    i hope this is the case and not that my documents are now in nowhere land.
    blah i wish they can just confirm that they have been received and are waiting review. at least that way i wont have this added stress of making sure the documents are ok.

    cant even imagine the anguish you are going through. staying away from your spouse for that long, pretty much putting your life on hold. These people are literally toying with people's lives here.

    umm they dont care. my step dad got his visa. my mom was given DS 5535. my step dad had to immigrate to USA since his visa was expiring March 2022. My mom stayed back alone and is still there without a visa.
    so yes, as others have mentioned, you could be separated and DS 5535 processing times are all over the place right now.

    when they reach out to you, they give you instructions on how to generate a courier return label, which has the address it goes to. you just take the instructions to the post office and they do the rest
    ours was a address in Sainte-Catherine, Québec. this looks like a mail sorting facility for the embassy.

    so when i did the call with them, they insisted that my mom be on the call, i told them she doesnt speak good english but they still insisted. so when the call came, i had her dial in from Canada....and they didnt even ask her any questions nor did they care she was on the phone. 😑

    yes i did ask my moms passport back. i got it back and guess what? they allowed her to cross the border and come to USA as a tourist while they are extremely vetting her for whatever threat she presents. Hopefully the absurdity of this entire situation is not lost on anyone

    @PNWUnited was able to provide this info to me and the lady on the phone was able to confirm they picked up the documents. but be prepared that embassy will not care about this. they will continue to say they didnt get the documents

    I am rooting for all of you to settle this nightmare ASAP. I have received my passport with the stamp from the consulate and I am good to go at the time of my choosing. A lot to settle up here first however. I am thinking about entering for a few days and coming back, although I am apprehensive about CBP giving me a hard time about not just moving down in one shot. Some people have reported being hassled by them when entering...

    awesome! opening the DS 260 for my mom didnt cause any delays. i just updated her travel to US within 5 years and resubmitted it.
    fingers crossed for a speedy end for you here.

    This afternoon I have sent my passport and supporting items to Montreal. One step closer. Just hoping that re-opening the DS-260 not another dirty trick for delaying me; I am somewhat paranoid at this point. Otherwise, it felt good.

Advocating working in the US on a Tourist visa and using that visa  defacto living in the US is a violation of the TOS. Condone or instruct, either directly or indirectly, others on how to commit fraudulent or illegal immigration activities in any way, shape, manner or method.~~

    Ah ok. For my mom it took 2-3 days. 
    but you can also email and confirm if they got everything. Their acknowledgment and replies to emails are taking longer and longer

    Well it has finally happened, pressing back on the law firm got a lawyer to talk to me and she was able to get the US attorney to lean on the consulate to send me--at long last!--the request for medical, a new RCMP certificate, new passport photos and my passport,  and to resubmit the DS-260 (for no described reason).
     
    This can be considered positive movement. However, the court deadline is Jan 14 and this stuff cannot be done by that date, so the lawyers are going to have to negotiate something with US attorney to allow more time.

    Just going to post again to reiterate as has been seen by ice cube - I really advise against using writ of mandamus churn firms. 
     
    It’s simply a cash cow and if you aren’t able to speak directly with the attorney, you aren’t getting your moneys worth. 
     
    You can go on the website AVVO and search for immigration attorneys. Almost every single attorney will be licensed to practice in DC so their state isn’t relevant (as long as they can file in DC). 
     
    I found my lawyer who was never mentioned on any forums by looking at Law360 and finding successful WoM cases filed in DC. 
     
    For reference I used Chris Casazza at PIC Law. Every single time I communicated with them, it was with Chris (name partner) directly, or another name partner.
     
    The lawyers that churn out WoM as their entire practice seem to just file and forget, because it can work out for them hands off. It’s genuinely possible for them to work harder for you and communicate with the government attorneys. Not having at least a direct email to them should not be acceptable. I had a direct cell number to Chris.

    I think it’s worth waiting for clarification 
     
    but if it helps, for my mom it didn’t add any Additional processing time. I had to add and delete trips within 5 years and update that her spouse lived in US. Got her visa within 4 weeks of submitting docs back to them. 
     
    but I highly suggest you get the RCMP police check again. It’s for sure going to be required and waiting time for that is 2-3 weeks. Get it asap and you’ll save some valuable time
