    Hi,
    Wow, so many of us! My husband is Argentine. We got ou I-130 NOA1 on July 18. I returned to the USA a few weeks ago to start working/setting up a home. I got permanent residence in Argentina after our marriage, mostly automatic, I could get citizenship there after 3 years, but we're grateful for the fall of DOMA and the chance to live both here and there eventually.

    Don't call, it's a waste of time. Even on the day our case was entered in the system and assigned the case number they always told me the same thing "wait 20 25 business days....."
    Send an email to NVC at nvcinquiry@state.gov and ask to register your case for email notifications. Include your names, dob's, email address, and USCIS case number.
    We received the email notification the same day the case was entered, just after i had called and asked again.
    I'm not sure they actually look it up when you call. They just say "wait..."

    We got an email today that NVC has input our case (I registered for email notifications as soon as the case was received from USCIS). I went to the website indicated for payment of AOS fee and the AOS fee invoice and the DS-261 electronic filing were already there. I took care of both of them and it says wait 2-3 business days for the fee to change from "in process" to "Paid."
    I had called a few times and as recent as the day it was entered at NVC but always got the "wait 20-30 business days..." response. I really don't see the reason to have been calling every day, like it states in the shortcut guides, since one can register for email notifications even before the case is input.
    Maybe the process is more streamlined these days?

    Where'd you get that you have to be living with someone all the time before filing I-130? Simply not true. File the I-130s already and get started.
    Also, there's nothing speedy about immigration process. I-130 takes at least 6 months to approve so you're probably looking into September/October for interview in Mexico.

    Agreed :-). However, I also pay taxes and expecting my government to remain open is also the least that I could expect ;-). Anyway, just glad the answer is a resounding NO!.     How can you marry and stay in the USA without the intent to do so? Intent only matters at the time of entry into the USA, given what OP is saying it sounds like they have done no research into this which would suggest they had no intent at the time.

    OK - I'll bite.
    I feel that if I have to pay a bond to do something that I always wanted to do, then I'm going to pay a bond to be granted the priviledge to do it.
    However, with the supposed thousands of folk from those 6 countries historically abusing the system in the UK - it makes perfect sense (to me) to have the bonds posted.
    Who's to blame? The fellas that gamed the system, prior.

    At $13/hour for 48 hours a week, means 40 regular and 8 OT (if he's non-exempt), puts him at about $35,000 annually. Well above the poverty level for family of 2.

    I am going to die of depression and frustration due to this total uncertainty. Spousal visa for citizens used to be the quickest one. Now it's in a miserable state thanks to authorities who like to make illegals the finest citizens.

    NOA2 is when your petition to apply for an immigrant visa is approved. After NOA2 you still have to apply for the IR-1 visa itself, at the NVC. Have you not read the guides above?

Because the process is exactly the same as it has always been, just now it includes all married people not just heterosexuals. All the posts and questions and forms and procedures are the same for all of us. Immigration Equality turned into a ghost town about a week before the Supreme Court decision and offers next to no information, actually a waste of time looking at it. Thanks to Visa Journey we already sent out our I-130 packet!

    I think you forgot biggest document of marriage certificate. I would not send all those with I130 because its not required at all. All you need to send is copy of marriage certificate, her birth certificate, Biographic form, few wedding pictures, your birth certificate, passport copy, social security card copy. As mention in I130 instruction along with money order for fees. These all other documents can be handy when visa call comes and if any problem arises. Send only documents what they look for because overdoing is red flag for your case as you try hard to prove something that's already legit. Be sure that marriage certificate is in English or translation is made.
