Sounds like a case for a very competent immigration lawyer. They need to review the ruling with respect to continuous residence and physical presence and see if they were re-instated back to the date you initially received your LPR status. Good Luck! -
Actually, at least with the I751, there is a little logic being used by USCIS. That form has an extremely low rejection rate, is essentially a waste of time, but is also a cash cow for USCIS. Therefore, in true bureaucratic fashion, this form was deprioritized which is evident by the ever increasing length of the extension letter (keep in mind USCIS, regardless of who is President, does not care about the actual immigrant, they are simply a massive bureaucratic machine). LPRs getting a 2 yr GC, are now essentially a 6 yr GC holder as long as they fill out the I751, and pay the fee. Maybe the extension letter will be changed to 96 months at some point in the future.

So the spousal visa goes through three stages before it is issued. The first stage is the I130 which is processed by USCIS. Once the I130 is approved, it is sent to NVC which is the Department of State clearing house that sends the petition along with the supporting documents to the proper consulate. At the NVC stage you, as the petitioner, is expected to upload supporting documents such as the affidavit of support, there is no deadline for these documents to be submitted, so a petitioner and beneficiary can let the petition stay in a form of stasis at this stage and it will stay that way as long as you do something like logging into the account at least once every 12 months. This is what I mean by delaying a new petition at the NVC stage until you are close to being ready to repatriate. Once you are within say six months, you upload the required documents to NVC, fill out the DS260, and let the petition proceed to the third stage which is the consulate stage where the interview will be scheduled for your spouse to actually get the spousal visa, in this case, an IR1. I hope that makes sense. I am not totally certain what exactly needs to be done every 12 months at the NVC stage, maybe @Crazy Cat can weigh in. Good Luck! -

The airline staff will need to verify your husband has the proper documentation to enter the U.S. so yes, he will need to present his expired GC and the extension letter when he checks in for his U.S. bound flight per the CBP carrier guide. I would make a few copies of the letter as one time for my wife the airline staff in China (also Delta) wanted to keep it. Since one needs the original to present to US CBP, we gave her a copy. I want to make sure I understand, NVC DQ'd you, and your case has been sent to the Consulate? I think you can fill out the DS260 and set up an interview appointment out several months. I am not sure I would delay the DS260 as the Consulate may think the case has stopped and send it back, although I could be wrong. Good Luck!

More than likely, you will need the amended I90 notice if for some reason your card is not corrected before it shows expired. The other thing you can do about a month prior to the expiration of the card is request an ADIT stamp in your passport so you have a continued LPR proof of status. Good Luck!

When your wife arrives in the US with a valid spousal visa, she will receive a temporary GC via the endorsement stamp in her passport. She can turn around and go back the same day if she wishes as she will be a US LPR. Good Luck! -

How long ago was the I130 filed? What stage are you at (USCIS, NVC, Consulate)? I probably would just add it to the documents/photos you plan to take with you to the interview when that time comes. Good Luck! -

Many people travel using an expired 2yr GC and the extension letter, but the person filing the I751 needs to be in the US for the biometrics appointment if required. Given your situation, it might be cheaper in the long run to file the I407 (no fee), and then file a new I130 now since you plan to repatriate in 2 years (what @Lil bear suggested). This would allow you to forget the I751 filing (will receive a 10 yr GC with a new I130 filing), and no need to make multiple trips back to the US to maintain LPR status. You can delay the new spousal visa at the NVC stage until you are closer to the point you plan to return. Overall, it seems this would be less worry, and you can look at the N400 after that. You can list different addresses for mailing and physical, but with a temporary physical address as you described, I am not sure I would list it. There is no online option for the I134, but I would make sure to retain copies of anything she takes to the interview. Good Luck!

Getting GC as insurance question

I agree with @Boiler, if not too much of a financial burden, file the I130, and in 18-24 months look at the situation. If she has no desire to relocate permanently to the US, let the I130 lapse, and let her keep her B2 for visiting. If she wishes to relocate, then continue with the IR5. We did this for my adult stepson as we have no idea what the situation will be in 15+ years. Good Luck! -
In that case why aren’t your husband’s company lawyers handling your case. I work for a large multinational that regularly handles immigration and expatriate tax issues for employees and their spouses/children. Anyway, I agree with others, file the I90 on your own, and then if biometrics are required come back for them. Good Luck!
