    The english in that contract is almost unintelligible. I don't think any self respecting, qualified, immigration attorney or immigration service would deal with such poorly constructed documents.
    Also its evident that whoever typed up this piece of trash doesn't know how to use the numbered list function in Microsoft Word. The "1.)" in the first clause is formatted correctly, albeit with a different font, and all of the other numbers are simply embedded in with the paragraphs. If this humble soul actually underwent any kind of quality education I would assume that he/she would know how to properly draft a contract.
    I would first blend that contract until the fibers became soft, make toilet paper out of it, then give it back to whoever wrote it to use.
    If you paid money I would ask to see this person's credentials (if he has any). Once you have the credentials, photocopy them and tell him that you are going to double check to make sure that they are valid. If he hasn't crapped his pants and offered to give you your money back by then, I would verify with the state BAR or Board of Immigration Appeals that this guy is legit.
    Was this guy trying to pose as an immigration lawyer, accredited representative or what?

    This is not complex at all. This is rather simple.
    You can not extend your 90 days on the VWP. That's one of the condition of using the VWP; no extensions.
    You don't need a visa if you are already in the US. Visas are for entering the US.
    Only a USC can file for a fiance. Green card holders can not file for a fiance.
    You can not wait in the US to process for your visa.
    Your girl is getting divorced in March. She hasn't file for naturalization which could take a year.
    There is only one choice until she becomes a USC. Once her divorce is finalized, you two can get marry and start the immigration process. It will take 1-2 years. She can upgrade the case when she becomes a USC.
    There is no path that will get you into the US this year to immigrate. You are looking at end of 2017 or 2018.

    Not complex at all. Vwp isn't extendable. A k1 will take 6 months to 1 year.

    I had my interview today, 08th of January 2016; 6:15 am schedule at US Embassy Manila. Flew all the way from Davao, I stayed at Bayview Park Hotel Manila, its located just across the street of USEM Manila
    To start with, these are the things I brought with me in preparation with the interview:
    1. ??Passport (valid in 6 months)
    2. ??Photocopy of passport biographic page
    3. ??Cenomar (petitioner)
    4. ??Cenomar (beneficiary)
    5. ??Birth certificate (petitioner)
    6. ??Birth certificate (beneficiary)
    7. ??Police clearance
    8. ??NBI clearance (valid in 6 months)
    9. ??Financial Proofs
    - ??Latest ITR
    - ??Latest W2
    - ??Employment certificate
    10. ??DS260 copy
    11. ??Sealed Medical Result from SLEC
    12. ??Interview letter
    13. ??Passport size (2x2) photo 4 pieces
    14. ??Marriage Certificate
    15. ??Proof of Relationship
    - ??Wedding pictures
    - ??Photos together
    - ??Chatlogs ( from start of relationship to current chats)
    - ??proof of financial support
    - ??plane tickets and/or passport stamps (records of previous visit)
    - ??affidavit of witness (3 persons)
    16. ??Affidavit of Support
    I went to USEM Manila at 5:00am, the line was already long, there are separate lines for SEAMAN/IMMIGRANTS/NON IMMIGRANTS. Then at 6:00am, they started checking and allowing applicants to go inside. The things that first checked before you get inside were: DS260, INTERVIEW LETTER and PASSPORT. Then, you will be instructed to go inside and pass through the scanner. Remember, electronic gadgets are not allowed (Flash drive, cellphone, tab, laptop, etc.) and also food and drinks are not allowed (but you can bring candies).
    Step 1: Proceed at window 2 for priority number. You will be asked who's your petitioner and the petitioner's DOB.
    Step 2: Before proceeding with the second step at the main building where the whole process takes, you will pass through a scanner again and bags will be checked by a guard this time. Proceed at pre-screening/Finger scanning area. Finger scanning first, then I was asked with few questions (Petitioner's name/DOB/ How did the petitioner get into the USA). And also asked if did I applied for a visa before, my answer was yes, I applied for a tourist visa before and yet it was denied. Then he collected few of my requirements (Cenomar/ NBI Clearance/ Marriage Certificate/ SLEC Sealed Medical Result).
    Step 3: Then, I was instructed to proceed with Oath taking. It was an American lady. Then another set of finger scanning.
    Step 4: Then, the most awaited interview with the American consul. I was luckily assigned to a male, smiling, kind and handsome consul. Questions asked to me were:
    CO: State your name and your birthdate
    ME: <stated>
    CO: Who's your petitioner?
    ME: My husband. <stated name>
    CO: DOB of petitioner
    ME: <stated>
    CO: How did he get into the US?
    ME: He was petitioned by his American step dad under IR2 category.
    CO: Husband's job?
    ME: <stated>
    CO: Your address in the US?
    ME: <stated>
    CO: Do you have a child?
    ME: None
    CO: Have you ever been outside the Philippines?
    ME: Yes! But just for vacation.
    CO: What country?
    ME: Been to HK, Macau, SG, Malaysia
    He then handed me a pamphlet about domestic violence and instructed me to read and understand it. And finally he says the magic word, "everything is good, you're APPROVED!!!".
    Step 5: Proceed for step 5 for the mailing address. The lady just gave me a piece of paper which explains how to register your mailing address online at ustraveldocs.com.
    Yes! Was exactly done and out of the US Embassy Manila by 9:30am. Went back to my hotel, availed my free breakfast buffet and by 11:30am I checked my CEAC status and I was happy seeing it already updated to ISSUED.

