    Your new wife wants you to give up custody of your two young boys, because she wants her own? Great. Tell her to go find a guy who doesn't have children. I hope you're not even considering this. Put her on the first plane back.
    Do you have any idea the damage it would do to your boys if you ship them off, essentially reject them, in favor of "new" kids? You can't do that to them. If she doesn't want your boys then she doesn't want you. End this before she gets pregnant. She will never treat your boys like her own. Don't hurt them that way, please.

    Let me ask you a question Robert. If somebody was giving you a letter to verify their income, what kind of information would you find useful to see in the letter? And I know you haven't bothered to read the I-134 instructions or you wouldn't be asking.

    I don't mean to be grouchy , but people can't spoon feed the same answers to you personally over and over each time it pops in your head. Hire a lawyer to do your paperwork If it's beyond what you're able to get from the embassy website, Dept of State website, the instructions for the forms, and from this thread.

    I think that would depend on more factors than you've used, photomile. Including any nebulous "average" employer plan in the US. Lord only knows there is no such thing.
    You might want to look at prescription costs in the US. What people pay for their meds not only depends on what they take, but how their insurance company defines the drug. Generic; Formulary; Non-Formulary. All the insurance companies define these differently. You can literally change jobs only to find that a drug your former employer's plan paid is not covered by your new employer.
    And you should take a look how much paycheck a USC brings home after insurance premiums are deducted. US employers expect all their employees to bear the same cost of the plan. So the Chief Executive Officer pays the same per month for health cover as the janitor.
    I could go on but I won't. All I know is I don't talk to many British citizens who don't long for the NHS after they've spent some time dealing with health cover in the US.

    I certainly appreciate the lack of financial stress that the NHS gives you, now I've been here for a while.
    I get my coverage through my husband's work plan which is an amazing plan so our coverage is great - we had no co-pays at all when I gave birth in a hospital here. I saw the paperwork though and if we hadn't been covered it would have cost us something like $20,000 (for a simple, no complications birth). A friend with a different insurance plan had to pay about $2000 as her co-pay for her hospital stay after giving birth. And that didn't include all the prenatal care etc. A Caesarean birth was about $80,000.
    But even though we were covered for everything, I still had to ring the insurance company every time a test was ordered to see if it was covered. It made the experience really stressful.
    With our plan my asthma inhalers cost me $20 but I can only have one every four weeks, so if I lose one I have to pay the full price to replace it which is $200. I found that out the hard way.
    The care you get here is lovely - very plush and private. But on the other hand I always found really nice GP practices in the UK, even in central London so I would never knock the NHS too much now.

    Well for the record, when I was petitioning for the green card under the I 130 there was all this talk about Haiti and the devastation of the 7.0 catasphronic earthquake in 2010 and those folks would be processed first etc....and people started making similar comments such as yours, against the President blah blah...and guess what? My petition from filing to approval took 6.5 months. Many many others were very close in that timeframe. So the argument and fear was without merit.
    And do you remember that while it's a royal pain the rear to have to wait, there are people facing deportation, you are not. Just like the folks in Haiti faced unbelievable devastation, people actually complained about the possibility of their own claims being delayed, and weren't.

    Yeah and we have been called "haters"... well I can't imagine coming on here and state that the system is great cause I got approved quicker than anyone else laughing you all in the face! So not considerable! People wait here almost half year in pain and tears to read someone giving an advice on how great the system works and how we will all get approved when he/she knows nothing about the wait and what we've all been through..

    Wow, that's ridiculous! Paul is being realistic about things and that gets him shot down? I'm sorry, but I do have an issue with the VJer crowd who want to be all "hope, trust and pixie dust" about their petitions being magically approved in record time in spite of the facts.

    Congrats for your approval. Sometimes VSC or CSC do things like this and I am very glad to the couples that get lucky.
    However, I totally dislike your tittle. Maybe you were too excited and didnt think while writing. I have some news for you: For everybody else " THE SYSTEM DOES NOT WORK". We and i dont mean just me but the majority have to wait for long periods of time. We all have special circumstances, in other cases really troublesome situations and we cant get approve for expedite request. Anyway, I wish you the best and next time remember that not everybody is going to have your experience. That's all

    I've had a (real) SSN for 7 years. Got it while on a non-immigrant visa (student). A made-up SSN doesn't equal claiming US citizenship, it just means claiming an immigration status you're not entitled to. It's illegal, sure, but not even close to being equal in rammifications as a false claim to US citizenship.

    I get bothered by people who act like the k-1 visa is the only "right" way, but hey...just my opinion.

