As far as how they slot CR1/IR1/IR5 is all a mystery. I do know that every embassy has few slots for CR1/IR1 at least. Maybe because their are fewer and more Visitor Visas and K1's don;t know.
Your case Complete and when means everything because interview scheduling doesn't happen every singe day of month. People have the misconception that case complete and instant interview.
Like right now everyone is waiting fro the announcement of May interviews which hasn't started yet. Those in the queue according to their embassy and slots open and where they fall in the big old world of placement may or may not get a slot.
So that's why you see some have to wait some embassies who are less busy keep open the scheduling and you will see people get interview any day of the month (Iceland I know). Others too busy and it takes NVC about 1 to 3 days and they are done with India, Philippines, Nigeria, Canada, UK too name the top ones.
Thanks!! I'll just wait till it's our time
Good luck to everyone here, hoping tomorrow's the day for the interview assignments.

I personally have no idea why someone would use a more complicated form than you need to. Both saylin and I used the I-864ez with no issues. Less questions = less spots to mess up.
I think they are concerned about having non-W2 incomes on their tax-return even though they qualify with the W2 incomes. There is enough ambiguity in people's mind that they are afraid of getting checklist for the wrong form. Whether that's warranted is another question.
All I can say is I was happy fill out the 864EZ compared to the 864. My guess would be the reviewer would be happier to review the former as well, just a guess though....

I am not at this stage yet as I am still waiting for a case complete. But hope to be soon. I had couple of quick questions...
Are CR1/IR1/IR5 prioritized over other IVs for scheduling interviews? I was looking at the IV interview list for April for my consulate and seems like majority of them are Fx's and relatively few IRx/CRx. Do they schedule based on case complete timeline or do the category of the visa come in to play as well?
On another note, are the cut off dates very consistent for that month's scheduling, like last month Mar 6th seems to be cut off for April interviews. Is it consistently about a week in to the month?
TIA!

You can't use I-864EZ since not all the three conditions apply to you.
I-864 is the form you need to file.
There was confusion around this and differing opinions were offered by senior members on VJ. However, I used the 864ez form and had no issue. My AOS section as been reviewed and accepted.

Since I have income from selling of stocks, which is not shown in W2, but reflected on 1099, does it mean I should use 864 instead of 864EZ?
Part-1, question b on 864-EZ is not very clear:
{
b. I am only using only my own earned or retirement income, which is documented using IRS Form W-2.
}
My answer is "Yes" to the first part: I am only using only my own earned or retirement income; but the sales of stocks is not reported on W2; though it is reported on 1040.
Is it safe to just use 864?
This is getting more complex than it should.
Thanks.
I used 864ez and I had other incomes (capital gains, dividends, interest, state tax return) other than W2s, it was approved just recently.
There was a discussion around this on another thread and similar doubts as yours were discussed.

I would much prefer to send a transcript for 2013, but I filed by mail and not sure if the transcript will be available when I need to send the AOS
Oh I see! Still worth a check to see if it's available already.
If not, I would certainly send a signed copy of the 1040, with all of the associated worksheets, 1099s and w-2s. Might be a good idea to sign the form and make a copy of that to send to NVC.
-
Did anyone send a copy of form 1040 for their AOS? if so, did you re-sign the form if your copy did not have a signature?
I completed my form 1040 using a computer, printed it, signed it and mailed it to the IRS. What I have now is the copy of the form 1040 stored on my computer... wondering if I need to print it and sign it again before sending to NVC.
I had the same concern as I also filed my 1040 online.
I would suggest you get a transcript instead of sending a copy of the 1040. They prefer this anyways, as they can confirm the IRS submission as opposed to a copy of 1040.
You can get a transcript instantly online.

Got a checklist for my mother's I-864A, Part-1,Item-3, for leaving that space blank. We left that blank because both mailing address and residence address are the same. And also it clearly mentioned inside the bracket of item-3 that i only need to fill out If different from mailing Address. I CAN'T BELIEVE THIS. We are so unlucky from the beginning of this whole process
Dear VJ members, please DO NOT leave anything blank on your forms. Their instructions are totally BS.. I learned my lesson!!
I can't believe they are making you re-send the I-864 to NVC for this!! Especially considering you are following their instructions!
Sorry buddy
They apparently have a different meaning of "If an item is not applicable or the answer is "none", leave the space blank."

Hi. We filed DS260 and we already got confirmation for our IMmigrant Visa and Alien Registration. We also paid the IV Bill. What is next thing to do? How would I know it is the best time to call? how long does it usually take for them to release interview appointment?
You should call NVC and find out if the case has completed. I looked at your timeline on Saylin's spreadsheet and many others around you have gotten case completes. Give them a call
-
Just got done talking to NVC and I have a CASE COMPLETE
Thank you very much Saylin, NLR, Dwheels and everyone who helped me with this journey.
I bust into tears when he said congratulations you have a case complete
I had to wait close to 6 weeks for iv bill to come and it was painful
once again thanks to god and everyone who has helped me out
cheers
Right in time for a May interview! Huge Congrats!!
-
Wait I have a question.
Did you send in the AOS even before the AOS fee was paid ?
I sent it right after the money was debited from my account. It took couple of days after that for it to show up as PAID in the portal. This was the recommendation per Saylin's guide and many others on the thread.

I have a questions, for the I-864EZ for the immigrant mailing address (part 2, number2) can I put my US address there or does it have to be my hubby's India address? We would prefer his mail all come to me and it clearly says mailing address and NOT residential address
It should be your husband's address in India.
Don't worry they are not going to be communicating via snail mail for the process, it will be all email communications.
Plus, the choice of agent (DS-261) will take care of you getting all of the documents.

