today i went to police station first.
i got my arrest record from 2008.
than
i went to clerk of courts, they gave me 2 piece of paper it says NO CHARGES , NOT GUILTY, and other one is NOLLE PROSSE
i think this is satisfactory right? document checklist says they require these papers. what do you guys think?
yes that's enough. just make sure the court paper is certified or stamped by the court.

I am not sure why you gave up and you would rather to start all over again. Go talk to an experienced immigration attorney, trust me, sometimes they do magic. I would go and talk to several ones. If you find there is no hope, then start over

They ask about that if you travelled overseas after the interview so they can verify your travel dates. If you didn't travel don't worry about it

Since you were in a legal non immigrant status until you reached 26 you were exempt from registration.
So you shouldn't have any problem with naturalization.

Your ex accusation it shouldn't have any impact. However, just be honest and confident if they ask you about your marriage. Usually, they ask about why the marriage ended , and as long as you tell them something make scene, you should be fine.

Summary of what I have gone through so far with my N-400 case: Submitted my N-400 in June 2014, biometrics done in July 2014, received interview notice for October 2014 and upon arrival with my lawyer, I was told that they cannot proceed with the interview because of the pending background check. Received a letter from the local office that interview could not be conducted due to unforeseen circumstances and have not received any notice about the next interview date. Have called congressman and senators office and they got a response indicating that USCIS do not have any estimate on how long the background check will take. Made an appointment with InfoPass in December 2014 and was told they don't have any other information available. Initiated an inquiry with the USCIS Ombudsman and received a reply that "our review indicates that your case is within normal processing times on the USCIS web site". I have a clean record and not really sure why it is taking that long. What else can I do other than waiting impatiently and praying?
you need to keep following up with them. if this got delayed more than 6 months. It a good idea to start looking for a lawyer who is familiar Writ of Mandamus.
you can't sue uscis because there is no law statute which allows you to do so, the only time you can sue them if 120 passed the interview and a decision has not been made. that's why uscis canceled the interview so you don't have that option.uscis used to get sued a lot ,so , that's why now if your background check is not complete they won't schedule the interview.
Th only option you may have is a writ. which a lawyer would petition the federal court to force uscis to make a decision , that petition will not give the court the authority to make a decision but only make a deadline for uscis to make a decision.

it's a petition to remove the condition in your wife's GC. You need to submit a proof of bona fide marriage which covers your entire marriage. You can submit your petition when the window opens which starts 90 days before the GC expires.

if your wife name is not on your insurance card. Call the insurance company and they can send you a proof that your wife is a dependent in your policy

Just be honest. And try to get affidavits from anybody who knows both you. If you have any evidence of her cheating , take it with you and show it to the interviewer, like chatting records, emails, etc.

Part of the executive action is uscis will start accepting credit card payment for n400 this should be implemented sometime this year. I think this would be a good option to consider . If you ask me about my opinion , I would tell the fees are 2 much , but it seems the government is taking advantage of the immigrants need and their families. Why uscis doesn't got funded partially by tax money ! When more than quarter of my income is going to the government , why also I need to pay high fees to complete any process with uscis !
But finally what we can do , we need to play by their rules.

My wife was naturalized on 12-23-2014, total process time being over 11 months from filing.
A Vietnamese there submitted her application about the same time as my wife, another Vietnamese about 2 weeks before that, & a Chinese about a year ago. Westerners whom I talked with (i.e., 2 Canadians & a Briton), however had about half the wait time. So I'm going to go out on a limb here & say that perhaps there's a quota system based on country, & that applicants are throttled through in a manner that's in keeping with those quotas.
Anyway, it's done. We're through. And good luck to those still in queue.
Congrats for completing the process. I don't think there is any quota based on the country. Most likely, they forget about the case, and then they noticed it has been sitting for a while. Human error is always there. But the most important that you are done with uscis.

Geez. The issue isnt up for debate. We are not the jury here deciding probably cause. The cops stopped him and used THEIR JUDGEMENT. They used several investigative methods. Observation of the scene, a finger waved in front of his pupils, his appearance/speech/behavior etc, and made a decision. PERIOD>
There is no violation of rights regardless of you tube vidoes. Alabama has “implied consent” laws. It means by driving on the roads you consent to taking the tests if an officer who has reasonable grounds to believe you are under the influence. The video mentioned is someone fighting probable cause. - most likely not this situation- and again not this forums place to debate is it probable cause or not>
And its a BIG YES YES YES this does impact citizenship. DUI is moral character "Agree". Arrest is moral character" No it's not". This is not something considered 'administrative penalty'.
everything depndes on the trial outcome. I am not going to have an arguemtn with you. I give my opinion. When somebody asks a question I try to share my knoweldge so they know what's the best thing they can do. What happened happened , blaming, and giving som inaccurate information is not helpful at all.

