    "Dear USCIS examiner:

    Please accept our sincere apologies for not completing the I-751 form according to the USCIS guidelines. We failed to meet this deadline because of a family which lead me to use all of my savings and simply couldn’t afford to send the forms out on time. My father-in law passed away July 30th, 2017, but two weeks before that (wife) took an emergency flight to Pakistan with our 6-month-old daughter. Since it was an emergency flight, it cost us over double the amount of the regular flight. Additionally, I had to fly out on July 29th to see my dying father -in-law, only to hear that he has passed while I was on the plane.

    However, none of this explains why we filed about one month late. This is because my wife and I spent all of our savings flying over to Pakistan, helping in the funds for burial and other miscellaneous expenses. All of this while having to take off from work without pay since I didn’t have any vacation days left. The death of my father in-law was not an easy one for us since he was like my own father to me, but (wife), my wife,  was effected very negatively so she decided to stay in Pakistan until end of September to be with her mother who now lives alone since (wife) is the only child. All of this was very expensive for a single income family. Eventually, we were finally able to get everything back in order but didn’t have the funds to make the payment to file for the I-751 and pay the preparer until mid-January

     We genuinely believed that we would have filed the I-751 form within the 3 months prior to the expiration on her green card but this family death and minimal funds set us back drastically. We understand all the rules and regulations and have taken this process extremely seriously. My Wife, (wife) and I deeply love each other and are committed to being in compliance with all USCIS rules and regulations in order to continue our life together in New York. We regret this event and therefore offer our sincerest apologies.

    I think this letter is fine..we did the same thing and offered a mercy letter and they were very understanding..however we did have to have an I751 interview and they asked us again why we filed late and we told them and asked that accept our deepest apologies and it was ok.

A little insight as well to you, I married a very nice guy from Jamaica, trust me you want to be absoulutely sure that this is what you want, because once he gets here, it's 4 to 5 more years of paperwork and on time filings with and for him, trust me you have to be in super love to go through all this so that he can stay current with all the paperwork and cards and so forth, my husband never acted differently, but i actually did, asking myself do i really want to go through this..in the end it all worked out, we are soo happy..but test your man, put some major questions out there to find out what it is, see if he will come up with all his future fees for medical and visa fee, let him do things to see if this is what he really wants, also pray if you love him, and I'm sure if it's true love it's a go, if not you will see RED FLAGS!!  take heed...this is a very big step and you don't want the drama later on meaning financial issues or any other issues...and don't use Rapid Visa, you can do this all yourself and don't waste the money, we just finished the last step and it was all worth it..if you have any questions on forms or anything, you can always send me a personal message..I will be so very glad to help..Take care!!

    ***Update, so after putting an inquiry into USCIS this same day, card was produced 6 hours later, I think it was one of those, case is sitting on my desk and OH we forgot to process, it's ok I forgive you officer, hubby now has is ten year card, WOOHOO..i can woosah for a little while at least!!!   Reminder to self, never to marry another foreigner, geesh!!!!:lol:

    Sometimes, USCIS selectively refer I 751 to in-person interview based on origin of the nation. USCIS recently discovered more marriage fraud in last year for and this month for those who are originally from Jamaica. 

     

    While USCIS officially denies any of those instances, they have internal policy (not disclosed to public) that origin of the nation is the cause for in-person interview and longer hold. So asking DHS ombudsman or Senator's office won't be too much helpful if not, but it is worth trying after 4 months of the interview. 

     

    I know it sounds unfair and discriminatory, but USCIS will just shrug it off and will claim USCIS does not have to welcome every immigrant and we live in that kind of the world. 

    Thanks and I agree, we have been dealing with them long enough to know that they are in no type of rush to fulfull our requests any quicker than they have too, I'm just going to do an inquiry and see what happens from thee..thanks for your insight..I really appreciate it.

    Like others have mentioned previously, have originals and copies of what is required when you attend your interview. Always be yourself and it is completely alright to be nervous because strange people are probing into your personal life. However, they have to probe so as to determine eligibility and bona fide marriage status between you and your spouse.