    You should enter 0 for spouse because you're already counting your wife as the intending immigrant.
    Other than that, everything else looks fine.

    I URGE to not let her do that!
    I did something similar, all driven by emotions and came back to Brazil before my AOS was finalized. It´s being 7 months and counting that I don´t see my husband. Please don´t let her do that! It´s just so painful and costy to restart the whole thing again.
    I wish someone had stopped me at the airport and put me back into my feet. Look up on myy timeline and you´ll see the journey this is being.
    As much as I pray for your in law to get better, I´ve learned that when in this process we must be a little selfish.must be other ways for her to be present and supporting her family without being physically present. I learned that the hard way. Unfortunatelly, her family members will have to understand that she now has another family in another country and that she´s subject to a long and expensive process before she´s free to come and go whenever she wants. There If it was today, I would have never had done what I did.
    Being physically present there won´t change anything after all. She can be there by other means.
    It´s just too horrible and painful to go through all the journey again. It´s painful, very painful to be away from my husband for all this long and not knowing when I´ll be able to hug him again. Our lives were out on hold the second I boarded that plane.
    PLEASE, TALK TO HER, OFFER HER COMFORT AND MAYBE ALTERNATIVES BUT DON´T LET HER GO BACK. PLEASE.
    That´s just my personal experience and advice to you.

    Hey looks like we got our case completes just a few days apart. Congrats!
    I am a bit of a stats nerd and compiled data from a Case Complete to Interview Spreadsheet (I cant find the link right now because I'm at work)... I compiled 210 Philippines cases dating back from 2013 to now and the average time was 47 days from case complete to interview date. That puts us somewhere around the last week in January or early February for the interview. I would expect a longer wait then average due to the holiday season. Anyways, that may provide a little bit of insight

    Household size works this way:
    If you are combining income with your dad (i.e. he only filled out an I-864A), then he is not a joint sponsor, he is a household member and would be included in your household size.
    If your dad was acting as a joint sponsor, he would've completed an I-864 and he would not have been included in your household size nor you included in his.