    No, your wife can stay here and file for adjustment of status again. HOWEVER, you must now file a I-130 with it as well, to establish a marital relationship. The I-129F is void because you did not marry within the 90 days. But as long as they all entered with inspection (they did) you can file a CONCURRENT I-130/I-485 Adjustment of Status package for them all, and they can wait it out inside the US.

    You will also have to file this for each stepchild.

    I'm not saying that I think it's ok she worked illegally. I'm actually very much against that particular crime. But, had she come here before she filed and said "I've worked illegally, what do I do?" Everyone here would have said "whatever you do, don't lie about it." And that's what she did, she filled out her paperwork honestly. Now that's she's approved and excited about it, people seem to be saying "we wish telling the truth would have got you deported". And, "we hope it gets you deported in the future." Does that make sense?
    She's young, she might have a disagreeable personality, but I don't see why everyone's so angry at her.

    This is just freaking ridiculous that we cannot file a service request because THEY are late. What will happen if in a week or even a month they are still late ?? We want to file a service request BECAUSE they are late ! This does not make any sense at all ! I am so done with that #######

    stay strong guys, it WILL happen.
    we got our noa2 on friday and it was wonderful, and now we're preparing to say goodbye again until POE... andrew's flight is tomorow and all i want to do is cry. i know we have our approval and that is a huuuge step i'm so grateful for, but i guess the point is, we're all hurting in some way, and we all deserve friggin' medals for doing this! but in a matter of MONTHS we're all gonna be exchanging stories of arriving in the US and starting our new, permanent lives... this is what keeps me going. we really are at the very end of the marathon - especially for those like us, who did long distance for a good few years before getting engaged. we're all gonna be okay!

    As it says in the video link I put up, if you oppose these changes, please send an e-mail to UK Shadow Minister for Immigration, Chris Bryant.
    It is being reported that his office is responding to these messages. There's no way to know if Bryant himself is seeing these messages right now, but hopefully he will before Tuesday. Parliamentary debate on these issues occurs on Tuesday June 19.

    What's crazy about this is that the UKC (especially a woman who is a SAHM) may not be the main breadwinner. And they don't count the non-UKC's income even if they have been married for years? So a UKC who stays at home with children (or is just a low earner or whatever) who happens to be married to a non-UKC who is a lawyer or corporate executive earning 6 figures but with less than $100k in savings is going to have problems?
    My mind is boggled by the stupidity of it. I may need to pay a visit to uk-yankee to understand.

    Go read, Boiler. It is as unlike the US system as it can possibly be.
    Minimum income is grounded to no national statistic, unlike the US where it is tied to a statistic that is used as a qualifier in most states for benefits.
    Minimum income is inordinately high for many regions of the country, especially Scotland, Northern Ireland and the North of England. Unlike the US where the minimum is slightly higher than the reach of someone with a minimum wage job.
    You must first have savings of £16K before you can use the savings ABOVE that amount to offset income. (That's about $25K for those not familiar with the exchange rate). This is a HUGE difference to savings offset in the US system.
    You must have been on your job 6 months before the income from it qualifies for use. No such rule in the US.
    Permanent residency not granted for 5 years. 2 in the US for spouses.
    No immigration benefit to partners who have been in long term marriages.
    I could go on. Or you could read the details yourself.

    As I already told you, European Nationals do not require any visa. They also do not require an offer of employment, that is nothing like the DV, TN or E3.
    Under European law, you do not need to obtain documentation confirming your right of residence in the UK if you are a national of a country in the EEA.
    The UK spouse would be ineligible for any income based benefits due to their income and or savings.
    The US spouse would be ineligible for anything that is classed as a public fund.
    Public funds include a range of benefits that are given to people on a low income, as well as housing support. These are:

    income-based jobseeker's allowance;
    income support;
    child tax credit;
    working tax credit;
    a social fund payment;
    child benefit;
    housing benefit;
    council tax benefit;
    state pension credit;
    attendance allowance;
    severe disablement allowance;
    carer's allowance;
    disability living allowance;
    an allocation of local authority housing;
    local authority homelessness assistance;
    health in pregnancy grant; and
    income-related employment and support allowance.


    The Conservative party are the ones responsible for this, namely Theresa May. Do you even know who is in power there?

    Flipped open the iPad one last time before bed and...... THE EMAIL!!!!!!! Approved!!!!!!!!!!!!!!! I was shaking and crying and best of all got to turn to Andrew and kiss him right away.... On our 3rd anniversary, no less!!!!!!!! What an amazing week - all we wanted was noa2 by the time he left. Amazing feeling. Hope you all get to feel it soon. Thank you so much for all your support, what an amazing community we have created here!
