It's the best worldwide courier service. It's expensive most reliable, but, then again, you are sponsoring your future spouse. I think it's worth it.
I would never dream of sending important documents using a government postal service.

I am at a total loss. It has been over 3 months since my fiance filed the petition in California and we have not received an NOA1. He finally called them last week and the lady said they're backed up and he mentioned something about them not processing petitions that are not standard size? What is that??? I'm sorry to be sounding like I'm ranting here, but let me just say it, I am VERY frustrated!!! We know they haven't received it at all because they didn't charge the check he sent in. Why is this happening? Have any of you ever heard of something like this? I'm ready to wait a long time for NOA1 to NOA2 but to wait this long for Filing to NOA1, it's absurd and so disheartening. :-(

1. You wait 3 months for a NOA 1, which takes 5 days or less to receive/approve
2. Next, the petitioner wrote a bad check? Have you checked to make sure if the check has been cashed or not? If not, you wont' receive the NOA 1.
3. Was the check drawn off a US Bank for the correct amount?
4. Ask your fiance double-check the 1-129 application and make sure nothing was missing.
I am betting there is an issue w/ the payment and file is missing documents. NOA 1 strictly means USCIS receives the application in Dallas, cashes check sends to processing center.

Spending money on a wedding is all relative to your budget , and what you feel comfortable. Some folks will spend $5000, while others may spend $100,000. It's a personal thing b/t the couple.

Thank you for your reply, Joanna. Sorry I was not very clear. I am the USC and Tom is the UKC. We will be having a co-sponsor because I am in graduate school and am not working full-time. We are good friends with a couple who was successfully granted the K-1 and are now married. They advised us against Tom changing jobs. Do you think it will have any effect on our chances of the visa being granted?
Changing jobs won't hurt your case unless your fiance decides to take a pay cut which would not look good. The real important part of the job / salary come into play when you are approved for the k1 and the petitioner has to provide financial support documentation i.e. i-134 before your interview. Getting to this stage will be months away. Also when your finance does switch jobs, it's very easy to call the USCIS number, speak to someone and ask them to update the file.
A job change can be included on that i-134 which shows salary history, along w/ the required paperwork. Shouldn't be a problem, in my opinion.

I think Pakistan must have different procedures. Canadians going to the US consulate in Montreal are saying otherwise on this forum.

I am going by what's written in the directions of the DS-156K Form (check out their required documents needed by the beneficiary), and what the i-134 requires as part of the affiv. of support required by the petitioner

WE GOT APPROVED JUST NOW!!!!! PRAISE GOD. I was sitting at my pc when the email popped up. I could do nothing but start to cry.

But why does DS-156K ask for it? and then have them not expect it. It's kind of confusing .. don't want to risk getting and RFE for a stupid mistake like that you know? Is there any reason why the form would ask for that?
Your finance in the USA should have mailed you the following for your interview and Affividat of Support
1. Letter of employment
2. Recent paystubs.. two months
3. 2 yrs of Tax Returns from IRS
4. Bank Verification Letter
5. Filled out I-134
Your DS-156K must be filled and submitted to the consulate
Attach the following w/ your submission
1. Copy of Birth Certificate
2. Evidence of Engagement
3. Evidence of Financial Support. See Above items (1-5)
4. Divorce decree (if any)
5. Police Certificate(s)
Without submitted these items w/ your DS-156K, your submission will be rejected. You don't want that.
Hate to sound like a broken record, PLEASE read the DIRECTIONS on the forms. Government is notorious for returning missing information or incorrectly filled out forms.

Just want to ask coz I am not clear about POE's. Our original POE is supposedly LAX,California. However, my fiance is now in Texas for his work. Our plan is to fly me all the way to Texas. Will this be ok?
As others have said. You will be arriving to an International airport in the USA, where you will enter using your k1 visa and letting the inspectors check your sealed packet. You are fine.. You can land anywhere in the USA.
Have a safe journey to the USA..

Will we be notified when our petition is at NVC, and when it is forwarded on to the consulate? We were wondering if the USCIS website is where we look for that. Thanks for all your help!!!!
Don't believe NVC sends anything to Petitioner. I would recommend calling them and checking your case number. They can tell you over the automated line if and when your petition was received and if sent out., but you wouldn't get a physical notification from them.

Noticed on DS-156K a birth cert. is required. However, i think a copy would suffice..

