    There are 2 ways you can get an EAD: as a K-1 visa holder, or as an adjustment of status applicant.
    EAD as a K-1 visa holder:
    Must pay filing fee of $380 The EAD will expire with your I-94 EAD as an adjustment applicant:
    Filing fee is waived (no cost to file this form) The EAD is valid for one year In either case it will take about 2 to 3 months to receive the EAD.
    If you file as a K-1 visa holder, which is your question, then you will have very limited time to work--or worst case your EAD will be expired before you get it.

    If you send in your I-765 prior to marriage and adjustment of status, you must pay the fee and the expiration date of your work authorization will be the same as your I-94 expiration date. By the time it is approved, your I-94 will be almost expired or already expired, making the work authorization prior to marriage a waste of money.
    If you file the I-765 along with your Adjustment of Status, the fee is waived. It takes approx. 90 days to receive the work authorization after you apply.

    Correction. As a K-1 visa holder she is a LEGAL ALIEN ALLOWED TO WORK. She will need the EAD before she can begin work, but nonetheless she is still legal to work with this authorization.

    To all you kind supporters:
    Wow! Who knew anybody would miss me? I don't seek attention, controversy, or to be one of the popular kids. I just give from my heart to those I see struggling to be with their loved ones. For my entire life, if there is something I can do or share to help somebody, then I do it out of kindness.
    I give hours daily to VJ because there is always just one more person who seems so sincere and needy that I hate to leave them hanging. So when I opened my iPad one evening to check on my people, I see I have been suspended for 24 hours. There is no reason why. I can't see anything...no threads, no mailbox, no profile, no click here. I was very deeply hurt by what felt like a kick in the teeth when I didn't do anything intentionally wrong. So I decided to move on. I don't fight back, and I don't play time-out games. I'm a volunteer. If it is hurtful, then walk away.
    After maybe nine days away, I opened VJ again to check on progress of a couple of people I cared about. I had a PM from someone I was aware of as a regular that I don't normally interact with. It was about tax form 8938. So I replied that I was no longer posting on VJ, but if he still needed help I would be happy to discuss it by email. I guess he informed the UK posse. I didn't mean to cause a VJ bashing riot.
    I want you to know that I have had very kind messages from the the Big Kahunas. They are caring people and provide an amazing service. As for me, this long period of not reading posts keeps my heart from being tugged. It's like going into Petco. If I don't go over to the cages of kitties up for adoption, then I am not tempted to bring one home. I just had a quick read of the UK forum, and there are many posts with incorrect info or uncertain replies that I could fine tune. You are correct that somebody with a six year history of a particular area has seen it all and can offer more than the blind leading the blind. But those people will work it out and get their visas, even it it takes a little longer, they make mistakes, or they stress a little more.
    Meanwhile I have a long list of things to do for myself like finish clearing my desk so I can remember what color the wood is. Work is never as much fun for me as bringing comfort to a person in need, but I am going to give it a whirl and see how long I can stick to it.

    My perception on 'this' is that 'the system' does not send out email notices that contain the information about the suspension and who to contact about it. the generic email address used goes to a general mailbox that only the site owner can read.
    I can fully understand the reaction that Nich-Nick had when attempting to see the information about the suspension, visible only inside of the portal, and only visible when one clicks 'yes, I accept my transgression' button. I'm sure she was thinking, "What transgression? I have to admit to something before I can see what the problem was?" and that's totally alien to any human that has reading comprehension skills.
    Telling someone to 'click it and read' is specious, IMO, as the application of guilt cannot even be figured out, no one can read stuff before accepting the blame.
    It's a small thing, in the process of the suspension, but a reader will refuse to click the 'accept thy guilt' button only to be able to read the transgression.
    IMO, that part of the system is poorly programmed, and the wording shown was not written by a native English speaker. And of course - the emails that are autogenerated are abysmally formatted and are mostly unreadable.
    Regardless of hopes, wants, needs and desires, I can fully understand Nich-Nick's reaction to :
    1. the email notice, as it's poorly done and
    2. the internal rule to accept the guilt before being able to read about what happened...
    Change the process, reformat the emails, and maybe the next time a subject-matter-expert gets slapped, the reaction would not be so foul.
    Otherwise? Party-On, Wayne... And no, Kathryn, your missives on this in the last 24 hours speak nothing about what actually happened. I applaud the attempt you've made - I feel certain you were called in to respond for a reason, but you not cover the two singular bits that have made Nich-Nick blow up. Any reader, a reasonable person, a SME, IMO would have the same reaction in the future unless the code handling this stuff is reviewed and changed .

    I do believe that Nich-Nick did not have any ill intent in her posts, however I believe the problem was in how the message was delivered. From what you have posted, I think the situation was handled fairly and I do hope that Nich-Nick will acknowledge receipt of the warning and come back to VJ.

