You are clueless about Haiti and about the earthquake. I did not post this to get Judge Judy-esque advice, but to get real help.
He did not believe (or want to) that his wife and child were deceased, his family members insisted that he file the report when they weren't found. And they did it for him, which is often the case in Haiti.
Not one of the officials were surprised at the numerous fake documents presented while we were there. It is difficult to get the official ones, and people work very hard to appear as officials to get your money. That is part of the culture here.
He does not have two death certificates. The baby was a newborn and did not have a birth certificate yet. That is how it works in Haiti where most babies are still delivered at home.
He is not claiming complete ignorance. He knows where he got them... from the friends/family members who did his bidding. That is the way in Haiti. There are many unemployed who are happy to do what they can for a couple of Haitian dollars. He has his cousin deliver lunch to me, and that regularily gets messed up... it's part of being in Haiti.
Do yourself a favor. Read something about Haiti and about the earthquake. Find out how people mourn when there is not a body found, and then reevaluate how idiotic your assessment sounds.
    Have a nice day.
I welcome feedback on the questions that I originally posted.

Who cares if he has been waiting 5 days, the point is hes well aware of the impending wait ahead. I dont understand why people here are so quick to pick apart others. Hes obviously frustrated and away from the person he loves LIKE ALL OF US! Give him a break. As far as deferred action YES uscis does not have enough employees to balance all these damn petitions and they have NO NEW HIRES as far as I know to help with Obama's deferred action. The condescending nature of some of the responses on this board are totally uncalled for.

True, but it's not like they are only getting a few applications a day. They get thousands, and there isn't enough manpower for the volume of work. My overall point is if you're in this process, you'll be waiting for a while. It's unrealistic to expect anything otherwise.

I agree.. if you are honest and do things the right way, you have a lot of hassle to go through. It is frustrating beyond belief. It took us 9 month to get through with USCIS... and they lied to me from the beginning. I told them I was living overseas with my husband, but they told me I had to give a US address on the i-130. I told them I can give them an address in the US, but I don't live there right now as I am living in Australia-I also gave them plently of evidence of me living in Australia. They said they don't send anything overseas. Lies.. lies. I also had to fly back to America last Sept for an interview with Homeland Security. When I called USCIS to ask why I was scheduled for an interview (it is NOT part of the normal process), no one could tell me why. All they said is that if you don't go, they will most likely deny the petition. So 9 months from the beginning and thousands of extra dollars later, I got approved for the petition. But it was only after I was in America that I found out US citizens living overseas with their spouse can get their petition auto expedited!! USCIS denied the whole thing when I called them up about it. Now we are nearly done with NVC.. that's another drama. So I understand your frustration with this process... we have been going through it for well over a year. But like you said, let's have millions of illegal people get into America.. no worries for them!

Just got off the Phone with USCIS this evening I got some discouraging news when you call USCIS first tier what ever times they give you double them, I am not kidding, if they say 5 months expect 10 months or longer! Obama and his Amnesty act has screwed all of us doing this the legal way and guess who gets priority now not us who sit by and wait and wait and wait but the ones who got here illegally and they don't have to pay a dime not one red penny! I hope every one has lots of time and lots of patience because you are in for a long agonizing ride! Oh and just to let you know USPS lost my petition some guy named thornquist is having a good time with the money I sent. and you KNOW what USCIS said for me to do WAIT and when i said i should cancel the money order and start over she said i would not do that if i was you i asked why she would not tell me she just kept saying their favorite word Wait! Wait!

You are brave enough to post this. Honestly, If I were in your position, I would leave her and start a new life here from the scratch... in fact, you already did start from the scratch by leaving your home country and coming here. Personally, I don't think I can look one daily in the eye and not think about what happened.

Alot of people on this board should evaluate their social skills. I guess writing an email and sharing "MY" experience (because can I speak about others I dont even know and how they feel? No) apparently deems me as only concerned with myself and not the others who feel the same way before or after me. Bottom line is WE ALL WANT THE SAME THING. Either find a way to share workloads or hire more workers to process petitions. OR when one form of petition is lagging behind, change priorities on which ones to process. do I expect this change? No not anytime soon. Lay down and play dead? NO. when 5 months hits I will be calling and doing everything I can. We all paid the same amount and the service needs to be balanced. There is no reason anyone should be waiting 7 8 or 9 months at either center.

