    You were supposed to apply for a renewal before it was close to expiring, they let you apply for renewal 120 days before the expiration date. If the EAD expires, I don't think you are allowed to work until you receive the new one. You may be able to request an expedite if you are working and will experience financial hardship if you lose it. I believe the renewal takes about the same time, it could be 2 to 3 months for normal processing.

    I just double checked, it's taking 3 months at the NBC, but a lot of times it's issued in less. Like I said, you may be able to request an expedite. Here is some info on expedite requests:

    If it's to print them, yes, it should be very cheap. I don't think they would charge extra for cutting them if you do it yourself. I know most pharmacies charge $10 if they take the pictures and print and cut it for you.
    As to an RFE, I have no idea, I would think not, but that's only speculation.
    If you took the pics yourselves, just take it to any chain pharmacy or Staples and see.

    Because his brother told him to get one. And before I saw all the forms I thought that it would have been a hassle to fill them out ourselves. After I finally saw the forms and found this website I regret it now. Having a lawyer was a total waste money.

    You could use scissors, but you need to have a really steady hand, I'm not sure if you would be able to cut them straight. I wouldn't risk it and use a paper cutter instead. You can try a pharmacy, like Walgreens or CVS, they should have paper cutters there or picture cutters, also Staples.

    I do my own passport photos, but I bought a paper cutter on Amazon.

    Preconceived intent alone is not enough to deny the AOS, in your case this doesn't seem like the case anyway because you didn't know he was going to propose when you came here to meet him.
    I wouldn't include this since it would be unnecessary and would point them to think something else. You don't have to prove that you were going back to your home country. Only submit proof of what is required from them, nothing else. The important thing here is that you didn't lie at POE.
    For example, if you said that you came to visit a cousin instead of your boyfriend, that would be something that could come back to bite you. If you came here to visit him and your circumstances changed after entry, meaning he proposed and you got married, you wouldn't have any problems. Good luck.

    I wouldn't be too quick to judge this "drug trafficker". That is defined by the INA and does not necessarily mean that he is a drug dealer. That aside, there are no waivers available. You could take another run at vacating the charge. He does not need an immigrant waiver for a non immigrant visa ie. a visitor's visa. I have seen many people return on these for visits. He shuld get his life squared away in a way that is demonstrable to the US Consul and he might be able to get one after a couple of years.

    You are passing judgment without having any idea of the facts. I have seen many cases where people havetaken "trafficking" convictions withut being dealers. You buy some weed and split it with your friend. You have possessed with intent to distribute which is a trafficking crime under the fed law. It was much better when the judges had discretion in these cases. they could look at the facts and decide. Certainly what you and I think of as traffickers should be deported,b ut a lot of people with minimal culpability get caught up in the net.

    Right, and we could all be starving, or we could be dying from the plague, or we could be enslaved....does that mean no one is allowed to complain about anything ever? Everything could always be worse.
    Yes, you expect to gather paperwork to become a citizen of a country, but it becomes increasingly infuriating when there is no logic to the system. This has been four years now of submitting the same stuff over and over again (registered copy here, in duplicate there, don't sign here and make sure you notarize this initial there, oh and we'll need another $1k for the 15th biometrics appointment, you know, in case my husband's fingerprints changed in the last year) and it's obvious the immigration departments do not speak to each other or even reference a centralized database when looking through the files. A database probably doesn't even exist.
    I have provided the so-called 'missing' documents that are currently delaying our case countless times on prior forms and packets, yet because we didn't produce them AGAIN when we weren't even asked to bring them to the interview in the first place, they were not yet able to approve him at the interview. It gets to the point where I feel like they're just making up the rules as they go along based on how they feel that day.

    There seems so many cases of mis trials. Seems to get justice you need a big bank balance. So to assume he is say a big dealer in crack may be jumping to conclusions.

    Ian H. reacted to jan22 in J-1 Visa - Getting Married with 2 year rule
    A point of clarification -- the two year rule is not limited just to those for whom a government provided funding. The J-1 is, basically, an exchange program visa; the recipient is generally expected to take what they have learned about the culture and systems of the US back to their home country to share. There is a reference in another post here on another reason why the two year requirement can apply-- the "skills list". This is a list of fields of specialized knowledge and skills that are needed in the J-1's country of last permanent residence for its development. For some countries, that is basically anything the person does -- learning English may well be one of them and the rule would apply regardless of the source of funds for the J-1. The skills list is country-specific. You can review it in the link below (FYI, it says it's a 2009 list, but that's the most recent -- it hasn't been updated since then.) Not saying this will definitely apply to your case, but many people assume that if there is no government funding, then there is no way the two-year rule can apply, and that's not right.
    From the Bureau of Consular Affairs information on J-1 visas (http://travel.state.gov/content/visas/english/study-exchange/exchange.html):
    Two-year Home-country Physical Presence Requirement Conditions - An exchange visitor is subject to the two-year home-country physical presence requirement if the following conditions exist:
    Government funded exchange program - The program in which the exchange visitor was participating was financed in whole or in part directly or indirectly by the U.S. government or the government of the exchange visitor's nationality or last residence;
    Graduate medical education or training - The exchange visitor entered the United States to receive graduate medical education or training;
    Specialized knowledge or skill: Skills List - The exchange visitor is a national or permanent resident of a country which has deemed the field of specialized knowledge or skill necessary to the development of the country, as shown on the Exchange Visitor Skills List. Review the Exchange Visitor Skills List 2009.

    If he was deported, it's because he committed one of those crimes that don't qualify for a waiver, then it's pretty much over for him. Unless you're friends with Obama, seeing as he's the only one who can pardon him.

    This is only true if he abandons the australian application (as he says he will). If you apply for another country after you get your green card it is obviously a case for being deemed to have abandoned residence in the US. That's not the case here but just clarifying your statement for others.

    Exactly! Many tend to forget that a K-1 VISA is quicker because it is only a VISA whereas the spousal visa route, CR-1/IR-1 is a visa plus the adjustment to LPR status. When you add K-1 time plus AOS/EAD/AP time, you get about the same total time (or sometimes longer) as CR-1. K-1 cost more in the long run too. The primary advantage of K-1 is entering into the US faster, but trust me, the AOS process isn't fun and games either. My wife is bouncing off the walls waiting for her EAD so she can get out of the house and go to work...

    The senator's record is no better. I can't wait until we can move out of the red states. I find myself worrying about these types of things affecting our immigration journey if we run into any road bumps. Of course the longer waiting for noa2 takes, the more anxious we get that there's some problem neither of us know about.

    This is for the others who will have the same question. The package really arrived when FedEx confirmed it. USCIS sent me a confirmation 5 days later with the date when they received the package by FedEx. So, they probably need 4-5 days to process it. NOA arrived 8 days after.

    Try to educate yourself how priority dates and visa bulletin work.
    Right now people that applied in March 2013 will get their visas, and as the bulletin's PD for F2A moves forward, they will be getting theirs. If you apply today, you'll get yours in ~1.5 - 2 years. Of course that's all somewhat speculation, as no one can really predict the movement of the bulletin.

    What category are you under? If you are referring to F2A, visas were current for a few months last year because there weren't enough applicants compared to visas, therefore the PD's were current. That may not happen again, at least not anytime soon.
