    First and foremost, there's nothing wrong with her English. She's not really telling us the whole story that is why everything is vague.
    Second, chinita if you really wanted the people here to help you out with your situation it will be better to tell the whole story. You should not be afraid sharing personal story since we don't know you exactly in person and no one does.
    I hope you won't mind sharing it, at least people could enlighten you with the best answer that suits to your situation.

    My husband is currently active in seeking a second job like I put in the post. But he needs to the second job not to interfere with his current job as he is trying to work his way up the ladder with the current company he is employed with.
    Regards to using the cash we spend to clear some debts, ..... This is how it went so people understand better as I to would have said the same as you.
    Back in 2014 my husband was involved in a car accident and to cut a long story short there was a lot of court fees and layer fees that need to be paid for us to be able to move on and get back on track with life. We also had 2 credit cards that had high interest rates that would keep amounting to more and more as the months went by. I did a balance transfer on one card to give us interest free for 12 months so we didn't have to pay any interest on that one for a while and the other card we paid off completely. By doing this we didn't have to worry about getting in a mess with money and it now allows me to put my entire salary in savings. I currently earn around £500 a week but can sometimes be as little as £350.
    Hopefully I would be about to save around £10k to £15 before they ask about our finances.

    The ticket you got is pretty serious as a moving violation but isn't a concern when it comes to your citizenship really. Tickets for DWI for example can be a problem.

    I do not mean to offend, but you really need to improve your English. You've been here for years now (according to your short, repetitive answers) and you can barely make yourself understandable.
    There's a lot in this process that you would understand if you had learnt enough of the English language.
    If you answered the interview questions in a similar way that you did here, I can see why they would be suspicious.

    Let me start the story for you.
    You came to the US on a K-1 visa. You married the petitioner within 90 days of arrival. You filed to adjust status. You failed the interview due to you and your spouse giving different answers to the same question. I assume this was a Stokes interview where you were separated and questioned individually. So there must have been some suspicion as to the authenticity of your relationship prior to the interview.
    After you failed the interview your spouse withdrew the affidavit of support and your AOS was denied.
    You and your spouse have lived apart for the past three or so years with little to no contact. Now you suddenly, three years later, want to reconcile with him so you can get a green card.
    How have you survived for the past three years in the U.S. out of status? Have you worked? Have you presented yourself as a U.S. citizen?
    Have you spoken to your spouse recently? Has he indicated he would like to reconcile?
    Why haven't you gone back home in the past three years since your green card was denied?

    What is the reason that your husband withdrew the affidavit of support ? Why did you separate ?
    Even if you failed the interview, I find it strange that nothing was done for 3 years and you and your husband went your separate ways to
    the point that you aren't sure if he divorced you or not. Why did you not stay together ? Why did you not appeal the failed interview 3 years ago
    or get an attorney involved ?
    You are throwing your husband into this mix of all about the green card and it reads like you are very stressed about the green card and don't really care
    about him and want to use him as a means to an end.
    I suggest you narrate the whole story so you can get a real answer instead of one short sentence here and there. It is frustrating to read and none
    of us have a crystal ball. Half disclosure yields half answers.

    sounds like it was not a bona fide marriage and more like an arranged one. You are avoiding to answer our questions, who has supported all this years? sorry but you aren't getting a green card in the situation you are in.

    At least twice people have given you questions that they needed you to answer in order to better help you. Without your answers, what this looks like is that you care more about dealing with a green card, rather than help dealing with your marriage. Your responses have only been more questions about the green card.
    Can you please answer the appropriate questions and give more detail/information so that people can better help you? I know there could be a language barrier, but if you don't answer, it sounds fishy, and we don't condone fraud.

    Your story is not 100% clear, but is this the correct summary?

    1. You came on K1 visa and got married in 90 days.
    2. You filed for AOS, failed 2 interviews, and got denied of GC.
    3. Therefore, your husband withdrew the AOS.

    4. You failed the interview because answers you gave were different than
    the answer your husband gave?
    *** What specific question and reasons did they tell you on why they failed your interview? ***
    *** Did they say, they don't believe your marriage is real? ***
    *** You need to tell us specific details so that we can help better ***

    5. You need to be in good marriage relationship with your husband,
    before you are qualified and to have a chance to file for AOS and get GC.

    If you are not living together, and not clearly talking to each other to a point
    you are not even sure whether he filed for divorce, then you have no way to file for AOS.

    6. Do you really want to marry him because you love him?

    7. What was the problem in your relationship?
    Do you believe he still wants to be married to you?

    Bottom line is, if you can restore the "true" and "normal" marriage relationship with him,
    then I suppose you can file for AOS again (though I don't know what the law is in this case).