    I can see why in the NVC guide it says:
    Case Complete
    There's currently a way to know (not 100% guaranteed though) if you have case complete by looking on the CEAC site. If the AOS fee changes from PAID to N/A, then I'd suggest calling NVC up pronto as most, if not all, people who have reported seeing this have a case complete.
    Although case complete emails used to be rare for non-EP folk, it's becoming more common (it might even be that everyone is getting them now). But, they're severely delayed (sometimes a week or more!), so do not rely on it (unless you're in no rush to find out). The fastest way to find out if your case is complete is to call an operator at NVC and ask.
    After the case is complete, the case is put in a queue to get an interview date scheduled.
    Thanks for sharing your experience. In my case, the 3 N/A mean case complete.
    Looks like you should be really close. One NVC rep told me they do review one time seems that is not true, they may review some and then come back to it.
    I think apart from efficiency, the NVC could use some unity.

    I went with my wife to her Interview Nov 10th went smoothly actualy asked me more questions than her. Approved and asigned the visa for pickup at 2 GO,mall of asia . I pre purchased our tickets for the Nov 23rd. Giving us 8 days turnaround time of the visa. Low and behold they were hosting the APEC summit, closing down the embassy for 1 week. No notification from the embassy or Rapidvisa who i hired that this was planned. Needless to say our timing went in the crapper. Received on the 25th, costing an additional 500$ in change fees and an endless amount of stress.Lesson to be learned form this is Listen to everyone who says dont buy the tickets until the visa is in hand, you never now in the Phillipines, ever as in they refuse to commit to any turnaround time. We arrived back in the US nov 27th, POE was a breeze.I have seen questions on here before about who can attend the interviews, my answer is anybody. They never even asked to see my passport at any stage entering the embassy. I saw mothers and father acommpany petetioners. Good luck to future couples in your process.

    Life is about being happy not being in the USA. Sounds like you have all the happiness with your true love, stay in your country propose to her , get married and have the best life ever. America is good but pure happiness which you seemed to have found is much much better.

    Once you get through press 1 and then 7 to go directly to the hold queue...
    If you get through right at 7:00pm then you'll most likely only wait for a few minutes. I have called them numerous times and Gina is definitely the most helpful agent! If you get through to Gina then consider yourself lucky.. Waldo is the least helpful, don't expect anything from him, I get the impression that he doesn't like his job haha... Best of luck to you!

    Your I130 approved in 40 days mine still not approved since December 2014, many peoples are like me who are waiting for their NO2 and you are crying over your NVC process sounds funny to me.

    "Return Service Requested" is nothing to worry about. It isn't specific to USCIS/NVC/immigration. It's just a standard piece of USPS terminology and means that undeliverable mail should be returned to the sender with either details of the recipient's new address or a reason why it couldn't be delivered. It's a way that the sender can confirm that the recipient is contactable at the address they have on file.

    Not being holier than thou but why should your divorce and spousal obligation be any different than if you were divorcing a USC? Life is short. If you're absolutely sure that your marriage is dead and there's no revival then suck it up, cut your losses and move on so you can put this chapter behind you. You don't want to drag this out and prevent you from looking to your future. Wasted years and bitterness is more costly than a few dollars...but yea man it's up to her whether she wants to stay.

    Well, if she can prove the marriage was bonafide like you're saying it was, there is no way you can stop her from removing her conditions if she wants to.
    Why do you think that stopping her from getting a 10 year GC will make it easier to avoid a long and costly divorce? I don't see a direct relation between how your divorce will be handled by court and her immigration status. What I mean is, if she wants to make your life hard for divorcing her, it doesn't matter if her GC has been renewed or not. In fact, she could use your reluctance to renew it against you.

    You cannot do anything without supplying evidence that fraud was committed. Some marriages work, some don't.
    Divorce and move on. It can be painful but it's survivable.

    Your post really makes me cringe. Your wife can't just be shipped back to her home country like some cattle, just because YOU want to. It is unfortunate that the marriage has fallen apart, but since you yourself say that there was no fraud involved, she will still be able to remove conditions by herself with a waiver. She what Boiler said.

    Seems very dangerous. Consider writing a check to yourself and opening an account in the US to deposit it. I would also think that if you have more than $10000, $54 seems like pennies for a matter of safety.
