    After reading instructions of I-9, employer cannot ask for specif documents to verify employment eligibility. The prospect employee can present documents either from List A, or documents from list B AND C but not only B or only C. Documents in list B and C include but not limit to a valid Driver's License and Social Security Card.  In case of doubt, take the time to read the instructions to correct me if I am wrong.

    More good news! I was able to schedule appointment at Mexican consulate next week to renew my passport. I was blown away how fast I was able to schedule this appointment even chose the date and time   Also like every morning, today I checked for infopass appointment online and BINGO! there was one day available with times to choose from 7:15am to 2:15pm, I immediately chose my time and got the confirmation appointment letter to print.  One week from today I will be getting my passport and two weeks later my infopass appointment to get my extra year extension stamp. Just in time to get ready for Fall semester and to prepare for a job interview in few more days

    My question was an honest question. I don't understand why some vj members feel the need to be so harsh when they reply. I bet some would be deligted to be IO to flat out deny any benefit to applicants for not breathing at certain rhythm. At the end it is everyone's decision on what to do on this matter, and I wish I hadn't ask this question after reading some responses.
    Posting a honest question here sure is like adventuring into a eggshell road. I don't see why some members respond in a way that new members rather stay away and hopefully find help somewhere else. I am not going anywhere because I had great deal of help here from other members who at least respond with minumum respect about some knowing more than others and simply answer without any harshness.
    I have been asked questions via PM and I don't mind to answer the best I can. Now I see why some rather stay away from some threads and hope for the best when asking someone in a private mode.
    Where is a pinned thread about this topic since it is a matter of controversy and things can get clarify by the expert vj members and others like me read there first before asking again?

    If affidavits are considered weak evidence, why are they listed as No. 5 in the list of evidence in the instructions on how to fill up I 751 according to uscis website? page 6/10 . Please clarify. Thank you

    I am not an expert on this immigration process since I am fairly new to it but others had given you enough information on how to proceed in your situation.
    I am sorry you are going thru this difficult situation, unless one has been in your shoes, no one else could truly understand how devastating this is. I was also dumped my my ex husband when our son was only 7 months old, he had H1B visa and I had H4, all he offered was to help me to switch my status to F1 so I could remain here legally ( for our son only) while he continued with his life. It was the must unfair situation, I was left with nothing, he took his savings out of US bank so he would not have to share, 50/50 share of assets never happened. I was terrified, uninformed, had no family here, had only 3 friends and my English was only 40% of what it is now. My son is now 10 years old, I went thru hell during all these years and I am going to tell you this, YOU WILL MAKE IT! it will hard and some days you may feel you can't take it anymore, but you and your daughter will be alright. You will have to learn to be strong, brave and if you have religious faith then hang on it. Now I look back and after all the pain, the very very dark times, I was always watched over. I made it thru even after when I went out of status for not being able to pay out state tuition anymore, credit cards maxed out, living with a friend, work permit application was flat out denied when I applied while I was still under F1 visa status. I kept pushing forward and after 7 years of being out of status now I am currently in the process of AOS. I was a single mom for years until I met my now husband. I waited for the right man to come to our lives to commit to marriage again, after all I went thru I did not want to end up in a bad marriage ( there are never guarantees as we know) but life is good again for us, I have a family again. I survived what at times felt like an everlasting storm and I learned so much during this journey.
    Once again, trust that things will turn around for you and your child. You will learn that you have strength you didn't know you have. It will take time to realized this but I share a bit of my story to tell you that even when it is hard to see that things will be fine, you will smile again and find joy and comfort in your heart. Take it one day at the time. Good luck!

    I am new to this forum, I've been asking questions and getting some anwers...thank you so much! I am also browsing through many other threats to see what information I can use and I have come across to many , way too many sarcastic replays. Why? are they necessary? why moderatos allow that? who gives power to who here? isn't this place to ask valid questions without being made fun of? is this a safe place to get some real help to go thru such hassle process? please please do not make offensive remarks to others, they don't help. If you don't have the answer to the questions just don't post anything. Thank you

    I think you may just want to pick your battles on this one and perhaps consider the context of the forum and thread where you are currently arguing your (largely irrelevant) political opinions. Either the individuals posting on these forums themselves or their very close loved ones are or have been these "foreign types" you speak of who apparently don't deserve their jobs. Also, because a non-citizen is offered a job, at any education or experience level, it does NOT mean they "stole" it from an American. It means they were the most qualified candidate who applied. It's not implicitly about paying them less, as with illegal immigrants -- as previously stated, it often requires a serious investment to sponsor a foreign employee. And if all of the other Americans who applied for the position were not qualified enough and these "foreign types" are being hired before them, then maybe its time we take a look at the education system in this country and how we can better equip our own citizens to secure these jobs.
    If anything, all opinions aside, the last thing you should be doing is taking your frustration out on the immigrants (especially the legal ones!!!) or scolding an individual who simply posted requesting help. Nobody is selling themselves out. This is an ADVICE forum and if you don't want to provide advice regarding a questions someone has asked, then don't provide anything at all. People don't come here to be preached at.