    Sorry I am so late to this discussion. I have been dealing with a lot of personal life concerns recently so have not been able to commit the time to VJ as I usually have in the past. The situations are moving along so hopefully will be well enough advanced soon that I can be a lot more present.
    Please don't feel that your comments are unheard or ignored. The moderation team has been discussing this situation in the report forum and the mod forum, reviewing the original report, the posts involved, the posters and the various decisions and choices made.
    While we don't discuss mod action taken generally with anyone other than the individual involved, sometimes, more details can help to clear the air so I am going to go over what happened, from the perspective of the moderation team.
    You have all correctly identified the thread which resulted in a removal of 2 posts and the issuance of a 24 hour suspension. I have gone through the thread and the post in question - which can still be read at the moderator level and above - and while I agree with the moderator involved decision, I wonder if the poster did not realize why her post created a problem.
    The issue under discussion was the legality of adjusting status from a Visa Waiver Program. The issue hasn't always been clear-cut as many people have adjusted from a VWP status, and then for a while West Coast petitions were being refused with one or more USCIS office stating that VWP petitioners were ineligible to adjust from that status, which meant they had no appeal and had to leave the US. Since this was not a consistent decision across the country, it was very confusing as petitions from the west coast were being denied, while petitions on the east coast were being granted. That ambiguity was introduced by USCIS and it did impact quite a number of our members, hence the confusion.
    Nich-Nick's response provided a link showing that someone who entered the US on a VWP was eligible to adjust status from within the US. If she had only posted the link, there would have been no problem, however in the rest of her post she went on to advise the OP about what to look out for and how to prepare if he chose to use the VWP with the deliberate intent of entering the US and applying to adjust status - in other words, using it to immigrate rather than visit. Intentionally using one immigration program to bypass another, more time-consuming but legally proper immigration program is visa fraud - a violation of US immigration law. Advocating or advising someone on how to commit visa fraud is a violation of the Terms of Service for Visa Journey:
    The whole moderation team read Nich Nick's post and unanimously agreed that her choice of words was instructing the OP on how to enter on the VWP with the full intention of using it to immigrate. Other posters also got the same message and the post was reported via the Report button.
    Accordingly, the post was removed, and Nich Nick was sent a message from the warning center notifying her of the violation,the TOS involved and the 24 hour suspension. This is actually a reduced suspension from the recommendation provided by administration in recognition that this poster does not have a history of making inappropriate posts nor violating TOS. We were actually all quite surprised to read the post in question which is why I wonder if Nich Nick was unaware of how it came across.
    Suspensions are issued through a structured protocol enacted by a function called the 'warning center'. The moderator will type in the message to the recipient, make file comments for the moderation team and administration - who see both messages - then selects the appropriate actions from pull down menu options. The site software then issues the warning and enacts the modification action. Before the recent software updates, individuals would say they had never received the notice and that led to concerns that people did not know why they received certain moderator attention. So administration added a 'read and respond' function to the warning message. The recipient needs to acknowledge that they have received and read the action before the software will free up their account to start posting again. This is a guarantee for administration that the individual knows why he or she received this action. The read and respond function is nothing personal aimed at any individual, nor is it something over which any individual moderator has any control. It is embedded into the software of the site and happens automatically.
    I agree that Nich Nick has been a great member of this site, and it may just have been bad judgement for her to word her post in the way she did. The post, however, clearly provides supportive commentary on committing visa fraud by using a VWP with the intention of coming permanently to the US, and as such, does violate the terms of service. So, the report was treated according to the guidelines posted by administration, the post was removed and the suspension issued. It could have been bad judgement on the part of the poster, or even that sometimes even good members make mistakes - (heaven knows I have made a number of them myself and I believe I am generally a good member) - but the report and action were appropriate to the circumstances.
    I know that the recent changes have caused a lot of concern and confusion, and sometimes administration and moderation are not always as clear or consistent as we would like to be on explaining our reasons or our actions. It isn't our objective, though, to 'go after' people, to be vindictive, or power hungry or even to 'punish' members, although I know that is the way it can be perceived. It would be great if we didn't have to worry about making sure everyone follows the TOS because they are doing this for themselves. Unfortunately, this doesn't always happen, and either deliberately or by accident, inappropriate posts happen. Visa Journey has a responsibility, however, to ensure that the actions of our members do not put other members at risk, cause them to violate American law, or to make choices that compromise the well-being of their own visa journeys.. Trying to be fair and even-handed is a lot more difficult than it appears as nothing is ever a level playing field. All we can do is our best. Sometimes that is enough - and sometimes it isn't.

    She needs more than a SSN to work. Her not getting one didn't change anything. You need to file AOS and get either your GC approved or the Employment Authorization Document to work.
    The fees for the AOS were known beforehand, a plannable cost.
    Anyone else reading this, PLEASE be aware that a K-1 is a NON-immigrant visa, and that a K-1 has barely any more rights than a tourist. AOS is REQUIRED to live a normal life in the US. A K-1 cannot travel, cannot work, cannot get a license, cannot do much of anything. It is only a temporary thing to allow marriage and AOS.

    What does the SSN have to do with you not having the money to file AOS? An SSN is not required for that.

    So, I checked the thread in question, I checked the TOS in the first post in this thread and I read Ewok's post in post 3, which says:
    I have about four years of experience of forum moderating, on a very large website. Good moderating is about context, about giving the benefit of the doubt and about ensuring there is consistency throughout the site. Banning Nick-Nick displays none of those qualities, and it is probably the worst user ban possible for the accuracy of advice given here.
    Sometimes admitting that a mistake was made is the best choice.

    You can apply for your SSN within a couple days of your arrival.
    AOS fee is $1070. The fees for EAD and AP are waived when filed with AOS.
    I believe you can retrieve your I-94 immediately, not entirely sure.
    If your DS-3025 is completed properly you will not need to include Form I-693. In this case you will also not need to see a civil surgeon. If your DS-3025 is not properly completed, you will need to see a civil surgeon to have your vaccines transcribed onto the I-693 (which you will have to include in your AOS package). You do not need to have another medical examination if your last exam is less than one year old.
    I don't think its required to include proof of living together for the AOS.

    Nich was probably the most selfless VJ member I have seen in the past 7 years. Her dedication and commitment to giving the right information and keeping it up to date has always impressed me. She didn't have to do any of this -- she did it because she genuinely cared about people. Her suspension is completely bogus in the context of her overall spotless record.
