    An attorney is an absolute waste of money, from everything we've seen with people here they slow you down, most immigration attorneys don't handle many cases like ours. 90% of immigration attorneys are helping illegals and people who came on visas besides family based who want to stay longer or have overstayed. Even if they did have any experience there's nothing anyone can really do to speed things up. From everything we have seen on these forums they seem to slow things down, remember unless you have them on retainer you're not their #1 priority and as stated this type of visa is not their forte. Avoid like the plague.

    U.S embassy follows N.J court order
    All's well that ends well even if one had to get the court involved. Capitol News reported back in November that a Federal Judge had ordered the US Embassy here to make a decision in the case of an intended immigrant. The man’s case had been in limbo for nearly two years under what was called Administrative Review. Well the Embassy made a decision in the man’s favor and he was able to spend the holidays with his spouse from whom he had been separated because of his pending visa status for over two years. New Jersey Federal Judge William Martini was asked by a Guyanese woman who sponsored her husband to the United States, to issue a writ of mandamus directing that the US Embassy either issue or refuse her husband a permanent resident visa. The Judge ruled that while it may not be within the court’s jurisdiction to review how a consular officer arrived at a decision, it was certainly within the court’s mandate to instruct the Government officer to make a decision. The case arose from the fact that the husband received a letter from the U.S. Embassy in Guyana stating that he was found temporarily ineligible to receive a visa. That was since June 2011. The letter stated that the case required “Administrative Review” and that new information, when available, will be communicated to him in writing. The court found that over time there was no evidence of administrative review. After the matter ended up in the court the US embassy called in the husband to continue the process. And earlier last month the US Embassy not to be in violation of the court order made a decision and issued the visa.
    Several persons have complained about delays in the immigration process where US embassies in the Caribbean have put them on pause so to speak for administrative review or claimed that there is a refusal on various grounds including failure to provide documentation or allegations of misconduct. The New Jersey Judge’s order is expected to make it clear that decisions have to be made according to the procedures laid down in the law. The Court ruled that intended immigrants simply cannot be told “your case is still pending” without a final decision being made.

    What people have been saying here is not entirely accurate. If the background checks are ongoing, State will make that case to the judge. In most cases, AP is just the embassy people dicking around not doing their job because they either do not want to or are not encouraged to grant visas to certain categories of people. In these cases, AP is a very effective way to force them to actually do their jobs. Also 1 year is sufficient to file a mandamus. I would listen to your lawyer.

    You're right, but LPR's are not the culprits. Illegals are. The suit would have to be about them, not the LPR's. LPR's still have to wait for the PD to become current before they can get through the NVC, our USC petitions get picked up straight away. The crime comes in what Obama has done with illegals, giving them precedence over us. The President does not have the right to give status to illegals, only Congress can do that, and he certainly does not have the right to give them precedence over us in naked defiance of the INA. There's your lawsuit.

    My name is thedude6752000 and I have petitioned the government for my wife, who is currently an Indian national residing in that country, to get a visa to come live with me here. I just wanted to thank you, you majesty King Obama, for your DACA amnesty, put into place completely in defiance of the US Congress and Constitution. Although I doubt you care, in addition to the 7 months at the USCIS I had to endure without my wife, I am now coming to find out that the National Visa Center has extended the wait time for every piece of paper they process from 30 to 60 days as a result of the backlog created by your brazenly illegal amnesty polices. I really appreciate all the help you've given to people who have no legal right to be in this country at the expense of people patiently waiting in line to come here the right and legal way. I especially appreciate the fact that I will pass my first wedding anniversary next month alone and without my wife. That's hope and change I can really believe in, because unlike your empty promises to "fix the immigration system for people playing by the rules" I am sure this will come to pass.





    In closing I would just like to say that I cannot wait to vote straight Republican in November (and I say this as a former OFA Deputy Field Organizer in Florida)and even to help the Republicans here in Virginia organize and get out the vote, in order to do my small part to further ruin the last years of your useless Presidency, just as you have ruined my life and shattered my marriage.

    If you're the beneficiary...go ahead and pay for the increased fess...nothing will change. As a USC, I don't want to pay more fees. As long as we don't have a miscreant government making unilateral decisions that affect the lives of USCs filing for immigrant spouses...we should have fine!

    You are mistaken. The I-821D, consideration for deferred action, has no filing fee associated with it:

    The I-765 is the work permit. DACA is not self-funded like every other USCIS form. Also DACA has not been suspended by Congress nor is there a workable possibility of doing so, unfortunately. Not sure where you heard this one.

    Remember to vote R in November to punch Obama in his big floppy-eared face for this debacle.

    Man, people need to read the threads on this forum.
    1) If you get the "alien registration #" message it means someone is working on your case and you'll probably be approved soon
    2). If your case is languishing at the NBC and it gets transferred, you get three messages, one informing you that it's going to your local office. In fact only the hard copy NOA or the USCIS dis-service line can tell you which service center it's really going to (id est it's not actually going to a local office).
    I must say it's tiring to see these same 2 questions asked over and over and over and over and over over and over and over and over and over over and over and over and over and over over and over     IMO, rather do it yourself. Like what others say, some lawyers seem to cause more delay in the process... VisaJourney and other reliable websites have great information to help you throughout the process.
    If not, tell your lawyer you need to review the forms and docs before they send it. Goodluck!

    I can't speak for USCIS, but I work in an office that deals with UK government paperwork and we absolutely do not allow Tipex/liquid paper on documents so I wouldn't recommend using it. I would follow Darnell's and The Dude's advice.

    I notice the CEAC website states that they are dropping support for IE6 and SSL on the 17th. I assume this means they will roll a big update to the website over the week end. I wonder if the evidence and documents fields which are currently always marked "N/A" will become more informative. I also wonder if some of the recent checklists asking for a ton of documents already submitted might be because of this change?
    This is pure speculation on my part.

    Day 57 and still no cc. Getting so discouraged, I don't even want to check ceac anymore. Each time is like a tiny dagger of disappointment in my heart. I truly feel like this is just never going to happen for me. The longer it takes the more I worry they have found something else wrong and will issue me a another checklist. It's just constant worry and butterflies, I really hate this.

    I know NVC is not involved in DACA
    what I was saying is that DACA had caused a huge backlog of petitions for alien relatives in which the USCIS had mustered manpower to overcome
    they have cleared the massive backlog which has now flooded the NVC to the point they are now backlogged..
    that is what I was trying to say.
