    1) Average time taken by Mumbai consulate from case complete to interview date???

    2) Requirement of Bank statement in AOS [This is the requirement of Mumbai consulate]

    It really depends on when your case is completed. Check the link in the Saylin's wiki guide for India data, also you can look at the May interview thread spreasheet for India. It should be around 1.5 to 2 months.

    There is no requirement for bank statement if you go thorough NVC; unless you are using assets. I am going through Mumbai consulate and my AOS was accepted and I didn't send a bank statement. But, I guess it wouldn't hurt to have a copy of the latest bank statement at the interview.

    I have paid AOS fees and it shows pending (I think transaction is in process).

    Should I wait for it to completed or I can send the packet of AOS.?

    Cover page with bar code is available as soon as I paid the fees

    You can send it in prior to PAID status; they are not going to scan in the package or even look at it for a while. Just make sure the money has cleared your account this will happen the very next business day. This is to make sure there weren't any errors with the payment transaction.

  4. I am on hold at NVC right now... This was the worst ever case for me, 36 redials to get through. Never had that happen before even during normal busier hours!

    Plus no music or background of multiple people telling us to be patient tonight.. only one guy coming on every minute or to say the agent are busy! It's so weird, I have become so used to the routine calling so many times over the last month.

  5. How can I file my taxes when my dad put my name on his tax papers stating that he is supporting me?

    I am no tax expert... But, you can (and have to ) file taxes if you have qualifying income you just can't claim yourself as you are already being claimed.

    Per the IRS rules if you don't qualify to file taxes, then state that in the 864. Write a letter explaining why you don't have a tax return for the year. Of course, you'll need a sponsor for your spouse.

    Your accountant would be the best person to explain your choices :thumbs:

    Not sure if anyone on this thread can answer these questions but hoping you may at least be able to direct me to the right place. I am the peitioner and have been living overseas for the past four years with my husband. I am aware that I cannot technically be his sponsor because I have no income earned in the US but am still required to complete an I-864 form. I do have foreign earned income and have filed taxes in the US each year. I am wondering if I list my foreign earned income on the I-864 form or list it as '0'?

    I believe so, you should try the NVC thread there are more members with this experience who can guide you better there.

  7. I have a problem, I just filed my taxes a few days ago and my accountant receives and error saying that somebody already put me down that they support me which is my dad. Now my accountant says that I should tell my dad to take my name out of his tax papers. I was wondering, my dads income isnt enough so I filed for $19,800.. Can't I still send NVC my tax papers? they might accept it.. at this point my dad will not tell his accountant to take my name out of his tax papers. I filed as self employed because I don't work and secondly I just filed taxes for my husbands case.. Can I just submit the document to NVC and see what happens?

    That would be fraud. If your tax return is rejected you can't submit as evidence as part of your AOS.

  8. the lawyers office pissed me off again today. The paralegal emailed AOS to me so I can sign it and send it back along with the divorce papers....When I looked it over before I signed..OMG there were so may mistakes and millions of blank spaces.... I had to re-do it, print it and fedex it over night for $24.00..... I am sooooo mad. I have done everything so far. Tomorrow I have to call and beg them to send out my packages. She told me we will have to meet to fill out the DS260.... I was like.... no, its cool. I'll do that one too. I'm so unsatisfied.... I could just scream

    Can't you just fire your lawyer and now handle it yourself? You are doing most of the work anyways....

    There goes my hope for getting my husband here before June then. If they hold onto my case for the full 30 days like Cranky Pants told me this afternoon, I'm looking at July or August even. #######, #######, #######, #######. #######.

    I highly doubt that...

    You IV package was exactly five days (and only 3 business days) after mine; you should have your case complete by Friday, and worst case Monday...

    After that you'll be right in line for a June interview in the worst case.

    You think this might have been a clerical error where they just forgot to ship part of the package to NVC? But this sounds like good news Deep. I would write to nvc-expedite mailer for an expedite based on the error.

