Well, it looks like the long process is over and I am a permanent resident for good!
I just wanted to say thank you to everyone who helped in our K1 --> AOS --> ROC process. This website has been a gold mine of information and everything has gone very smooth thanks to all your help. We did not have a complicated case to start with, but navigating all the forms and various stages by ourselves would have been waaaay more difficult. I also hope I managed to help some in return as a contributor to the forums.

Your list does appear solid. In addition to what you're sending, consider crafting wills, medical powers of attorney, and similar documents. These make excellent evidence for ROC, and they're even more crucial to have in "life."

My Lawyer submitted only transcripts in relation to taxes.
In addition to items on your list here is what she filed:
Copy of marriage certificate (don't know why she included this. Lot of people here say it's not required) Personal statement from my wife and me about our life for last 2 years Statement written by family and friends (my wife's parents, my brother, a friend of mine and our financial advisor who happens to be my wife's cousin) Lot of pictures together and with family, at different locations (trips, visiting family etc.) and settings (office party, wedding party, dinner party etc.) I gave her a lot of pics. She specifically picked the ones on trips and visiting with family and office parties, basically social settings and trips My wife's Facebook posts wherever she tagged me for last two years. Your list is solid in terms of financial co-mingling. I would add some more items for social settings.

I think you've got some pretty good evidence going. You've got the financial co-mingling and residential covered. Like someone said earlier, no need for W2s with IRS transcripts. All the best and congrats on the birth of your daughter!!!

Would suggest that you include copies of W2s and 1099MISCs with tax transcripts. Last month, we got an RFE related to our ROC petition, we only submitted the tax transcripts, the instructions are kinda vague, so go figure..... The RFE specifically wanted copies of all W2s and 1099MISCs with tax transcript(s) and/or complete tax return(s), for all applicable years.
Our recently submitted RFE response was accepted, we received our GCs two days ago.

I find the seizing of someone's passport at POE to be highly suspect, but I admit to not having much knowledge of this particular area.
I would jump at the chance to gain citizenship of an EU country. It would open so many doors in terms of where you could live and work.

I think it has to do with whether the country requires an oath of allegiance. This area is extremely complicated. I have looked for clear guidance on it many times and haven't found any. I would go to a lawyer expert in the area before I took a chance of losing my USC.

There is nothing wrong in Dual Citizenship so long as you obtained that citizenship of another country without the intent of relinquishing your US citizenship. If you read further below in the link you will see the following:
Dual nationality can also occur when a person is naturalized in a foreign state without intending to relinquish U.S. nationality and is thereafter found not to have lost U.S. nationality: the individual consequently may possess dual nationality. The U.S. Government does not encourage dual nationality. While recognizing the existence of dual nationality and permitting Americans to have other nationalities, the U.S. Government also recognizes the problems which it may cause.
They may not encourage it, because there are several legal quagmires that may happen in terms of consular protection and international law, but they will not stop you or make too much of a problem for you so long as your intent was not to relinquish. Most commonly it would certainly not be rejected if obtained through marriage or birth. I am pretty sure you could call the DoS and hear this information directly from them. There are many successful dual citizens in this country: some that naturalized here and some that naturalized in other countries. I can't speak to the person's case that is having trouble however, but I do know there is a list of countries where it would not be allowed. My uncles and great-grandmothers were dual citizens. I don't think you'll have issues because of the ASD (in the USA, Aspergers doesn't exist anymore as a separate syndrome according to DSM).
It may be worth having a letter from his doctor that confirms the diagnosis, and explains any issues he may face at the interview; for example of he has problems making eye contacts, it is good for the CO to know that, or if he has issues with waiting in a crowded, noisy waiting room due to SPD, accomodations can be made.

Yes, that is a labor certification issue. I wish you would have mentioned that in your first post so that all speculations could have
been laid to rest.
Unfortunately fraud to bring someone over for work happens all the time, even spousal visas have been denied
because of it.
To understand the logic of it all you would have to understand the fraud behind it.
People pay people off to bring them over for jobs, then they go their separate ways or even divorce if married. it seems insane to you and me
but it happens a lot with desperate people.
The burden of proof is on you to show a rock solid paper stack of quality relationship evidence. From day one to current, describing the flow of it all.
You need a good lawyer experienced in returned petitions.
Do not attempt to file again without a lawyer. You also must front load your next petition, as they will have already seen your sparse
evidence submitted prior to the interview at which time they have already made up their minds and they don't want to see further evidence.
One last ditch effort I advice now is to have a (very good) US based lawyer request that the consulate not return your case and to be granted
an extension for a second interview with new, fresh, solid and overwhelming evidence that without doubt shows you are and have been in the past
a genuine couple.
You must act fast because once it is returned it is out of their hands and USCIS will NOT review it.
Small chance but worth a try to fight it at this level. If you file a CR1 you could run into the same obstacle.

I used one of those for my AOS. Got a RFE asking for its English translation. I felt there was no need to point out how dumb what they were asking for was. The person handling my paperwork was clearly not familiar with that kind of certificate. I just sent in another copy of the same certificate with its "translation" reporting only info in English, and my Certification by Translator:
I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

It worked.

How does one have an appeal dismissed and a decision upheld if there was never a decision made or an appeal filed?

Then I suggest:
- someone possibly hit the wrong button while updating your case online
- call USCIS and ask for a Tier 2 + make an Infopass appointment to inquire about it
- meanwhile, wait for whatever you might get in the mail. It might even be the notice of approval, for all you know.
- if nothing arrives in a week or so, contact your Congressperson and the Ombudsman.
