I am in the camp of file a new I751 ASAP. Sure the notices have scary words, and if @mindthegap weighs in they can help explain that. Sure the current group in the WH is more focused on immigration things, but as already mentioned, only an IJ can take away your GC, and if you have a new I751 in place it will be hard to justify doing that. Curious as to which carriers are flying from Russia into the EU? Lufthansa? I do know Turkish airways and some Middle East carriers are flying back and forth into Russia, and possibly some airlines into Serbia. I know if my wife decides to go back anytime soon, she will most likely fly through Istanbul given the direct flight between there and Detroit. The last 2 trips (2022 and 2023) were through Dubai, but that was before the Turkish Air flight to Detroit came into being.

Simply put, all U.S. citizens are U.S. nationals, but not all U.S. nationals are U.S. citizens. This may be helpful, but if your fiancé was born in the U.S. or areas such as Puerto Rico, Guam, NMI, or U.S. Virgin Islands, they are a USC. Looking at the form, this is in Part 5. Relative to 1-5 in that section, I would leave that as “NA”, and then put each parents name in items 6-7 in that section. I am not sure how the online form is set up relative to the paper form, but those items should be there. It appears Part 5 items 1-5 is more about petitions that have been filed in the past and were either withdrawn, approved, or denied. Apologies for the confusion, but I hope that helps. Good Luck!

I would apply under the 5 year rule. I believe when filing under that rule all she has to do is provide copies of her current marriage certificate, and any documents showing any previous marriages were ended properly. You should not need the type of evidence showing a valid marriage like you would under the 3 yr rule, but of course an IO could ask about it, so you should have it in the proverbial back pocket. Personally, I would think that being married 9-10 years would be enough evidence. Good Luck! -

Up to you, but it appears she will meet the requirements to file now under the 5 yr rule. It appears you have sufficient evidence to show she maintained ties during the last trip lasting more than six months. Good Luck! -
I am not sure the expiration date on the NOA2 is really meaningful (i.e., it is not like they will contact you and request a new submission/petition). You may also want to contact your senator(s), and can also try the CIS Ombudsman. As to other things, what consulate will be dealing with the petition eventually? Traveling to VN with Expired GC and Extension Letter

The key is being stopped with just an expired GC. Your wife is a valid LPR (not an illegal alien) with valid proof (expired GC with a valid extension letter). I suspect the stories are more about LPRs that left the U.S. for an extended period of time (more than a year), their GC expired, and now they are trying to re-enter. There were stories back a few years with LPRs that were outside the U.S. for more than 10 yrs, coming back and being allowed entry even with an expired GC. I believe there is more of a crackdown on those types of situations. Now with an expired CGC and extension letter, your wife most likely will not be able to use the kiosks at a PoE, but usually there are CBP officials that will direct you and your wife to the proper line for those traveling with extension letters. I agree, you can only answer forms with the knowledge you have at the time. Based on what you posted here, it would be hard for USCIS to prove you knew about it when you submitted the N400 (I.e. lied on your form), and reviewed that form at your interview (knowingly lying during your interview). Keep the evidence in your files that shows when you were informed of the situation, and how quickly you dealt with it when informed. Good Luck, and Congrats on becoming a USC. -

Correctional officers called dispatch a few minutes later and two unarmed officers came out to the fence line to attempt to talk to the group of people, according to the documents.