Also, I think it's a good thing you informed the officer that you are refusing the test because of your civil rights, enforcing the Fifth. If I am the judge, the first thing I will look at in this case if their was a probable cause for the police officer to ask you to do a breath test. I don't think the car situation is a probable cause for a breath test, espically in a rainy day.

He is worried about his citizenship. Refusing a breath test in Alabama may lead to 90 days driving licence suspension. But this is administrative penalty which has no impact on your citizenship. You were not refusing during dui check point, you refused when they were no probable cause for the request, as I told you may have a civil right violation claim.
I saw on YouTube for one activist who intentionally went to a dui check point , he refused to do any test and I think he refused the arrest. The county judge found him guilty, however he filed a civil right violation in the federal court , the federal court ackwnloedged that there was indeed a violation to the civil right and they reversed the ruling. They guy then got reimbursed all the fines that he paid.

Thank you so much for your reply, I hired a criminal attorney for my charges and paid him today. He will be in court with me next week and he told me that I have a good chance of getting all this junk dismissed or just keep the reckless driving charge and dismiss the DUI.
I would consult with a 2 - 3 lawyers, and hire the one which i really feel comfortable to represent me. Good luck and I wish you all the best.

I sent my application N400 in April, 12, 2014 and I completed my biometrics in May, 13, 2014, USCIS put me in line for an interview since May 15, 2014. However, yesterday morning on the way to work, it was raining heavily and my truck slid into a creek off the road where the water was high to the windows. I sat inside the truck for safety as I was trying to get a wrecker to get me out. Suddenly, a police officer spotted me stuck in the creek ( 30 mins after the incident) and he stopped to check it out. Then, another cop and an ambulance showed up. I couldn't wait staying in the car as the truck was getting flooded more, I decided to open the window, managed to get on top of the truck and jumped off to safety. Shockingly, when I was standing on the bank of the creek, the two police officers approached me and started to ask me what happened, so i told them the truck slid and I totally lost control of it and I ended up in this creek. They asked me if I had anything to drink, and I said no. One of the officers started to point his index finger toward my eyes and asked me to follow his finger with my eyes, so I did. Then, he grabbed a breath analyzer tool for me to blow, and I refused because I felt they were harassing me and not even concerned if I was okay from the incident. then, they placed handcuffs on me and took me to jail for 24 hrs suspecting that I was drunk and that I refused to take the alcohol test. They charged me with DUI and reckless driving , even though I wasn't pulled over driving, I was stuck in a ditch. Anyhow, I bonded out of the county jail and I have a court date set for January, 8, 2015. I am hiring an attorney for this case but I am deeply concerned about my citizenship status. What shall I do? what is the impact on my citizenship application? I have never been in jail my whole life and I have never been in trouble before ( Clean record) up till last night ......Note: I am an engineer student, I work full time and this could ruin everything for me );Thank you and your help is greatly appreciated.
Since you refused the breath Analyzer , they got the opportunity to charge you with DUI. it sounds to me, 2 bad officers they just wanna show their power.
They can charge you with whatever they want , but that's doesn't mean you are guilty. the impact on your citizenship depends on the outcome of those 2 charges. Hire a good criminal lawyer. A good lawyer should get you out of this completely clean. if the DA decides not to pursue the cases in court, then just disclose everything at the citizenship interview and you should be fine. if you went to trial and the cases got dismissed then you will be fine. God forbid , if the judge find you guilty, then the impact on your citizenship will be based on the fine/sentence. If I were you, I would consult a good immigration lawyer who has knowledge in your state criminal law. The same situation may very from state to state. For example, here in virginia, a reckless driving is class 1 misdemeanor, and one lawyer told me you may get denied for citizenship with such thing. because uscis may find you lacking a good moral character. Again, this will vary from state to state. I am not a lawyer, but I feel with a good lawyer, he can get these 2 cases dismissed. Finally, At all cost don't go to trial by yourself, get a lawyer.
It doesn't heart as well, to consult with civil right attorney to see if you have a civil right violation claim.
