    Hello! I have 80 days left until my Green Card expires, therefore I must apply for the extension. However, we decided to get a divorce because things are getting very bad. I have read several somewhat similar topics here, but they were a little bit outdated, can anyone please tell me the steps I need to take?
    This is hard for me, and reading about the process makes it even harder. I am not sure I am ready for the divorce, I would like to have some time to think about this, but I understand that I have no time, so can anyone please help me?

    interview took less than 5 mins.
    if only the DPS office could be such a breeze. went back again today and the line in one office was til the car park
    drove to another city and it wasnt as bad but had a 3 hour wait.. sighhh!!!

    You will need to explain the situation during the interview but she did not plan on getting married visiting you, so you will be fine.
    Read the guides, you will need to file I-130, I-485, Travel Authorization and EAD (Employment Card) all together. She can not leave US until she gets Travel Authorization. EAD card will allow her to work. It will take 3-4 month to get these documents. She then needs to apply for Social Security number and can start working.
    You will need the marriage certificate to start the process.
    It is written in the guides, just follow them. You will need to fill out some paperwork, you can start getting used to the forms right now!
    The other possibility would be to get married, she starts her job in Canada and you file for CR1. She will have to move to Canada though and you would be seperated. The process is similar, but the interview would be in Canada for her.
    Again, read the guides!

    If you do a search on VJ for "AOS interview", or google "AOS interview questions", you'll get hundreds of results with lists of possible questions. They'll ask questions to determine that your relationship is real and that you know each other - these can include anything from which side of the bed either one of you sleeps on to names of your family members, when/how you met, how much you make salary, etc. Our interview was 10 minutes and included very few questions: Our dates of birth (I was asked what his was and he was asked what mine was), when and where we met,how we delt with the long distance in the beginning of our relationship, and that was about it.

    Are we supposed to file the I-130 and the I-485 at the same time? Yes.
    There are some places where it asks for an alien # where is that? also it asks for an I-94#, he came over on a visa waiver, what should we put here? He doesn't have one, he will get one after you submit all the paperwork.
    Also for the guides for the I-485 it talks about sending the medical forms. Is he supposed to have a medical examination before we file?
    Yes, No physical done, no Greencard.
    Also in terms of fees, where do i find a list of how much i need to send, and who do i make the check to?
    You need to send $420 for I-130, $1,070 for I-485 (I-131& I-765 are free if you want to apply at the same time)
    Write the check to U.S. Department of Homeland Security
    The last question, since we have been working overseas for the past year, and weren't planning on staying in the US, neither one of us have jobs, we are currently staying at my parents house. Therefore, i believe my parents need to do a joint file? is this correct? and how do we go about this?
    Your parents can be the co-sponsor, I am not sure how this thing works, wait for someone else to help you.

    Show photos, letters sent to both of you. Any joint bills, or at least individual bills sent to the same address? IN your case, affidavits from friends or community members (priest etc) that know both of you may help also.
    Who will be your co-sponsor for the affidavit of support, or do you have enough assets (is the house in your name?) to self-sponsor?

    You have to go through these particular guides:

    You can file both of those forms, unless you want to file for your EAD and AP, then you have to file those forms along with them.
    It's important to understand the guides because this is mostly a do it yourself forum, so if the process really confuses you, you should reach out to an attorney. The people on here are very helpful with questions that need answering on particular issues, but definitely utilize the guides

    So you're saying he filed for the years he worked but wasn't required to file for 2009 so he doesn't have that available? If so, that is fine, he can include a letter stating he was not required to file in 2009 and stating why.

    I would say it is a waste of money... Lawyer is not going to know if you wrote something wrong, because he knows nothing about you guys. You can be spelling your address wrong, and the lawyer is not going to know about it. Best way is to sit around the round table with 4-5 family members, or close friends and check every single question. Or read aloud to your spouse, and let them read it to you.

    To use marriage as a vehicle to make someone "legal" is not legal but perhaps legal status could be achieved through a bona fide marriage.
    I think the reason you are seeing some of these negative reactions is because of the way the question is posted. It would seem that the intended outcome is to make the Latvian boyfriend "legal" by marriage to you or even someone else.

    This is what I counted...
    I-130
    1 for USC, 1 for beneficiary (which go with the G-325A)
    I-485
    2 for beneficiary
    I-131
    2 for beneficiary
    I-765
    2 for beneficiary
    None for affidavit of support or medical exam. Can anyone confirm? You could send in extras to be sure.

    I can't imagine this kind of situation...I love my wife way too much to have allowed that kind of separation. Losing a job is reason to seperate for a couple years? If this was my wife and I we would have done what it took to stay together...she would have looked for a job in Florida until she found one, or if she found one too good to turn down in Indiana I would have transferred to do school there or put school on hold...
    It's hard to prove you married for love when you have been married at least over two years...how long exactly you haven't said...and only been together for eight months of that...
    Truly baffling, and I would definitely expect huge red flags in the IO.

    Why bother taking the risk? Unless someone back home is dying, I would just wait a few more months for the green card.
    Why risk traveling abroad when the risk is completely removed after a few more months?