    But if your marriage is virtually broken (though not divorced yet), and your husband is not
    willing to sponsor you for AOS, then there is virtually no way you can pursue the GC by yourself.

    Sounds like you're more about the green card rather than the marriage. Marriage first, than worry about the green card. Where are you living? How are you surviving? Are you certain that you're still married? Is he in contact with you?

    Congratulations for every one did his interview already and got approved ....and good luck for all others still waiting as me and everyone else .....please guys if any one apply to field office NEWARK NJ and still waiting post his experience and when did he apply and when he did fingerprints to try to get a picture of when we can get our interview...i just went yesterday to INFOPASS appointment and they said still pending and i did my fingerprints more than 3 months ago !!!!!
    please share your experience guys with NEWARK NJ office....GOOD LUCK FOR EVERY ONES HERE.

    I had my oath ceremony today and am officially a us citizen!! It was held in Moaab , The Arches National Park so my Husband and I went down last night and made a trip out of it. It was supposed to be at a lookout but was raining so got moved inside. Started early as everyone was there. They started off with all different natuonalities, 4 of us were from UK:-) , and then a group of students sang national anthem. We then stood up and took oath. We didn't have to repeat word after word, just hold up right hand and say I Do. At the end there was a chance for anyone to come up with their stories. I'm quite a stoic, stiff upper lip, kind of person but even I got a lump in my throat. What was interesting was the woman conducting it urged us to keep embracing our cultures, thats what makes America what it is. Then we got certificates and had pictures. Also had a little'party pack' with letter from president, passport application, voting info etc.
    Feels so good that I now have the same rights as everyone and can put all this behind me. Thank you to this site and everyone that has helped me over the years. Its because of you everything since 2008 has gone smoothly and I hadn't had to get an immigration lawyer.
    Good luck to everyone. You have all worked so hard to get to this point!

    I had my Interview today, it went pretty smoothly as expected. My interview was at 10:25, I got there 15 minutes early, and got called in almost on time. Before starting the official questions, the officer asked about my job and where I work. Then he started with Reading/Writing test followed by six civic questions:
    What is one promise you make when you become a United States citizen? What movement tried to end racial discrimination? What did Martin Luther King, Jr. do? Where is the Statue of Liberty? Name two national U.S. holidays Who was the first President? Then, he reviewed the Yes/No questions and finally asked me about my Birth certificate, I told him that I was not asked to bring it to the interview but I had submitted that when applied for my GC. He said it is okay.
    He gave me couple forms and papers and asked me to sign them, when I reached to the last page, I realized that is my case approval letter! He said do you have any question? I asked when will be the Oath ceremony, he said 2 days from now, May 7! Then he asked me to wait in the waiting area until they give the Oath Ceremony letter.
    Whole process took about 1 hour.
    Just two more days left!

    I'm not trying to give you my opinion but BY LAW you know you are supposed to exit and enter the US with the US passport. Not doing so is against the law. I'm just trying to help you here. Im not trying to force my opinion on you.

    I am not sure ignoring it completely would be the right thing to do. I would establish if it was truly legitimate first. Inquiring with the local FBI office would certainly clear this up and also open up a case against the person if was in fact a scam.
    If there is a telephone number, then the FBI could track that.
    the FBI, just for information sake, is in charge of handling federal issues within the US Territories. So it would be completely legitimate for them to inquire on a potential US immigrant if they had concerns..

    EDIT: Im not saying it is legitimate or not. Im just saying you should contact your local FBI office.

    That letter should be turned over to the FBI. The real FBI doesn't go around leaving letters on doors nor do they use language such as you suggest here.
    Someone knows too much about his case & your business & is going to attempt extortion. Do not contact them prior to the local police or FBI.

    I would like to express my gratitude to all members of VJ community. You've helped me a lot in processing my Green card. I am a silent observer. I read/ researched the topics related to my case ever so often while I'm processing my AOS and a great help indeed! I think I owe those who are also pursuing their american dream a little contribution on my part as a VJ member.
    Here is my interview experience:
    April 29, 2015
    Me and my husband arrive at USCIS around 9:45am. Waited for about an hour. The interviewer was very nice and kind. She let us stand and oath. After that we've seated and she told us to bring out all the IDs, travel documents, original certificates. She checked if it matches all the documents that we have submitted from the original one. Then, satisfied, she ask us some questions:
    A) if US citizenship based on marriage?
    B) If I am H1B visa and if current. ( I came here on H1B )
    C) How we met?
    D) then she asked for joint accounts / joint names - documents
    - I gave her some that I wasn't able to submit ( previously ) like our recent ITR, utility bills, car registrations, titles and more pictures.
    E) asked about my parents coming over to our wedding and if they stayed for how long?
    G) when and where was our recent vacation?
    Interview went well. We almost chorus out answers. After the interview she gave us a paper with a checked-mark on background check pending. she explained that they are still waiting for my background check. Then my husband asked if there's any problem? And she said that all documents were complete except for background check.
    We went home and I check my status on line, it was still the same. Then the following day I checked again and it says - card under production. I was so happy. Then after a few hours the I-90 was approved. Then welcome letter was sent. I thought I will be in this black hole ( background check ) for a long period of time but thank God that long wait didn't materialize.
    I filed : January 21, 2015
    EAD received March 19, 2015
    Interviewed : April 29, 2015
    Approved : April 30, 2015
    - Card under production
    - Welcome letter was sent.