The operators at NVC are more knowledgeable than those at the USCIS misinformation line but Gabrielle is misspeculating and is simply wrong. Still, no harm filing the I-864.
My AOS with 864ez was reviewed and accepted by the NVC.
I had,
Interest income
Dividend income
State and Local taxes refund income
Capital gain income
besides my w-2 income which was used to qualify for the AOS.

Congrats to all of the case completes!!
Nice to get those right at the end of the month, this way you get your interview dates right away and for the very next month cycle. Good luck to all of you on getting your interview dates soon.

Hi Everyone,
I am the USC sponsoring my husband from the UK. I now need to file the AOS and am wondering if we need a co-sponsor. I've browsed the forums, but given how nerve-wracking this all is, I am soliciting second opinions. Please be forgiving.
Now...
I have requested tax transcripts, but I know my last three years of tax transcripts do not meet the financial requirement. In 2010 I graduated from undergrad; in 2011/12 I lived abroad off of modest fellowship stipends; and in 2013 I was largely unemployed or only worked part-time. I did not even file for the 2012 tax year, because I did not need to file as a single person at the time.
Now and since August 2013, I started a funded grad program and am employed as a graduate teaching assistant, making an annual salary of $20,159. This does meet the financial requirement for just the two of us, albeit not by very much. If my tax transcripts reflect a prior income that does not meet the financial requirements and fails to reflect my current income, which does meet the financial requirement, do we need a co-sponsor?
There is also one pesky thing. My gross income is $20,159, but I do have graduate fees to pay ($2,200/year), which I have deducted directly from my paycheck. Will this be a red flag in the AOS? How about the fact that I am a graduate student and my position is consequently not permanent?
Obviously, it would be ideal if we did not need a co-sponsor.
Thanks a bunch!
I would really go with co-sponsor, if your previous tax returns don't reflect your current income it's recommend to show proof of current income via paystubs and employment letter. In your case it being so close to the line plus the income being deducted already.
With the above considerations, I would recommend a co-sponsor. If you want to take a chance; send to NVC w/o co-sponsor; they might give you a checklist or instructions to get a co-sponsor prior to interview. But I would worry about the consular officer's discretion in that scenario.
Go with a co-sponsor to save your self time and heart-ache of worrying of getting an approval.

AFTER PAYING THE AOS FEE SHUD WE WAIT FOR THE STATUS TO BECOME "PAID" TO SEND THE AOS PACKAGE?
Many here just wait till the money is debited from the account prior to sending instead of waiting for "PAID" status. This might save you a day or two.

hello, my I-130 been transfered to texas service center in mid november and i requested for expedite service for my wife in december due to typhoon hyan. i got a email notice on the first week of january 2014 saying that i met the requirements for expedite service and ill be notified within 30 days. its been now 7 months since NOA1 and over two months since my email epedite notice. i been calling for status update but only to be told that its still in process. dose anyone have the same or simalar situation as I. is their anything i can do. thank you
Who are you talking to at USCIS, make sure you talk to tier-2? Since you were approved for expedite , you should be able to get some traction from tier-2 and get them to open a case for you. Immediately contact your senator's office explaining the situation. Get an infopass appointment if none of the above work.
Hope you get some movement soon, good luck!
-
waiting______, you got your case assigned pretty quick.. is it just your luck or is there any trick that we are not following ! ? :-) I am happy for you, I hope you get the interview soon..
It was very much luck, and thanks. Good luck to you as well.
We are approved today!
Congrats!

My dear friends! i have other question.... can u please help me?
My husband just call to NVC and they said that they receive the case on 19 march, but right now is not in the system, so they can not put the emails in the system, they said befor 30 april he has to call again, but i get worry that if they dont have our emails, they ll not contact us, and waiting to 30 april is long and we can lost time, have u ever listen something like that befor?..... Thx u for ur help.
Dianita
You don't have to wait till April 30th to call.
You can call regularly and just keep checking with them once a week. Or, if you don't have the time for that track the NVC thread and spreadsheet to see who are getting their case# assigned relative to their received date. Once it gets close to your received date, start calling daily.

So I have this little list of the reps that answered my calls at NVC. I hope you guys find it useful.
Very nice and helpful reps:
Waldo
Gus
Todd
Vanessa
Jenn
Not so helpful and kinda cranky:
Joy (for someone named Joy right?)
I'm very lucky that most of the repa I talked to are very nice.
Hope this helps.
I always get stuck with the bad ones, Haven't gotten any of the helpful ones as of yet :-(
I had Mike today, I got the stern "Wait 30 business days" and nothing more.

Sorry I wasn't clear enough. The checklist was not for AOS, but for IV supporting documents, as follows:
"The National Visa Center received your DS-260 form. We are waiting for the traveling applicant’s supporting civil documents to be submitted to the NVC. Your online Immigrant Visa Application will be reviewed upon receipt of your supporting documentation."
Jim (NVC operator) said the checklist had been issued because the DS-260 was received but civil docs weren't actually scanned in until yesterday. The wording in the checklist makes it sound like someone is waiting and ready to review the DS-260 when the packet is received, which of course now it has been. So I'm just trying to get a sense for timeline with anyone else who might've had this experience.
I understood that it was a checklist for IV.
My understanding was that it was the AOS review that caused the checklist. But per Jim, maybe it was the acceptance of the DS-260.
Regardless, they should improve this automated system. I think they get so many extra calls because of it that are usually a waste of time for us and NVC!

What do you think BOS_LHR, will they get to our IV this week?
