Laws are just laws and can be changed. Specially if they are for the common good, which in this case they are. It is very funny to read these sort of bogus arguments in regards to a country that was founded on illegal immigration. Just like President Obama said, if you're not Native American you're from somewhere else. Do you think Native Americans were pleased with how the colonialism went?

I think this is an impossible situation and the OP should just move on and focus on the divorce and his child. That's what matters here.

But legally, they are still married and she could easily argue they are working things out.

This thread says it all. There are even members posting on this forum for many years now with no immigration to do, who are here 24/7 and randomly just attacking new immigrants.
I think this is a self esteem issue, mostly.

OP, please disregard all the answers given so far. Some people on this forum like to pretend they are lawyers when they are not. Seek a lawyer to look into your VAWA options.

What a mess... Calling them is useless since they probably know as much as you do over the phone. Send a letter explaining what happened, preferably, a notarized affidavit. At what stage was the AOS? There is a strong possibility that you'll need to submit everything all over again. This is not some game, so please think about what you do. You have every right to withdraw the affidavit of support, but think about what you are doing first and how you are affecting your spouse.

Very true. I studied in Northern Europe. My tuition was free, including books and the state was giving me the equivalent of $900 for being a full time student (welfare program that every student gets depending on how far they reside from home), which was more than enough to get by. Also, minimum wage was the equivalent to $20/hour. That's what mcdonalds workers make there (compare that to the $7 they make here). I graduated with no student debt and some savings. (Most americans find this hard to believe).
I've read some posts here considering in-state tuition ($5000/year on average, I believe) a handout... lol. It just seems to me that there's a correlation between low self esteem and hatred for immigrants in America. As if immigrants are the reason for all the problems in this country. History is completely forgotten or they'd know that most of them are descendants of poor, sick and starving immigrants, "Give me your tired, your poor, Your huddled masses yearning to breathe free..."
It is specially ironic to read derogatory comments towards immigrants in general, from people who are immigrant themselves.

What exactly is a victim of visa intent?
Your wife wasn't even living in the US. I hope you realize that she won't be able to visit you anymore. And from what you're saying, she even invited you to come along with her. Understandably, you declined and her life was taking place 400 miles away. Thus not even taking any advantage of any benefits that resulted from the petitions you filled.
From a sociological stand point, I think it's fascinating that on a break up, instead of both individuals trying to stay friends and having a positive relationship, the opposite happens. It's as if both want to hurt each other as much as they can. And when the immigration system is as old as here in America, Immigration status is used as well.

Only the beneficiary can tell you, if he/she options to. There are strong privacy laws in place, precisely because of abusive situations.
I don't know why you want to know this, but let's all continue with our lives, shall we?
