marriott574 got a reaction from Chardon Ne' in Married husband on VWP - No SSN or ITIN yet for taxes - I-130 Rejected, what now?
Hi I'm a CPA and specialize in tax accounting, while this is a immigrantion forum here is some very general tax advice.

under the VWP you are not authorized to work unless you have recieved your EAD card, but the fact that you worked is history so let's just move on.

Go and get your SSN it's pretty simple just follow the guide, now onto the tax portion.

if you are married but the last minute of the year you are considered married for IRS purposes, thus you file Married filing jointly or Married filling separately. In general you are much better of filing married filing jointly, you will need to complete form 1040NR as you were a non resident for the year.

You can apply for an extension, note it is an extension of time to file not an extension of time to pay.

Now the good news as a non resident you would have had social security with held from your pay check. You do not have to pay social security as a NR filebform 8316 to do this.

On a side note most people most people over pay social security but never. Lain a refund.

i would recommend finding a good tax accountant and have them prepare all the forms it will cost around $400, (This is not a DIY tax return or the sort of thing H R block will get right, go to a real accountant.)

good of luck with your journey

Hi I am a Tax Accountant
I would recommend MFJ even with the ITIN difficulty.
When filling MFJ you spouse can claim married standard deduction and 2 exemptions, this will allow her to pay less tax. The flip side of this is potential double taxation as you should report your income in India, however you will received a tax credit against any tax you paid in india.
MFS she will pay more tax and technically you also need to file MFS however without an SSN and not currently being in the USA that is confusing.
If she has a CPA (Accountant) Trust there advice it is going to be more reliable then a forum for visas, also you can call the IRS and ask this sort of question and they will give you a free non legally binding answer.

marriott574 got a reaction from Mark&GinaW in Visa interviewer totally humiliated and insulted my wife. What to do?
By all means file a complaint, that is your right. I tend to ignore comments more then most, but the "You married a guy old enough to be your father" comment, now there may be more to the story but single comment hardly infers or implies that your wife is a Golddiging wh***. Obviously the CO needs some additional customer service training, I just don't see what complaining achieves, apart from a sense of satisfaction and the possibility of it preventing others from the same scolding remarks. But this is just my personal opinion, which you can by all means ignore I am not trying to pick a fight.

What you want to do is visa fraud, it can have serious consequences! Complete the K1 like everyone else.

I understand you most be upset, and want action and i completely agree that people should not treat others that way. But think about the possible repercussions is it really worth creating a fuss. Just celebrate your approval and move on. Pick the battles worth winning.

    Dear OP
I have only needed one copy some places want to look at but dont keep it. You can always get a notarized copy.
As per the University transcript there are companies that will translate a foreign transcript into a US acceptable version, you will not to check with your college/university in the USA when applying as to which translating companies they accept. From what I know expect to pay $200 for the service.

marriott574 got a reaction from ccyahaira in I94 and the SSN
    Hi All
So I entered the US recently with my K1 Visa, at the desk in the airport where I handed in the big envelope of information and my passport and I94, the lady took everything and processed it. However I did not get the paper I94 back, I asked about this and was told they now use an electronic I94. I thought nothing of it until I want to get my SSN yesterday. The lady at the SSN office had not heard of an electronic I94. After much trouble we found a website which shows a scan of you i94. However she processed my SSN without the I94 and used the admission number on the stamp in my passport.
    Hope this helps.

marriott574 got a reaction from Nich-Nick in Saving DS forms
Someone asked me how I saved a digital version of the DS Forms. I thought it may help others to share.
The DS forms usually wont let you save all the information you enter into them, however it is possible to save the completed forms. This makes it much easier to send them to others.
To do this you will need a PDF Printer. This is a piece of free software that allows you to turn almost anything into PDF documents.

Firstly I download Cute PDF printer it is available here.
    http://www.cutepdf.com/products/cutepdf/writer.asp
    Follow the installation
    Complete your Forms
You then want to "Print your file". To do this simply go File, Print. Or in a web browser right click and select print.
Then select the Cute PDF printer from the available printer list.
    Click Print.
    This creates a "digital print"
A new dialoge box will open. Select where you want to save your new PDF file.
That's it then you have a saved version of the form.
Please note that the form is not editable.
    Hope this helps
I take no liability in the quality of this software. I have no vested interest in it many other PDF printers are available. This one has worked well for me for years.

marriott574 got a reaction from Newbie12 in any october 2012 filer who already got their noa2?
It is really frustrating having to wait so long. I was hoping our case would go through quickly as we have been dating for 4 years and have visited each other 11 times including a 12 month stay in the USA for me and a 6 month stay for her in the UK. I angers me when people how have only been dating a year and have seen each other once get approved faster then a scolded cat.
