    My advice is to end it. If your heart is no longer in it, then there is no way you'd be able to handle the process and all that it entails. It takes a very dedicated pair to follow through on it, as it is hard enough as it is. And it is best to end it soon, as the deeper you get into it the more you will lose once it truly is over.

    It's not so much the turn around of results that you have to worry about.
    In order for you to have the interview you must submit the Packet 3 which is either inclusive of the medical/sent directly too the consulate. The consulate will review your Packet 3 documents to ensure everything is in order. They will then contact you with "Packet 4" which will outline when you're interview time and dates are. Lately from what I've read, this has been approximately a month after the consulates receipt of Packet 3.
    So what I'm basically saying is I don't think it will be possible for you to expect to get a Packet 4 until they have received this. He most likely will have to do two trips a pain, I know.

    Brave...very Brave.
    There are too many variables that you can't control in this situation. It took me three months from NOA2 to my interview date. THEN I had to wait for the Visa to be posted to me - This was when they were processing interviews quickly. I do know earlier this year, people were having issues with getting in contact with the Consulate and having interviews scheduled as quick as they were end of last year.
    The Consulate will send you an email with Packet 3. All this is is a Word Doc summarising instructions from the below link. Read ahead and start working on those documents. Have your fiance send over the I-134 (Affidavit of Support) with original signatures and whatever supporting documents you need.
    To get the ball rolling, I would start off with your Police Certificate - this can take anywhere from 3 - 6 weeks depending on what state you are in.
    Call NVC for your Case Number It should look something like this SYD12345678
    With the above number, you are then able to book your medical. (Again this is dependent on the state you are in - my doctor in Brisbane wouldn't allow me to book until I confirmed I had the number)

    Hi, I have gone through (and am still going through) a similar situation to yours.
    Id been dating my US fiancé for about 3 1/2 years when she became pregnant in the US in May last year. So I stayed with her for just short of 3 months on a tourist visa over the summer (but I had been living in Canada before that) and returned to Australia. But before I left we started our K-1 Visa process, in which we sent in all our I-129f documents.....I was back in Australia for about 5 months and basically missed all of her pregnancy and because our NOA1 wasn't approved for almost 7 months I decided to fly back to new York for the birth (which I missed by 24 hours - she gave birth while I was on the plane) and stayed for another 3 months to help with our baby. Im currently back in Sydney waiting for my interview....should be issued any day now.
    Personally I think you should apply for the K-1 visa now and stay in New Zealand and earn money while you can and when she is nearly due to give birth (1 month before or so) come back to the states on a tourist visa and stay just short of 3 months and then return home to NZ for your medical and interview and by then your whole visa process will be almost over.
    That way you can have time to say by to family friends, you can be with her when she needs you the most - cause having a baby ain't easy. The whole visa process is bullshit in my eyes....but its the only way. Why risk the future of your wife and child by ruining your chances of living in the US. Do it by the book so to speak and youll be fine.
    Its a long process but you have your whole lives together....all the best!

    You need to have the medical done and then send it off WITH the packet 3 (or the doctor will send it directly to the US embassy). The US consulate will then contact you via email with the interview date and time.

    Count yourself lucky you've got school to keep you occupied. I was doing the Suzie homemaker thing full time while we waited for my husband's orders to drop from the worst base imaginable in the USAF (Thank Gosh we finally have them).
    Once you have your EAD, you go to the SS office and apply for a card. Make sure you bring the EAD.

    You'll have three packets if you choose to file the AOS, AP, and EAD applications at the same time. Although they're mailed together, treat them as individual packets as they will be separated at the lockbox. Thus, you'll have multiple copies of the marriage certificate, I-94, etc.

    Baron555 she probably won't get to the point of needing a chaperone since she is very likely to get her visa denied.
    Daddys_dream. Right now, I don't see anything else you can do other than submiting the reason she can't travel to see you. In the eyes of the USCIS the only thing that can stop her from visiting you visa denial.
    Not having the money to travel because her family likes her to travel in groups of three is nonsense.
    At the same time, this whole chaperone thing is very unusual for a phillipina looking online for a husband. I am not saying there aren't religious families in the phillipines, but their daughters don't try to marry older American men online. Be careful not to fall into a scheme of sending visa money + plane ticket money for 3 people. You are an easy target since you are disabled and can't travel to The Phillipines to cause trouble after losing all the money. Usually, If it's too good to be true it's because it's not true. You don't want daddy's dreams to be shattered now do you?

    First, I think you mean F1, not B1. A B1 visa is not a student visa.
    Secondly, she is Canadian. she lives just across the border and often some people take this for granted. Don't take offense when I tell you, being Canadian does not make her immune to US laws, nor does it make her special. She was being denied entry because you are her spouse, and because you could have filed for her GC once you became a USC. This alone give her immigrant intent. Not to mention she is in school and her "life" is in the US presently. You are supposed to bring proof of ties to Canada before entering. Your marriage does not alter the F1 (which is what I assume you mean), it can just alter her intent.
    You also admit that you effectively lied by omission to CBP. Did they ask you outright if you were married and you said no? Or did they ask relationship status and you said friend? If you lied in way this also looks badly on her. This increases her immigrant risk. To them, why would you lie about your marriage unless your plans were to enter and try and AOS later?
    I would file the I-130 now. It will put her in the queue. Then once your naturalise you can upgrade your petition to a citizenship petition. This will make it a lot quicker down the line (given the wait times at the moment).
    I would also seek paroled entry for exams, and offer to sign a form stating you will not attempt to file for her adjustment of status while in the US. It will be her only chance. She does not have a right to enter. They do not care about her schooling or exams, they care about the laws.

    Ap is for any purpose, not just for emergencies. So AP can be used to go whatever you want.
    But, AP takes 90 days to be approved. They won;t expedite it for anything other than a life/death emergency.
    The good news is that it is April now so if you applied by the end of the month, you'd have AP by around the end of July, so I think you'll make your timeline. It'll be tight though, best send off your package (which is a lot of forms and paperwork) ASAP.

    Look at your situation objectively.
    You husband has a US job offer. You show up at a POE with all your belongings, your cats, and no ticket to leave the US. You were suspected of illegally immigrating to the US and you claim no. Now, you want to AOS.
    Come on. You've just contradicted your claim which allowed you to be admitted into the US.
    AOS is not going to end well for you. Take your chances if you want, but its not going to end well for you because your statement at the POE is going to bite you in the #######.
    The smart choice is to go home and endure the temporary separation like many other couples here while you wait for your immigration visa.
    Sorry, but you played the "fast immigration" game and you've lost.
    I personally do not believe your story. I don't think anybody with experience on this forum will believe it either.

    Intent to immigrate is a negative factor that is not enough to deny an AOS by itself. However, did the person put "No AOS" in your passport or anything like that? I am not sure that even has legal grounds but I would be worried. Any other annotations in your passport?
    You were foolhardy to think that you could show up to the US with a husband and lots of bags and cats and no return ticket (a requirement of VWP as you now know) and to think that you would not have trouble with entry. I also think it's completely unlikely that after doing all that work on moving that you would leave the US, even though you say you weren't really planning it, per se.

    Start calling them now to get the syd case number...then as soon as u get it email im the number and he can book the medical ahead...then by the time he gets the pack 3 from sydney, he can send it all back the next day ..provided he has all the paperwork done. all Forms, Police check, birth certs, oh and your aft. of support package.
    Or thats how im planning on doing it ..i have everything ready to send now except medical and aft. of support which my girl is sending asap. that way its a quick turn around for pack 4 and interview .....then on a plane lol