    If they ask you questions where 1+1 = red then you know you will be put under scrutiny. Relax, once all your information is legit and you have been truthful during the entire application process, you and our spouse should be fine. ;)

    Update, so we had the interview in Baltimore, MD went sooo well, we talked to this very professional officer for almost 2 hours, she was intrigued by my husband being from Jamaica, said she had been there, she wants to go back, we thought the interview ended there but it didn't..ha ha  she asked allllllllllllllllll kinds of questions, i mean all kinds, how we met, what was it that attracted to her and him, where are kids, when was the last time we went back, when are we going again, how has he adjusted the US, does he have a job, car, girlfriend, did she pay you to come over here, did he pay you to bring him over here, only asked for a few additional documents copies only, and then interview was finally, i swear we kind of on pins and needles for a while, my husband's lip kept quivering, poor thing!!  But she said we were a great couple, and she will approve us..WOOOHOOO, Sidenote**  she did explain to us that she sees sooooooooooooo many couples that has tried to commit fraud, that's why she grilled us like that, but she was a very nice griller and we told her we appreciate her, she even asked if my husband wanted the stamp in his passport, uuuhhh heck yeah..it''s been a week and a few days now since interview, my husband wants his card like yesterday.!!

     

    Thanks all for advice, we were nervous for absolutely nothing, but heyyyyy you never know.

    This is completely correct, we never had had an interview only at the embassy to come over, so i guess we were due for one.

Hi all, so we filed in Aug. 2017, got RFE inn Dec. 2018, responded in Feb. 2109, sent back to Vermont Service Center, now received a letter case has been transferred to another office, uuugghh WHY?, does this sound like we might get set up for interview?  OR has anyone else dealt with this type of scenario, usually when you get RFE, they respond pretty quickly, just want this over already..any advice appreciated!

    I'm sorry, it's just a bad feeling I know when you've submitted everything you can..they did ask for birth certificate of our children, but we don't have any...so I'm sure you can include that now..i'm just going to update and send what we can and pray for the best, I hope it all works out for the both of us, like another OP said, Why USCIS can tell you how you are living your life stinks!!!!!!!!

    OMG I hate to say it, but that looks like an RFE, my envelope looked just like that, but don't panic, it can be an easy fix...

    Send whatever you have, just updated, because that is what they are looking for. I would say 2 affidavits are enough, have one friend and maybe a family member sign saying they know you both. Notarize them if you can. Send updated insurance policies saying that you are still under the same insurance.

Soo we got an RFE, uugghhhh!! a few questions if anyone can chime in and help us please..received RFE, asked for a bit of evidence, this irks me as we submitted sooo much..but it's asking for joint bank account   (we just prefer to have our own accounts), is that ok? we don't have children, do they want every exact thing on the RFE or just as much as you can???  They are asking for affidavits, we can get those, how many is sufficient?  Insurance policies (what kind, I sent car, health and homeowners insurance, and they want a will or trust.  Gee wiz!!  I'm so upset right now, I thought for sure we would be good..  any help is appreciated.

    [2] Can we get her passport stamp , if yes, how we can do it?

    Did the extension letter come on Green letterhead bond paper, if so she's good to travel with that and her expired green card, I've done it and no issues at all, going and coming back, if you want to get a stamp in your passport, go to your nearest USCIS office through infopass….www.uscis.com/infopass

    I just got hired by this big company but i think they have no idea about extension letters. i have social security card that says "valid with DHS authorization only".  i have orientation this Monday and what do i do if they doesn't accept the extension letter and don't have any idea about it... i really need this job, it is very card to get hired and cannot loose it over this kind of issue..

    Please go to the SS office and get your unrestricted social security card, my husband went and had his was mailed in two days, you can get your card with your Expired green card and your ext. letter..it's in their policies tell them to look it up...I had the link and I will try and find it shortly

Hello, so my husband has been in the states for over 4 years now..WOOHOO, we are going through Removal of Conditions right now and he doesn't want to give up his citizenship in Jamaica and his Jamaican passport is about to expire next year, my fellow Jamaicans and their spouses, do you know if there's a way he can renew his passport from the states or does he have to travel back to Jamaica to renew it, any help would be appreciated.