-DS 230 (Only complete part 1)
-Parental Information Form
-Original Police character certificate from all the cities from where your fiance(e) has lived for more than 6 months after reaching the age of 16 (provide a photo copy as well)
-Original Birth Certificate (provide a photocopy as well)
-2 passport photos (2x2)
-Copy of the first 2 pages of your fiance(e) passport
The Birth and Police certificate must be in English if they aren`t then a translated copy is required to be sent
Correct me if i am wrong. The consulate doesn' t request a birth certificate to be mailed to them as part of Packet 3.5 They request the beneficiary to bring DS XX documents as indicated, and but bring birth certificate it at the interview date/time. Reason I say this is b/c imagine, if the packet going to consulate gets lost or misdirected (unfortunately likely and common) in Pakistan, the beneficiary is basically royally screwed. If the original birth cert. is lost, that's a huge ordeal..so unlikely the consulate will ask for it to be mailed..
I would like to hear others' experiences on this ..

Hi all got a letter from USCIS today stating that I have to re file again. My question is it better to re-file again or marry him and file for the marriage one rather than the I-129F since we have been in that route? I am visiting him the next month and make the decision from there. I wish I have known that we have four months wait after the interview to rebut the issues. I assume hat they just let the paperwork expire after I called them and send them a letter they finally answered my questions. Lesson learned to keep following up the paperwork but then we did these also but to no avail it did not work for us they just let the paperwork expired. Well get it right next time I think
This notice is in reference to the Form I-129F , Petition for an Alien Fiancee(e), filed pursuant to Section 101 (a) (15) (K) of the Immigration and Nationality Act, as amended. The petition was approved and was forwarded abroad to a United States Embassy /(Consulate with a validity period of four months. Subsequently, the petition has been returned to the United States Citizenship and Immigration Services (USCIS) with a finding that the beneficiary was not issued the requested K-1 visa/ Since the period of validity has now expired the petition will not be revalidated. Therefore, in accordance with 8 C.F.R. 214.2 (k) (5), all USCIS action on this petition is concluded as of the date of the date of this notice. However, the petitioner may choose to file a new Form I-129F, Petition fo ran Alien Fiance(e), for the beneficiary with fee.

Have you spoken to your fiance abroad and discussed what questions were asked during the interview? if so, there could have some discrepancies in his answers w/ the data you provided in the 129 application.. Seems to be, the application was approved and ultimately visa denied once the interview took place.. Is that correct?
If the USCIS is advising to re-file, I would do that, only this, provide a stronger case (evidence, relationship) and make sure cover detail of the application so no surprise questions during the interview..

On rule of thumb, expect it will take 5 months end-to-end from NOA1 to Interview Date. Once you understand this, its a waiting game.
Some NOA2 Approvals are quicker, than, others, but if something is outside your control, don't stress about it.
It tests your patience, but, that's life.
Personally speaking, I think the USCIS does a very good job in vetting the applications, processing applications. You need to realize people throughout the world (other visa types) from all over the world
try to enter USA legally and through illegal documentation, so, I don't mind USCIS taking 5 months time, because it's a huge task to make sure the country doesn't let in crazies, or fraudulent cases.

What is the exact amount I need to pay for the I-129-F packet? Will a cashiers check or a western union money order work fine? Do I just make it payable to "USCIS"?

I sent a personal check. No problem. But a cashier's check drawn off USA bank will be fine. Please read the directions on the application for all the details, there are many details people overlook which cause returned applications..

yes i'm aware that cash income is also meant to be reported in taxes. but tax evasion isn't in the field of jurisdiction of the immigration department. but thanks though, i may have to do that...

By virtue of not filing taxes as a US Citizen, and having earned a large cash income base, while attempting to document this will be a big problem when your application is reviewed. I hate to be the bearer of bad news, but, IRS comes after even small time evaders, and simply thinking immigration will overlook this is highly naive.
If you going to sponsor someone, I would advise to file back taxes, and get yourself in the IRS system so you can
A. Legitimize your payments of taxes to the government. Be clear of red flags down the road.
B. Establish your creditability for immigration and IRS

Did you make a copy of the 1-751 Form? That is the evidence of support to show the government you are in the process to remove conditions. Do you send the letter certified mail w/ signature, it's very easy to track and make sure who signed for it in Vermont?
Did you call USCIS and find out what steps you can take to mitigate the situation?
