    It doesn't matter at all.
    I arrived Oct 6th 2013.
    My passport should have been stamped with Jan 3rd 2014 departure, but it was stamped with Jan 3rd 2013.
    They put the wrong year meaning my passport kinda made me look like a 1 year overstay.
    I just successfully AOS'd w/out being asked about it. Don't worry about it.

    There is an element of injustice in the grand scheme of things, but AOS makes perfect sense to me.
    When you marry or commit to a person, that means you want to be with that person. Isn't that the point of being in a relationship?
    You're together - that should be allowed (and it is in most cases)
    I don't understand what it means to be on the other side of the world and to say to the USCIS "Let me in your country so I can be with my spouse or fiance"
    That doesn't make any sense to me.
    Why aren't you already with your spouse? Because something in the small print said "go home after 90 days"?
    Or because somebody in a forum told you it was too risky to stay and marry?
    If you fall in love and decide to marry and want to stay with that person -- that is actually allowed.That is how relationships are supposed to work. Thankfully the US immigration system still caters for this wonderful phenomena that humans call..."being with your loved one"
    But yea, get married, OP, and file everything that needs to be filed.

    But wait, if he just wanted a GC , why didn't he just marry the other girl and AOS with her? (sorry if I missed anything from the post)
    Either way he's a complete a**hole. I feel sorry for you, OP. I don't think you have a case for fraud though.
    Most of it is anecdotal and it's not a cut-and-dry running away from marriage a week after getting GC kind of situation.

    The actual meaning of "Discrimination" is to be able to distinguish differences in things intelligently.
    We are all different. There are high-fraud countries and lower-fraud countries.
    There are countries with radical religious cultures and some with very little.
    There are countries that have posed major security risks to the USA, and some who have not.
    If people never "discriminated" in life, we would let anyone through our front doors that knocked, and let our kids go and play with anyone they choose without checking where and who they are playing with.
    Typically nobody does that, because we "discriminate" (ie distinguish between things) and use judgement.
    Discrimination is sometimes a very good thing. It's not just a dumb "racist" word.

    So he was supposed to be self aware of his situation, having been schooled and given a home somewhere by his parents in a state of innocence, to suddenly take charge of the situation and deport himself, because he "turned 18"?
    Kids (or even the general public) aren't even aware of visa/immigration situations. A child will always take his life w/ parents as his home, without conditions.

    Knowing he was "illegal" is one thing (I'm not denying that), but being able to get on a plane at the age of 18 (cost?) and crash-landing somewhere with no home (?) is another.
    As you mentioned in a later post, he did leave when he was 19, when he was able to.
    I'm just completely dumbfounded that people can say he "knowingly broke immigration law and is fully responsible"
    He had no choice in being there in the first place.
    I understand he will likely need a waiver. It just seems people here have become so absorbed with immig law that they've lost touch with human reality.

    There are ways to word things to other people on forums, especially when it's dealing with loved ones.
    People come here for a human response, not a robotic one you'd expect from a USCIS agent that is likely to make the OP feel like her fiance is a criminal.
    Lay down the hard facts - fine. But do it like you would to a human being in real life. Ya know, with a bit of warmth. That's not sugar-coating.

    I try to stay away from these forums as much as possible because of condescending (and scaremongering) posts like this.
    We know this lady's back story, and we know AOS exists for overstays who have met "The One"
    It isn't "visa fraud" to skip that return flight back to Europe when there are plans to marry and stay with your USC. That's exactly why AOS exists and overstays are overlooked in those cases.
    Seems to be a lot of venting and hard feelings bubbling deep down in the posters here who went down the arduous CR-1 route.

    She views it as "manipulation" in the sense that they wanted to simply visit on a tourist visa. Now since that is denied they have to consider marriage and fiance visas to get the guy into the US.
    It's influencing their relationship in a way they wouldn't have considered had they allowed him a visit.
    I agree that he should have been honest up front and declared he was visiting GF (although I'm sure that would have been denied also)
