    We were told by the officiating official at the oath ceremony, that if you are stopped and asked to provide proof you are a US citizen, to say, "I am a US citizen, I don't have to prove anything." Make sure you get his/her badge number, and sue the ####### out of him/her and the department he/she works for.

    As the OP has received the correct and best advice in the situation - and as the facts of the situation keep shifting so that it appears first to be bigamy, then an unofficial marriage and then a 'party', it is hard to ascertain the true facts. Since the OP is discussing a situation where a green card holder wishes to take advantage of a US citizen in order to gain an immigration benefit, that does constitute fraud regardless of the questionable other relationship. Since there is a legitimate legal process that can be followed and it has been recommended I am now closing this thread to further discussion re: TOS violations.

    he is worried about his green card if he expects his US wife to still continue with the adjustment of status, and thanks her for being a "nice person" why can't he just be a man and divorce her and move back to France to be with the person he REALLY loves?

    Well here's the thing. IF she's pregnant (you've asked this several times which indicates to me that she is or thinks she is) and he thinks it's his kid, he needs to list this kid on his immigration paperwork. This means if he remains married to his REAL wife and he files paperwork stating he's had a baby with someone else, they're gunna look REAL hard at his relationship and most likely assume it's fraud.
    You also mention that your brother WILL tell his real wife about his affair and marriage (real or not it was a commitment ceremony showing his LOVE for someone else) and in my personal opinion he needs to tell her about all this BEFORE she files for joint ROC so she is given the chance to divorce him (if she wants) so he can file ROC by himself and so she is actually able to make a decision based on ALL the facts. In fact given the possibility of a child, I believe it would look a lot less like fraud if they were to divorce and he file by himself then down the line they see he had a child with someone else while married to his USC petitioner.
    Regarding the childs status... he's not going to be a USC before the child is born so there is no immediate US citizenship or anything. He COULD petition the child years later for a visa but it's very important that he declare that he has a child on ANY paperwork that asks for it... bearing in mind this would be a child he has to another woman while married to his petitioner born after a jointly filed ROC... it doesn't exactly scream "legit relationship". He's been very very foolish and VERY mean to his wife.

    Ummm...I've done it. I was in between undergrad and graduate school, had worked for a year, and wanted to see the world. No one but my savings paid my way.
    Statements like this just display ignorance. Regardless of the OP's motives, to say that no American would ever take six months off to travel is wrong and shows a short-sighted view of the world.
    I now live abroad, where it is quite common to find Americans (and other nationalities) who have taken off even (shockingly) a year or two.
    You would do better in your arguments if you did not make such blatant, false generalizations.

    Actually the K-1 visa is not meant to be a 'get to know you' visa. You are already supposed to be in a solid relationship and know each other. You are supposed to be engaged and ready to get married, which is why you sign letters of intent to marry within 90 days of entering the US. The 90 days is given so you have a little time to get situated, plan together and get married.

    Your "world" is not crashing down. You are ridding yourself of a person who could not care less about you. He would prefer to "take a shower" with pixels and tosses you aside. What are you losing? Do you not deserve someone that treats you well and makes you the center of his world? You do. If you ask me it is his loss, not yours. Such a shame for him to throw away something so rare and valuable ...but idiots walk among us.
    Now lookie here, you are going to get over this, sooner or later. Sooner is better.

    Aight, well I finally got through the USCIS phone lines and spoke to the officer.. Who told me I could come by right now and bring the selective service stuff. After a 20 min drive to Manhattan and another 20minutes of looking for a parking spot, and 30 minutes of waiting in line to get into the building, I handed him the stuff and it looks like it's done now. The wait for oath date begins again.

    Today I got my passport card in the mail. That completes my process. Now I have passport book + secondary passport book + passport card.
    Now I am wating for my OCI from indian consulate. India does not allow dual citizenship so I have to surrender my indian passport and apply for the OCI card. It is an indian version of Green Card in India. It is expected to take another 60-90 days to get it and then I can travel freely to india.
    In the mean time, since the weather is getting nice here, I am thinking of renting an RV and travel with family coast to coast and see the rest of the country.
    It is a great experience and I can not beleive it I made it finally after waiting 32 years being in US. Good Luck too all of you who is waiting in the process to become USC.

    Yes, you MUST admit to your arrests AND provide documentation from the PD about them. USCIS runs FBI background checks so they can access ANY arrest, even if you were not convicted or it was expunged. If you lie, they will definitely find out and you will be accused of material misrepresentation and deported for life. So do not lie.

    Many abusive people don't want to file for a GC because they fear that by keeping the spouse "un-free" will force them to rely on the USC so the immigrant can't leave. Many men also fear "independent" women (there are a million on this board) so in an extreme version, keeping them chained keeps them dependent on the USC. That way they get a wife at home that depends on them totally no matter what they do.
    I find it despicable to attack the OP's use of English as a reason to attack her or her story. The question of her English shouldn't be answered by someone who "lives with a Russian" but by people who actually speak at least two languages. Someone who speaks only one language is not capable, in my view, of understanding what it is like to learn a second language and what is possible. When someone gets attacked they would naturally get flustered and probably reply faster and make more mistakes. For a second language, speaking is not easier than writing for all people.
    The OP is very possibly a hurting abused person who needs help, and is making all kinds of excuses because that is what an abused person does. USCIS can make an appropriate determination regarding her story (if she goes that route). It's not up to us.
    OP - you got some good info on your options at the start of the thread.

    Being Military does not make you a saint! I live in an area with one of the largest population of military in the country and let me tell you, no person, fighting for the country or not, is without fault. One of my best friends is a JAG officer, military people are in jail here for being child molesters, abusers, rapists, and more! Some of them officers! Spare us the guilt trip....
    She is seeking advice, all we can do is take her at her word and steer her in the right direction.

    I disagree. VAWA was enacted with help from women advocacy groups. Women are the ones who pushed then Sen. Joe Biden to bring it to law. For you to say that VAWA was made as some sort of bias is incorrect. That VAWA benefits men and battered children of USC proves that it is not a biased law. It would be biased if it was covering women only but not men. If it weren't for women advocacy groups, VAWA would not be law today. Men should participate in advocacies that protect the rights of men like the women groups do. Don't let us (women) do all the work and then complain that we are biased against men, when we push congress to protect us, especially when you get to enjoy the benefits of our hard work.