I stayed off this website all weekend. The more I observe what is going on concerning vermont the angrier I get. And I am talking ANGRY! Ruin my weekend, want to punch someone, need a drink kind of angry. Not just one drink either.. I'm talking 3 or 4. Please, before you say "YOU ARE A MAY FILER! Relax." try to remember how long we have all been waiting to be with our loved one in general. I can't speak for everyone, but my fiancé and I have been apart for a year and a half. We have seen each other a total of 5 weeks during this time. One trip to America (harassed at POE) .... Another trip to America (denied at POE. Is it his Turkish name? I mean really.) .... and lastly my trip to Europe. Those were the best two weeks of my life, I would give anything to experience it again. Okay now I am tearing up. Here is the email I sent Mr. Obama, maybe a few others might take the same action:
Hello Mr. President. I am writing (and in tears) side note: bring on the drama! concerning the USCIS Vermont office. Vermont's processing dates claim 5 months for I-129F K1 visas, however the patiently waiting public is aware they are going far beyond that 5 month time frame to approve petitions. When inquiring on the matter, the reps explain (and have been for weeks) that they are currently processing petitions from January or early February. California USCIS is moving at a much faster rate, already approving petitions from JUNE for K1 Visas!!! Its very difficult to comprehend why some cases can't be transferred to CSC to help with Vermonts horrible workload. Myself and many others who have connected via the website visajourney.com are very concerned, upset, angry and down right miserable. The CSC filers essentially receive "expedited" service while paying the same monetary fee! It is very financially and emotionally straining waiting for our loved ones to get here, let alone get past the first step!!! I myself have had anxiety/panic attacks and depression due to not being able to see my fiancé in months. Traveling to see each other is just not possible anymore on our budget. We and thousands of others are trying to get our loved ones here the legal and right way. I respect our country and the process to bring a loved one here, however there is just no reason for the time differentials. Can anything be done? We really need your help in this matter. Thank you.
So, long story short.. I am not expecting a reply. Maybe if I called him Barry or sent the email to Kenya I might hear something.
Sorry, trying to make myself laugh. Not working.

Just realized this was in the wrong forum, should be in service centers.. don't know how to move it. My apologies!

    First, calm down.
When did you receive the NOA1? It takes on average 5-6 months for the petition to be adjudicated, so you're still within the regular timeframe.

On Monday Dec 3, My husband attended his visa interview at the US Embassy in Kingston. He got there at 6:45 for his 7:30 appointment. He got himself checked in and waited to be called. He was called to be sworn in and had his fingerprints done, turned in his medical and signed his police report. After that he was told to sit back down and wait to be called. He was called to another window by a white American man. He asked my husband how did you meet your wife, when did you get married, how many people at the wedding, do you have any pics of the wedding (Husband pulled out the pics), guy asked who filed for you, my husband said my wife of course, the man chuckled and proceeded with have you ever been arrested? My husband said yes, sir I have, however I was never charged and the case was thrown out. The man proceeded to ask why and for what and my husband was honest and told him it was years back for a domestic issue with my ex wife. The interview basically ended there and my husband was handed a blue sheet to return with a letter regarding the case that was dropped and he also needed to surrender his previous Green card.
On the blue sheet my husband was told he could surrender the Green Card on Monday’s and Thursday ONLY from 1-3 pm. Since it was a Monday, my husband decided to exit the building, to re enter to handle surrendering his Green Card. He was told that they no longer offer this service on Monday that he would need to return on a Thursday. So my husband headed back for home (5 hours commute each way errrrrrr). On Tuesday my husband went to Sav to get the letter about the case and I am glad to say that, he received that same day!! My husband proceeded back to Kingston Thursday morning (12/6), when he reached Kingston, he was told we are closed today, you will have to come back next Thursday. When he called to tell me this I was like, REALLY??? You have got to be kidding me, well he was not :crying: !! So I decided to write an email to the embassy begging them to schedule my husband’s blue sheet interview on a Thursday so that my husband could handle both his green card and his blue sheet in one trip. That a total of 4 trips to Kingston is a lot and that we were advised by the embassy officials to go on Monday and Thursdays, which we did and they were closed. I sent this email at 6:30 pm (CST), the next morning I received the standard email stating email was received and that I should expect to hear from them within 5 business days. So at 2:47 pm that same day I received another email stating, thank-you for your email, we have scheduled a blue sheet interview for Mr. XXXXX on Thursday Dec 13 at 1:30.
When my husband returned to the embassy for his blue sheet it went pretty quick, he was called to the window, saw the same man how interview his the first time. He turned in his papers and the man really didn’t ask him anything other than where will you reside in the US, he told him. Then he looked at my husband and told him that always remember “honesty will always pay off” to go to the DHL window and enjoy being reunited with your wife for the holidays .. I have never felt so blessed in my entire life. I called the DOS today and they told me that my husband’s visa has been processed and should ship today or Monday…

We were told this would happen (though not such a short timeframe) - at our infopass meeting recently - that there were new staff employed and things would be moving more quickly. After 9 months of waiting for our **NOA1** (and still waiting for it) you can understand why I would think it would have been appropriate for them to clear the backlog first !! Our petition was perfect too...(their words) it is their error that has prevented us from being finished with this stage of the process.
    Congratulations, however.

It's not a negative comment, it's a simple truth: you were lucky; no one begrudges you your approval, but think of the people who have been waiting for months with no end in sight, where is their approval? Elevating you above them due to an administrative mistake is disingenuous to those waiting.
It certainly isn't your fault, but spare a thought for those people.
