Good day, I filed for my husband( i-130) in 2015, he went for his interview in 2016, case was denied under 221g( the counsellor doubted the marriage) and sent case back to USCIS for review and possible revocation. We rebutted the consular's findings and the case has been reaffirmed and sent back to the embassy for another interview. Question ; I have been outside the states for 2 and 1/2 years and unemployed(with 3 dependants) so coundnt file tax. I would like to know if that will be any issue this second time *though I ve a joint sponsor who's income qualifies*. Please advise. Thanks.

Are you living with your current husband for the past two and half years? Had similar issue our reaffirmed case was denied but has nothing to do with bona fide marriage because we had a child together and DNA was already with the embassy before my reaafirmed interview. My wife came to live with me in Ghana over a year and half and we filed a new petition at USCIS office at the US embassy in Ghana. Visa approved and we finally in the US but i believe a joint sponsor should be okay for you guys. Make sure your husband knows the joint sponsor very well because they will ask him questions about the joint sponsor.

To clarify this further, having a judge "properly sign" the divorce and have it recognized by the US for immigration purposes would require due process.

For example, generally divorces in DR are valid for US immigration. However, there are cases where people went to the DR just to get a very quick divorce. The judge would effectively sign it so long as you paid the fee, but these were not recognized for US immigration purposes.

The best way to get a divorce and not have any issues is still to file wherever you currently reside (assuming that is possible....as it's generally not possible in PH).

Sure your domicile is so important regards to filing for a divorce, because the intent to revoke uscis sent us in 2016. The embassy said the state that issued my wife divorce decree in Mexico requires either my wife or her ex husband to live in Mexico for good 6 month before a divorce decree can be obtained there. My wife or her ex husband never in their lives visited Mexico. We had a rough journey but thank God we are finally there.

Congratulations.  That's a long journey, one that i'm sure has aged and stressed you both for entirely too long.  I can't imagine the relief you must feel to finally have this part over and done with!

You said it yourself, patience is they key.  Those who try shortcuts to marriage like online services, shortcuts to get divorce or other documents to present will always run into issues and slow down their case.

Thank you and lol yes some shortcut are dangerious and can cause harm.

    To clarify :

any of these quick and easy divorce sites do not issue a divorce

for a fee they send paperwork for a client to fill out

and only for uncontested divorce (means no children and no property to split and both want the divorce and the state they live in does not have a separation waiting period)

the actual divorce is granted by the court /judge when the papers are properly processed,  fees to court paid,  signed by the judge,  and recorded by the Clerk of the Court

there are many sites offering services but the service is only an empty application paper and not a legal document in any way

only court signed and sealed documents are legal

Well, my wife paid 1,400usd for the service and signed a power of attorney, she was provided with a divorce decree from Mexico not even in the US. She and her Ex husband got married in Utah and one would be woundering how possible an American can easily get a divorce in Mexico.

I have been interview the first time we applied which was somewhere 2016 then I wasn’t given the visa all info was transferred to the state for review and asked as to prove why to keep our case active then we did and they approved and now, with the email they did it only said you have been booked for an appointment and also to redo our ds260 but no visa fee

It simply means you were denied in 2016 and your case was sent back to uscis for review, hope am right? That means they reaffirmed your case again. If that is the case then you have to provide all those docs. I went through the same process so yes you have to log back to your ds260  edit it and submit it.

We filed DCF through Moscow before the office closed. We have contacted the IV section of the embassy and they direct us to schedule the appointment online (and are generally super unhelpful). The only way to schedule an appointment is online but just curious if DS-260 needs to be submitted before the embassy opens up interview appointments because none have been available and they don't provide instructions on this. Just trying to understand the procedure for other DCF countries as I imagine it is somewhat similar.

You need a DS260 confirmation number to be able to book an appointment. You will be asked to put in your DS260 confirmation when booking an appointment, so I will advise you to go ahead and fill out the ds260.

    Hi all,

Can you all confirm if the appointment dates only opened up after you submitted the DS-260 online? Was there anything else you had to do? In Moscow, the only instructions they gave were to create the online account and submit the form where you want the passport delivered and then the calendar would open up, but it is clearly not the case as no appointments have opened up for us in 7 weeks now. The embassy is not helpful at all and won't answer any questions or tell us what needs to be done other than wait, but I have a suspicion that the DS-260 needs to be filled out.

    Can anyone confirm?

    thanks!

Is your case reaffirmed or new petition? We waited over 3 months before getting an appointment as a new petition. We filed our petition over here in Ghana at the US Embassy, so we had nothing to do with NVC scheduling our appointment. I was directed by the embassy to fill out the DS260 and book my own appointment. On the booking system, it gives you options which say ( 221g Appointment or Regular appointment ) which depends on your case.  To be honest it took us over 3 months before getting an appointment. Good luck to you as well.

    Sorry to respond late dear.

It's currently taking 3-4 months. The last one I saw was 140 days from the case completion date to the date of interview.

So I have been counting the days.

I have two cases and one of them, I'm at 81 days since case completion so hopefully will hear in the next month or so

May God's grace be upon us, may he make ways that seem impossible and give us patience because this journey requires A LOT OF IT.

Wow 3-4 months, well I have been directed by the embassy to go online and book my appointment since November 29th, 2018 till now no appointment available. We filed direct at the consular so we are not dealing with NVC

My case was reaffirmed case filled in the States not directly in the Embassy.

But all the same , I scheduled my first date on October but was cancelled when I went for my interview with my wife , reason was all reaffirmed cases are not suppose to schedule an appointment on Friday . I  rescheduled again and it was cancelled again, but as for the second cancellation of this appointment I don't really know the reason why they cancelled it , so my wife addressed the issue to her congresswoman to intervene and she did. I was given a mandate to schedule a new appointment by the Embassy . I waited searching for a new appointment but at  this time, it took almost one month before I was able to get my last appointment.

My first case was reaffirmed too but that year the embassy was in charge of scheduling an appointment, it was later 2017 the embassy directed me to book a 221g appointment which I did but it was easy then. But this is a new case we filed and has been waiting over 6 weeks now and yet there is no appointment available.

Just a while because I keep checking three to four times a day , and I was able to scheduled three appointment but two was cancelled at the beginning before I got the last one .

So pls don't give up keep checking three to four times in a day , you will surely get one.

If you don't mind share with me your time table? When did you get your instruction package from the embassy? How long did you wait to get an appointment? and was the appointment date closer or 2-3 months ahead?

Am asking because my wife has planned for us to travel at the end of March...

I think the priority date matters a lot because I have my old case which was denied by consular due to their issues with my wife divorce decree. So when I enter the old case number and the priority date it shows there is an appointment available but using the new case number and the new priority date it says no appointment available.

I check on the website every 2 hours every day since they sent me the interview package instruction, called the embassy support team to help but all they keep telling me is appointment is under the discretion of the embassy so I should just keep checking. The whole story is we filed on the 14th of November 2018 and got approved on the 23rd November 2018, embassy emailed me with the interview package instruction on the 29th November 2018. I don,t know if the priority date matters when you are booking the appointment online, looks like first come first.

    What is your priority date?

22 minutes ago, Jesus is Love said:

That's weird because I was able to see two different appointment dates back in November for December bookings. You have to just be persistent and keep checking. Some times it will say no available appointments in the morning, then going back on in the evening there is a date available.
