  2. If you manage to send your application before you move and after your window opens that would be great. You need to have 3 months living in the same Uscis district before you file, HOWEVER, once you file you can move and request the file to be transferred to the new location

    if you moved before you file , then you need to wait 3 months before you file in your new location. I hope it's clear, because some people think if you file and then you change your address to a different state they will deny your application, that's not true, the rule here is they look at the three months before you filed if you lived in that district or not, but after you file you can change your address and they will transfer your case to the new Uscis office.

  3. Hi everybody.

    I completed filling up my N-400 form and getting ready to mail it. I just wanna know if I'm forgetting something.

    I'm filing based on holding a green card for 7 years ( I'm also still married to the same us citizen spouse ).

    So here is what I'm sending :

    A completed form N-400.

    A copy of green card front and back.

    2 passport photos.

    A check for $680.

    So is that all ? I've read I don't have to send any documents as proof of my marriage to an us citizen since it's been over 3 years, Am I correct ?

    Any help would be much appreciated :)

    yes, that's all what you need if you are applying based on 5 years of being a PR. Plus, a proof of selective service registration if you were required to register [ if you are a male]

  4. Thank you very much for your reply. I agree with you not to voulnteer info but she asked me if I worked or not and I was working remotely from home.

    I got the offer 2 weeks before the interview and I asked my company that I can't start work until I make my interview. They asked me to start working remotely from home.

    I am a computer Engineer and I actually work out of my home office right now and when she asked me If I work or not then I said the truth thats it didn;t voulnteer.

    I already scheduled for a free consultation with an immigration attorney but I still would love to hear all your inputs.

    I know that my case is pretty unique and possibly no one ever did it before. If its a winner case then I will be the first one to do it and many others will follow my path.

    I understand that it could take 6 months for a court date and thats why I am working on it right now.

    Every day counts. I don't mind to pay some money for attorney helping me getting citizenship earlier if he said that there is a possibility.

    I would gamble no matter what.

    I am gambling my job right now without it. I'd rather gamble with couple of thousands of dollars rather than losing a 6 figures salary decent job

    the issue with most of uscis officers they are living in another planet, they don't know that working remote is exist.[ I am an engineer and I know what you are talking about]

    Your argument should be that uscis did a mistake by transferring your case to CA. The stupid officer thought " Ooh since this guy works for a company in CA and he is moving there then let's just transfer the file to CA". From law perspective , the uscis office that had jurisdiction over your case at that time was HI, it's the place where your reside not where you work,

    Again, it will be tough to proof. But, I would be interested to see what the lawyers tell you. My advice, try to find a good lawyer who has experience in court cases not just filing the paper work. These free consultations most of the time are useless, you may need to pay a couple of hundreds for a good consultation .

    in order for this to work , you need a judge order to change the date of permanent residency back to the time you where in HI, which I think would be tough to win. But , to be honest I respect the people who fight for what they deserve and not just accepting uscis mistakes.

  5. I doubt you will reach any where. I can say that there was a mistake by transferring your case to CA since you didn't leave yet. I hope you learned your lesson that don't ever volunteer with extra information tp ucsis. Always answer their question without elaboration.

    You can try by checking with immigration lawyers. You may have a valid point but consider if you gonna go the court route it will take some time. it's not like the second day you will have a hearing.

    I know if uscis didn't make a decision withing 120 days of the N400 interview, there a statue in the law which allow you to sue them. But, your issue is completely different. You need to check with immigration lawyer. IF the lawyers told you that you have a valid case and you are willing to spend money and time, then I believe the lawyer will file in the US circuit court- 9th district.
