Case Update:
My court date was supposed to be today after when it was continued once before, however, due to the bad weather in Birmingham, AL area, my court appearance was cancelled. My attorney informed me that the next court appearance will be sometimes in April
Now, the problem is that the immigration officer gave me until March 25 to respond back with certified court document to make a decision on my pending N400 case. Please give me some advice on what to do next? Should I send a letter to the immigration officer and explain to her what had just happened? Do you guys think she would give me more time to resolve the case or is she going to deny the application?
Thanks for your help
Contact your congressman asking for help. let them send a request on your behalf to Atlanta field office in order to extend the deadline for the rfe. I think this is the fastest way to get a response in writing.

If you have a lawyer and there is intent to deny I would look for another one

Hire a good immigration lawyer ASAP

your wife can apply;
1- After having 5 years of residency- GC [ Regular eligibility]
Or
2- After 3 years of you being a citizen.
So, in order for someone to apply based on 3 years rule, marriage to a usc, the us spouse should have been a citizen for 3 years.

each state has 2 senators , go to http://www.senate.gov/and you will find out the 2 senators representing your state. [ you can mention any of them, if they asked you]@Page 11
Question-Whats your answer for States U.S Senator? and U.S Representative?
---> I'm confused with these two. Thanks in advanced.
- congressman represents the people of his district, you can find your representative by going to house.gov , on the top right corner there is a place where you fill your zip code, then , the website will display your congressman.

Kash2011 & JimmyHou, you guys are always helpful. I am still debating to file on the end of March when my window opens, or wait until April.

Moe,
Just, as the first respondent mentioned ! Make sure your lawyer aware that your have a pending naturalization application, and if they found you guilty it will affect your eligibility. Most criminal lawyers have no experience in immigration law, The majority of innocent people plea guilty just not to risk having a hard punishment. In addition, most lawyers prefer not going to trial and make a deal with prosecutor. I pray for you my dear
-
But we all know the law is automatic guilt if your refuse the breathalyzer, and you refused.
what you know is not necessarily true !

The department of Public Safety had affirmed the 90 days suspension on my driver license, My attorney filed a civil suit against the department and he successfully removed the suspension and returned my driver license back a week later !
This is a good news. Just a proof what good lawyers can do.
I pray that you get your cases dismissed before the judge. Please, report back with the outcome

One more question, does bankruptcy affect one's ability to become a US Citizen?
No.
If you are sure that you lost your GC, I would file a formal police report for it.

contact your congressman and ask them to contact your uscis local office requesting an expedite processing of your N600. Send the congressman office a copy of your flight reservation as a proof. Hopefully, you will get your Citizenship certificate quickly

I think you shouldn't worry about it 2 much. You never know what they entered into the system which caused this error. It might be an error in your DOB, or something similer which they need to re-do the bio. I would go ASAP and do the Biometric. Usually, the FBI background check takes from 48 to 72 Hrs to be completed . So, After you do the finger print I will setup an info pass in a week or so to follow up.
-
Call them and request a correction to your A# on the form ! they should record what error was done, and then forward that to the NBC.
-
Then you should be in a good shape. Once you receive a confirmation from the NBC that they updated your address . I would request another NOA, I think you can do it from the website. and follow up with them regarding the bio appointment if you didn't receive the letter.
-
Most likely what the agent did is useless. she might just updated your address which is related to your A#, and since she didn't include your case number then your N400 address won't be updated. If you are lucky, the postman may know your apartment and then he puts the NOA in the right box[ if the same person delivers your mail daily]
Once you got your case number, hopefully you sent the notification form, you call them again and request an address update. Even if you didn't receive the NOA, Try to call them once your check is cashed and talk to Level 2 Agent and he/she should be able to find your case.
Make sure you receive a confirmation from the NBC that they updated your case. [ usually it comes in the mail after a week or 2 of the update request]
They won't stop your case if they got returned mail ! Just follow up with them until you make sure they updated your case .

The people ahead of me are the people who got approved 2 months after me and people who got approved with me had their oath over a month ago.
Unless I act on this, this will drag on for many months sure.
Then keep bothering them
-
After getting the final approval that doesn't mean getting an oath letter the second day. usually, there is another team who handles the oath cermoney, it will take some time because there is people ahead of you. I would give it 3-4 weeks , then I would follow up
-
Realize this is a month old, but thank you guys for your replies!
Still no bio letter, but had my attorney file a request with USCIS to see what's up.
Try to call them, your bio might be current that's why they didn't send your a bio appointment

I think your hired the wrong lawyer. In case you get an interview, bring paystubs and explain to the officer your attempt to save the marriage ,stating the fact you changed your job just to be closer to your ex, this is a strong indicator that you did your best to keep your marriage. I don't see any problem that it will lead to a denial.
-
one of the requirement to be naturalized under the 3 years rule, you need to be living with your usc spouse which you don't meet. I would withdraw my application if you see noway you can continue this marriage
-
-
A) we don't have kids, and B) we don't own a home (we rent an apartment)
You shouldn't have any problem.
send with application 3 years of Tax returns or apt lease. Keep in mind at the interview the officer may ask for more evidence , so I would bring extra proof like joint account statements / any joint stuff.
be advised that she needs to have the GC for (3 years - 90 day) before she could apply
-
No you don't need to do that. What uscis means, if you want to add extra info where the space is not enough in the form, then you add your A# to the extra sheet.

Just let him take the police report and itinerary print out. They can pull his travel record with a click of button, don't worry about it.