    Having the shipped and re-affirmed message great news.. IMO.

I don't know why he specified first round when a second isn't standard or even likely, but "we're done with the first round" was the response when I asked about May interview scheduling so I had to ask what that meant. I was already betting on June so it's not as though my hopes are dashed, I'm just glad I won't have eyes glued to my email hoping for a notice all week long. Seriously hope you and I are at the top of the list and first in for June though!

    Second round might not occur for all embassies/consulates. But looking at the interview spreadsheets; assignments seem to happen in two batches; once right at the beginning of the month and the other 10 days or so after.

    Last month the quite a few interviews were assigned from 1st-4th (first round?) and 11th-13th(second round?) excluding the outliers.

    Yep, really hopping for an early June date, and would be ecstatic with a May date.

  12. I just starting calling today but it doesn't even ring. It just sounds busy :(

    Another question, at this point in my process I'm suppose to be calling NVC for what exactly? To recieve my new case number is that correct?

    You have to hang up and try redial many times to get through.

    You can call early in the day or late in the day to avoid the extremely busy times. They open from 7 - 12 midnight EST.

    When you call them you want to get a case#, and invoice ID#. You also want to provide them with Petitioner's and Beneficiary's emails.

  13. Just got off the phone with Jim at NVC and was told the first round of interview scheduling is done. When I asked what that means he told me sometimes there's a second round and sometimes not, but basically, they're done with May. Ah well. Settling in for the next few weeks while we wait for an assignment, hopefully it'll be early in June because we were so close to the cutoff.

    I was told the same thing today. She didn't mention about the potential second round though.

    I just spoke to a nice lady at NVC (didn't catch her name), and she told me that the they have already completely scheduled the interviews for May for the Bombay consulate. I was a bit surprised as they continued to schedule last month until a week in to the new month.

    Are they reliable on this front? They do tend to answer in a way such that you don't call again, so just wondering is this the case of wait 30 business days for reviews or they really filled up the slots and the only opportunity for interview being scheduled will be next month?

  15. I received a reply from my attorney( on the receipt email from paying one of the fees).. He writes "Jen, I thought you were going for the K3?"

    OK, can I just tell you how annoyed I was? He didn't even know the K3 was closed. UHHHH

    I wrote a very long response telling him that I mailed the docs and pictures and he should be getting them tomorrow. My goal is to get this done asap. When he mails the docs to NVC I want the tracking number. I explained that I keep track of every move. It keeps me busy. I explained the police certificate issue to him. Just incase he didn't know.

    The DS260 will become available once the fees clear..... correct? Do I need to sign it or can I sign it electronically? I want to complete that thing as soon as possible. I am not leaving it up to him.

    It will be available as soon as the fee shows as PAID on their system. For me it was a day after it cleared my account. Signature is electronic.

  16. I just receive a checklist from Nvc it says

    __________ income indicated on the I-864EZ Part 19 does not correspond to that shown on the most recent tax return and W-2(s).

    I just copied what's on my W2?? am I doing something wrong?? does it have to be what's on my 1040? I gave my w2's for 2010,2011 & 2012.

    They advised me that since my case is complete I have to send a new copy of filled out I864EZ to my husband for his interview. Has anyone have this issue before?

    You need to report the 1040 income on that item:

    if you filed a 1040 (or 1040A), then use total income, and if you filed a 1040EZ, then use adjusted gross income.

    What I have seen others do is to apply for the ITIN and put that on the 1040.

    Or, just wait to fill out the taxes after you get the ITIN as you already have filed the extension.

    To be clear, YES you are allowed to file Married Jointly even if your spouse is abroad.

  18. Excellent, congrats!! I don't think I can get my hopes up properly for a May interview, but knowing there's a slight possibility is maddening :bonk: It feels great to have so much of the process behind us though!

    What makes you doubt getting a May interview? Looking at last month's interview data; case completes until the 6th were scheduled for the very next month. Is there something unique to the London embassy?