    It feels like Christmas Eve when I was a child! Since I got the tracking # yesterday afternoon I've been checking it and finally this morning while I was at school, it showed that it is out for delivery to destination. Today around 3:30 -4:00pm I will have my GC in my hands finally!!!!!!

    Congratulations!! we also got approved two days ago and our interview went smooth and relaxed. We were not even asked for our marriage certificate nor divorce decrees to our surprised. We were approved on the spot and our interview lasted about 25 minutes. The feeling I experienced when she gave us the approval letter was one of the best I've ever felt so far and I do still feel joyous and most of it , I am so grateful things went so well for us. Now waiting for GC on the mail hopefully next week.

    We are back home, I am tired and feel like a ton of weight has bee lifted off of my shoulders so this is how the interview went for us:
    We left the house 1.30hr earlier and with traffic we arrive 5 mins before 12. They did the security check and scanning, verified my appointment letter and let us in. There were about 15 couples and little by little more kept coming in and I counted in total of 25. At 12:17 they called my name and I was the first from all to my surprise. I got up to grab our stuff and they lady told me to wait a minute and she went back in, talking about teasing!! then she came back again and she just made us a sign to come in and the clock marked 12:20, so we went in 10 minutes earlier than our schedule appointment. She guided us to her private office and we took the oath standing. She asked us to sit down as she pull out our package, it really looked bigger than I can remember.
    She asked us to present our DL, my passport and I-94, EDA and SS card - which I didn't bring with me but she didn't make a big deal out of it-. She started verifying the information on I-130 asking my husband for confirmation of answers. She asked me for my birthday, my parents names and day of our wedding.
    Then she proceed to ask me about 6 random questions from I-485 which answer was no and only one was yes and I gave the explanation and she was just like "ok". She asked me how many times I've been previously married, how many times has my husband been married and she spend a little time going thu my divorce decree we included in the package. She never asked us to present the originals or even asked for our marriage certificate or birth certificates.
    She was marking the pages on the package with red ink as she was going thru them as well as writing stuff in the computer, she highlighted few things on my divorce decree and my birth certificate. She asked me about the name I was born with and I explained her I was adopted and the information was in the back of my BC with my current name.
    She asked us if we have children together and we said no, we only have my son from the previous marriage. She asked my husband how he gets along with my son and he answered " we are great, we do fun things, we ride roller coasters together, do lego sets, etc"
    After all this she asked if we had anything else to present as evidence, so I showed her the documents of the purchase of our new car a couple of months ago, the payment history in the car, the car insurance cards including new car, and she she also asked me for my health insurance card I had put on the desk while getting my DL, she said " I am sure you send a copy of it in the package but just let me include it again here" and she wrote all that in her notes.
    I also ask her if she wanted to take a look at our photo albums, she asked if we sent pictures with the package and I said " yes we sent several" she said " ok let me look at the pictures you brought" and she barely looked at them and gave them back.
    She spent few more minutes writing stuff in her computer and printing sheets she made sure we would not see by folding the top part over and putting some stamps on them. At the end she printed two more pages, one was my approval letter and another was the instructions how to do ROC. At the end she asked if we had any questions, we said " no thank you" and she said " this finalize your interview, let me escort you to the exit" and off we went out of the office with a huge smile on our faces. It took about 28 minutes but they went pretty fast.
    She was very pleasant, not too cold but not too friendly, just doing her job but for sure she made me feel at ease and relax a lot more.
    2 hours later I got the notification that my card was in production.
    After celebrating having lunch and ritas in my favorite restaurant we headed to the College I had already enrolled two weeks ago to buy my text books and ready to start classes for Fall semester next Monday August 25.
    Life is good and I am so grateful things went so smooth for us right from the beginning, we didn't hire a lawyer, we did not have RFE's and we completed our journey in 3 months. :dance:

    For what I've seen it also depends on what visa you are adjusting from. This particular sub forum is for applicants with F1,HB and B1/B2 (Student, Work and Tourist Visas) and most of us here have similar timelines. Your topic shows you are adjusting from K1 which is fiancee visa, if you read in the Family & Marriage based US visa forums you will find all the posts from applicants from K1 and check their timelines. Their process can take any time from 8,9 months to a year but some do not go through the interview step.