    Why wouldn't requiring 'US Citizenship' be legal? For example, there are many gov't positions which require US citizenship.....nothing illegal about that requirement, especially when pertaining to National Security or Federal Gov't.

    You will find that the US is an employer-friendly nation and prospective employees can be rejected "without cause" very easily. The employer will simply state that there were other "more qualified" candidates. Case closed. Once you are hired and have been employed for 60 to 90 days, terminating you becomes a bit more challenging but employment contracts are generally unheard of for all but very top level directors and officers and if the company wants you gone they can find a way to do it legally. I am not saying this is a bad thing, it is just the reality of employment in the US. On the plus side, IT is generally a good field to be in in the US and most companies are pretty decent to their IT staff. It is quite easy to make yourself "valuable" in IT here and have a job for as long as you want it.

    Use immigration attorney...
    1. If you have unusual and/or difficult circumstance
    2. If few thousands of dollars is insignificant
    3. If you are not good at or interested in reading and following instructions
    4. If you have ADD/ADHD and immigration paperwork is not in your interest
    5. If your English is limited
    6. If you are lazy and don't like dealing with paperwork details
    7. If your IQ is way below average
    Do it yourself...
    1. If you have pretty normal circumstance
    2. If few thousands of dollars is significant
    3. If you are good at and interested in reading and following instructions
    4. If you don't have ADD/ADHDt
    5. If your English is reasonably OK
    6. If you are not lazy and don't mind dealing with paperwork details
    7. If your IQ is close to normal or higher
    Personally...
    This is my first time filing for K1 visa, and I was completely intimidated at the beginning
    when I didn't know what to do. However, upon reading few VJ guides, my confidence level soared.
    And having such interactive discussion board to ask questions and to have many folks who's
    gone through the paperwork and processing themselves to answer in a reasonably timely manner
    really put the icing on the cake.
    Visa processing is NOT trivial and its' not for everyone to do it by themselves.
    That said, for someone with average intelligence and normal situation,
    I would say this is about as difficult as filing a income tax with itemized deductions...
    which by the way...is also not for everyone to do it by themselves.
    Finally, I would say that without the VJ site, I am pretty sure that I would had to
    resort to an immigration attorney.
    Therefore...thanks VJ...and thanks all VJ members!

    I understand the whole process is frustrating and we are only human. I know I was very careful with compiling what I needed for the filing phase and there were still times when I doubted myself. However, I still believe the VJ guideline is very straight forward. I made sure that my husband double checked everything I did so that fresh eyes could check for any mistakes. I'm sorry you had to re-do the whole thing, but you can only blame yourself. There was a checklist on the guides for a reason. That said, I'm glad the second round is less stressful to you.

    Thank you for advice to others Estelle.....although most people don't find much of a problem with filing some people do. My husband and I used a Lawyer only because we were both extremely nervous about the whole process and he was like our security blanket. It did pay off for us to use him, our process went very quickly to both our surprise and that of our friends that filed at the same time as us. When we went for our interview the Officer started looking through our paperwork and noticed our Lawyers name and made the remark "well there is no need for me to check all this he is always spot on with his paperwork" so sometimes yes it is a great advantage to have a well known and respected Lawyer handling things for you. I have to admit though, after actually seeing all the paperwork and now looking at this site, I think I could have handled it all myself but at the time it was nice having someone hold our hand too.     this is going to sound a little harsh, so i apologize in advance. It proves that you're pregnant. It doesnt mean the peitioner is the father etc... You can send it, but it's useless information about your relationship (like ring reciepts etc.. ) Sending quality evidence such as proof you've spent quanties of time together (photos especially with family, boarding passes, etc..); evidence that you spend regular time talking and communicating, and finally send along any financial co-mingling if possible or naming of each other as beneficiaries on documents. An ultrasound has no weight, rather like affidavits. I do wish you the best of luck and I am truly sorry if it sounds mean. I am not trying to omply anything, just trying to explain the view of an outside person who likely doesnt care about you, or me, or anyone on this board. I do hope you have a safe and wonderful pregnancy.
    I also apologize for typos. Im on my phone this morning!
