    Her birth certificate and police certificate are sealed in a big envelope along with other documents. The embassy will give this envelope (sealed) and passport back to her. At POE, she needs to give the sealed envelope to border officer.
    No, she doesn't need a letter of intent to marry to come. Her k1 visa on her passport allows her to fly over. Not the letter of intent to marry.

    Try to apply for an I-601 or I-601a waiver. When my husband and I got our I-130 approved we immediately filed for the I-601a because he tried to come in to the U.S illegally in '95, he was caught and immidiately sent back to Mexico, he never made it across. He tried again in '97 and has been here ever since. He just had his visa interview on Monday and was approved! When someone says they cross over with family or even friends, it is seen as immigrant smuggling, so I am not sure if the waiver would help you in your case. I would seek legal help from an attrorney. Good Luck!

    Page 12 goes over alien smuggling. However, it doesn't look bright.
    I am so sorry this is your situation, but you guys didn't think this might be a possibility? You didn't know this might come up before going through the whole process?

    It happens every day 365 days a year as far a I know. Anyone at anytime does ship just about anything into the US and its a nightmare for the ports I'm sure. Obviously as long as the contents fall within legal rules (ie not hazardous etc etc) its legal and happens every day.
    I would think the K1 process has nothing what so ever to do with what you ship and when. What matters most is that you are shipping items which are allowed by the US postal service or other agencies. So as long as you follow shipping laws and rules, you should be able to ship anything any time afaik. How does the parcel system know whether the person sending you stuff is immigrating, or just a relative or friend sending stuff - or someone shipping an Ebay item for that matter? If all of this is not the case, I'm all ears.

    How would the postal service, a shipper, or US customs know anything about the immigration status of the person who is shipping the goods? Where are these shipping provisions described? If my fiancee sends me a birthday present before she arrives, is that unauthorized? So your statement, if true, still doesn't make any sense to me. Also, you say my fiancee "must only ship goods once a visa has been issued"; in our case the visa has been issued but just hasn't been used yet. Thanks. -- Stu

    I had no problem with my POE visit today! Basic questions, in Winnipeg, Canada.
    Where are you going? San Diego. What for ? To visit my fiancé. When are you coming back? Tuesday. When are you getting married? When we can, depending on visas. Who is moving where? I'll be moving there. What do you do? I am an early childhood educator. Then he said have a good flight and let me go.
    I may have been slightly stressed about it for no reason.

    So now we're all lying about our NOA dates from CSC?? They can come and look at my NOA1 and NOA2 from CSC (from January/February of this year, VERY recent).
    42 days between the two - that is not quite 5 months!

    I don't recommend not having a round trip ticket either. I'm not sure how my comment was interpreted that way, lol. I ALWAYS tell people they should get a round trip ticket. Even if people get through, it looks fishy. My comment was just stating that they *say* it's not enough proof, but most of the time they don't even ask for proof at all. Round trip ticket is better proof than none! And yes, I've heard UK customs is worse than US! hahah!

    The poster I quoted is the USC traveling to the UK from the US, so it's different to the majority of the experiences posted on this thread. UK Border Force can be a lot less welcoming than what you deal with at passport control going into the USA. As someone who lives in the UK and has traveled a lot, I don't recommend a one way ticket if a round trip is an option. It might be fine. It might not. To me, it wouldn't be worth the risk.

    Customs will tell you that you NEED pay stubs as proof. When I called, they told me he'd be most likely rejected if he didnt have that. But they didn't ask for any proof at the airport. We had a round trip ticket as our proof, and they didn't ask for it. They never have. BUT it differs, and it all depends on the officer coming in. To answer the question if the round trip ticket is enough- yes and no. Sometimes it is, and sometimes it isn't. You take a risk coming in, so just be prepared, but from most of our experiences (if you havent read the 73 pgs hahaha), they don't even ask for any proof.

    So he is flying from the US to the UK?
    Is there a reason why you are looking at a one way ticket instead of a flexible fare round trip, which allows changes? Flexible tickets are more expensive than a standard return, but usually much cheaper than two one way tickets. I would anticipate he is less likely to encounter problems if he just picks an estimated return date to book a flexible round trip as he will then have the option to change it without penalty later to suit your timescales once you know where you are with the visa. At least that way he enters the UK with a date for return.

    To keep things simple I will summarize:
    I am not a lawyer and this is just a recount of our experience. I can't be held responsible for what happens to you. I am an American citizen My (now) wife is an Indian citizen She had a valid tourist visa from before we met I submitted the I-129F on 2014-04-05 I wanted her to visit so we could do some house shopping I contacted the immigration officers at the airport she would arrive from and explained our situation They told me that as long as she had a valid tourist visa and was going to return they would let her in I repeat, as it was their only concern: she had to prove that she was going to return We bought plane tickets for her to arrive 2014-09-13 On 2014-08-26 I got her NOA2 saying her application was approved I called the immigration officers at the airport again and they said she can still come She came on 2014-09-13 and the immigration officer asked for evidence of her return and she showed him a copy of her return ticket (on her phone) She returned a few weeks later to complete the visa process Long story short, it is possible to enter America on an existing tourist visa with a pending/approved I-129F as long as you can prove to the immigration officer that you will return. I think it is at the discretion of each immigration officer but I spoke to ours before I bought the ticket.

    I will share our story for future filers. Didn't read the whole thread, maybe someone already had such experience but anyways.
    I have a 3 year tourist visa to US and came to visit my then boyfriend now fiance on October 8 2014(I was admitted to the country until Apr 07 2015). At first it was my plan to leave in 3 weeks, but since my work contract was done we decided I could stay longer. So while I stayed as a tourist we got engaged and filed K-1 petition with NOA-1 date Jan 02 2015 (knowing that I will need to go back for the interview and everything else to Russia). So our petition was approved Feb 13 2015 and I am still in US. Now I am planning to leave to get ready for the next step-medical.
    Pretty much for those who are doubting if they can be with their loved ones during the process-yes you can.

    i know time apart is not key or optimal but that is the reality of things and as we bear it, our relationship will be even stronger than it already is. At least that has been my case. I do know others that the time apart has been and put a strain on their relationship. Everyone's circumstance(s) of course can be different. Best wishes to all. We are nearing the end but, not there and, one continues to press forward

    Guys chill out. I was at Texas for four month then by God's grace was transferred to California. My application technically was processed in 5 months the national norm but because I had a couple of items missing I had to send them in, they viewed and approved . Have patience. Many people have wasted, some from my group are STILL waiting at California. It has only been two months for many of you . I knew some people waited 12 months just for the NOA2. Keep yourselves busy and work on strengthening your relationships. The wait will test your patience and pledge as a couple . Learn patien and your relationship will be unbreakable

    That's what we did last October, and had no issues.
    It will work out okay.

    After reading posting after posting, I get the distinct feeling that the government bureaucracies are way behind in everything, i.e., their correspondence replies, their adjudication, their delivery transfer process, etc. Though I suspect that they are real quick to get the money.

    That's not what I mean at all. I still got an RFE for someone else. So that's not even what it's about.
    I made this post for people who also forgot it. Mind the word forgot. Not to stress like I did. Because I was loosing my mind and just waiting for them asking the pictures. I made this so others in the same boat. Could still have hope that they didn't ask me for pictures.
    I never said don't send them. They are really important obviously. But it's not worth stressing out about.