    Hi all!
    I just wanted to share some information about rescheduling the AOS interview. I read a lot of old posts on this forum and everyone really seemed to discourage trying to reschedule. Since people rarely write when things go well, I thought I'd share what I did.
    About a month before the scheduled interview I sent a letter requesting to reschedule our interview to the local USCIS office. I explained my reasons (back home in Sweden, scheduled to work and that having to reschedule would result in loss of wages and airfare). I attached my employment contract with english translation and a copy of the interview notice.
    About a week later I received a letter from the field office director at our local USCIS office that our request had been granted. The letter had two boxes: 1. "The above referenced interview will be rescheduled" and 2. "Your request to schedule has been denied for failure to demonstrate good cause." Which leads me to believe that attaching some kind of "proof" is important. Obviously it's almost impossible to know what they deem to be a "good cause" but if you want to take the chance/risk I think it's worth a try.
    I sent my letter about a month before the scheduled interview and received the response from the local office a week later, however, USCIS did not update my case status and send a notice about the rescheduled interview until yesterday! So it took a while for NBC to respond as well. I was planning to call if I didn't receive a response from the local office, but since that came so quick I didn't worry about it!
    I'm waiting for a new interview but requested it to not be before Sep. 1 so we may be waiting a while! It doesn't bother me though since I have the AP and EAD card.
    I deemed it to be worth to take the chance/risk to reschedule despite the horror stories and it worked, however, I think everyone should weigh their options carefully. Still read the horror stories (as well as the positive ones!) -- then decide!

    My USC husband and I put our package together without any lawyer's help. We initially consulted two of them and both told us we were a straight forward case and we could file on our own or hire them. As you can see in my signature my timeline my interview is coming up, we did not have RFE so far. I have been F1 out of status for over 7 years, my Mexican passport is expired, my DL is due to be renewed on November and does not show my current address where my husband and I live. I did my own birth certificate translation and we took our time to read, learn, ask questions before we send the AOS package. It took us around 3 solid months to work on it but it was worth it IMO, like I said, we did not get any RFE while waiting for interview letter. The possibility to get a RFE during the interview is still there, but we are preparing ourselves to bring all the original documents, photo albums and a set of copies of our original AOS package. We were expecting our process to take 5-6 months if not more, so 89 days from applying to interview day looks pretty good to me.
    My advise is to take your time to learn the process. I asked questions in this forum, a lot more questions on justanswers.com and few other at avvo.com.
    If I get my EAD card before the interview then I can go ahead and renew my DL and update address and name ( married), but if not my DL is still valid and that is good enough for the interview.

    I remember you can walk to the POE offices from within El Paso without crossing the border by the left hand side as you face the bridge and have Juarez in front of you, well not really into the office because right there is an IO checking visas for the people who cross walking, you the USC could walk to that point and bring your wife's AP card and ask the officer if your wife is safe to use it again given the particular circumstances ( explain your reasons to constantly going back to Juarez and the way this other IO treated your wife, and because of that she is scared to cross again) it won't hurt to try. Not all IO are immigrants haters, some actually do their job just fine.

    Did you guys enter by the Paso del Norte POE? or the other one by Louetta?..don't remember well the name but it is on the east side of town and it used to be a lot less crowded your wife must know which one I am talking about. I am from Chihuahua and I know very well how extremely rude the IO are at this particular PUENTE, some IO literally terrorize people and I've seen it with my own eyes, it is very traumatizing. We never had a problem crossing by either POE showing my visa. I am so sorry your wife went thru this, it brought back memories of those experiences I've witness and they make you feel your life is in their hands. It should not be like this, they applied for this job and they agreed to deal with thousands of people a day who deserve the minimum respect like every human being.

    wow this forum exploded with new posts the last couple of days! yay! for me it's been a week today since my AOS changed to "testing and interview" I was hoping to get another notification today saying that my interview letter has been sent in the mail but nothing so far. I wonder why they moved applications to the this stage if the letter will take much longer to arrive. I know I sound a bit impatient but being in this sorta "safe" stage ( no RFE for I-485) gives some false hopes that interview is next and soon. Oh well, at least things are moving along fine.

    I did all my husband's forms hand-written. No RFEs.
    You can get the forms sent to your house and write on them. So yes, they will read the handwriting.
    You are free to prefer typing.
