jews who are from those countries. Well. Maybe not Somalia. One time, I even met a Muslim from Morocco.
Stop perpetuating this stereotypical myth that Muslims are from A, and Christians are from B.

This has been known for over a year now this would happen. This is only a temporary stoppage while they check people out further.
If if you are from one of these nations and currently here then it's not recommended you travel until you can be checked out and cleared.
I hope everyone dealing with with this issue finds a way to get back with their loved ones.

Trump considers LGBT rights as an American value that is protected. That's why extreme vetting for Muslim immigrants in particular allegedly includes asking them what their attitudes are regarding LGBTs. In other words, you shouldn't worry much because Trump himself is an LGBT rights supporter (for the most part).

As far as im aware the changes Trump is making will not be affecting the UK, but the 7 countries mentioned. I too am going back to England in September for 10 days. I don't think we are on Trumps hit list or radar in any way shape or form unless we hear concrete evidence in the mean time.

Please do not scare people with incomplete hear-say stories. Your Brazilian friend was not allowed to leave the US? The US does not care who leaves - you can leave any time. The question is on coming back. This requires either a Green Card (and due to the Trumpisms going on not being Syrian, Somalian etc for the next 90d) or an AP travel document.
Another story floating around on VJ is that some Brazilian airport officials are uninformed and request GC/AP holders to provide "transportation letters" - this has nothing to do with the US.
Bottom line, with our current knowledge, unless you are from one of the 7 countries, you are good. I am slated to travel to Europe next month, and I will go.

Just so you know, not having a valid foreign passport in NO WAY makes one undeportable. If he had a deportation order, he can be shipped off very easily.
Overstay is forgiven for spouses of US citizens who file the AOS. Since that did not and is not happening, he is currently out of status (and deportable).
Also, if not filing for residency to which one is legally entitled as the spouse of a US citizen is being used as some measure of "proof" of the legitimacy of the marriage, that marriage is in serious danger from a lack of trust from the start.

Hello, everyone.
I've been madly in love with my fiance for 2 years now. We met in real life officially 25Aug15. She is Aussie and has visited me here 3 times. I have only been able to visit her once for 2 weeks because of my job.
I dropped her off at the airport to return home just this afternoon to end the best 6mo of my life so far. Actually, she is en-route to LAX as I type this, and it has been a difficult evening to say the least....
Anyway, we are more than ready to be together permanently and this site seems like a good place to start. The USCIS website is a bit difficult to navigate and a quick search on reddit brought me here. I feel more hopeful now and will surely be reading a lot of info here (possibly posting as well)
Thank you to all the people who have contributed to this database. It is going to be incredibly helpful for bringing my future wife and I together.

A religious marriage IS a marriage in many places. If it can be legitimately recognized in the place you got married it will be recognized by immigration.
Also, refer to the legal status advice previously mentioned.
