  1. If you are a qualified with a degree in a sought after career field such as Accounting, IT, Engineering, Applied Sciences.. YOU will get a job in the USA.

My wife recently accepted a position with an accounting company for $65,000. She has an accounting / MIS degree, 4 yrs of experience overseas. She came here on a K1 in March, we got her Green card in few months, and she was working part time in an office til green card came.

She was applying non stop to companies, networking.

The economy is slowing coming back up, but, you need to be persistent and determined to a job. In the meantime, take classes, improve your skills, get certified.. It helps ALOT

  2. Congrats!!!

    FINALLY

    VISA ISSUED :D

I will be leaving P-land and arriving to see my Fiancee on her birthday.... WHAT A GIFT FOR HER

THANK You everyone on this forum and especially Al Mighty Allah who gave me this wonderful gift.

And yes to the senator who helped me, to my lovely family and the US embassy who issued it to me.

And the list doesn't end here, so its' ETC ETC ETC...

    LOVE YOU ALL!!

    ONCE AGAIN THANKS :D

  3. Let's put it this way. The likelyhood of pakistani males being put on 'AP' is very high. There are some who don't get it, but, plan for AP but you may be surprised.

I am not sure if the name thing matters alot, but, background checking and proof of relationship probably single most important element in putting folks on hold.

    - It's very important to have met in person in pakistan or somewhere where you show proof of meeting.

    - Take alots of pictures, hotel receipts, airfare receipts.

    - Pictures of with family members

    - Make sure you don't need a co sponsor. I keep on reading how during the interview session they deny visa b/c lack of financial support from USA sponsor.

    - Get all police certificates from places male fiancé has lived. It shows through sponsor has done due diligence.

    - Make sure all fiancé information is correct and matches on all forms. Interviewer will question the accuracy of the forms.

It's very tough that so many males are put on AP, but, at least you need to be prepared.

    Good luck

  4. Just an FYI to the people on this board! I am expecting a treat from anyone who gets off of AP and gets a visa... and if my fiance gets her VISA on the 18th of October you may come collect your treat from Lahore.. I promised her that will fly out next day to spend time with her and bring her back as soon as she gets her things gathered... im estimating 10 days :P

Wishing her all the best. Females are getting their visas with regularity in Islamabad. Good sign.

Do some research and email her some practice questions which interviewers tend to ask.

I wouldn't say they are trick questions, rather, they want to make sure the couple isn't already married if K1 visa involved.

  5. How shall I manage to check either my sponsor is eligible to call me or not so how shall I see it ?

I mean, she is calling me on K1 visa and her family unit is sized as 6 but no one is dependent on her and everybody is earning their own ? How shall I check that ? Right now I am simply preparing for my Interview and asking her to prepare I-134 so what should I do !

Your sponsor in the U.S.A should be well aware of the financial support required for K1 Visa.

Your sponsor in the U.S.A should have a job and verified tax returns / bank statements / letter from employer submitted as part of the application for K1 visa.

She should check and confirm her income in relation to the federal guidelines. If above, good thing. If not, she needs a co-sponsor.

If the income is not meeting the federal guidelines, then there will be an issue during the interview. And likely there will be a AP put on you, until the appropriate level of support

    is provided.

Please refer your sponsor to the GUIDES section of this site. It's VERY helpful.

    good luck

  6. Thanks for your answers. So there is no chance of getting interviewed in turkey? Btw do our age difference pose a red flag?

No problem.. I don't think you will get interviewed in Turkey, unless you provide a compelling reason to USCIS, which will be difficult, since you are a citizen of Nigeria. Consult a good lawyer in this case. I have no clue of Nigerian customs and age differences. I have read of others on the forum with age differences from 10-15 yrs, so it's not uncommon. More important is the support of evidence your fiancée will be providing to prove the relationship is real.

Nigeria is one of those countries where it's a tough process to K1 visa approved. Ask fellow Nigerians on the forum for their personal experiences..

    good luck

  7. Hello Fellow members,

I am new here and i love this forum. I have been reading a lot. Pls i need a help on some issues. My fiancee is from USA and I'm from Nigeria but residing in Turkey. We want to file for k-1 petition. Which address will she use for me, Nigeria or Turkey as i'm not a permanent resident in turkey. I have only 1 year resident permit as a student. I wish to be interviewed in turkey. Is there possibility that it will happen? Also we need a co-sponsor and we are confused about the forms for our co-sponsor. What form exactly is for co-sponsor? Also do our co-sponsor need to have cash in his account or they just wanna know annual income and tax scripts. Pls i will like your advise and answers. Thank you all in advance for helping. God bless.

If you are a citizen of Nigeria, then, you will be interviewed at US Consulate in Nigeria, even, though you are living in Turkey. Others can chime in and correct me if i am wrong.

Your sponsor US citizen fiancée will need to file the K1 papers. Please read the Guides section on this website. It's extremely helpful. Regarding co-sponsor, if he's making below the recommended income guidelines, yes there needs to a co sponsor. USCIS is very strict on this matter, and reject many K1 applicant who fail to show sufficient income.

Your US fiancée should be well aware of filing taxes and income requirements. He should have two to three years of US Income tax reported /documented and available to show. K1 is an expensive and long process. Even slight mistakes in the application will set you back months..so i urge your US fiancée to read and understand all the requirements. If they don't make sense, ask specific questions and I am sure many will help out on this forum.

    Good luck

  8. Hi Guys,

I just wanted to let you know that on August 1, 2012 I wrote a letter to President Obama about my case. I made sure to give him our names and case number. His office forwarded my letter to the Department of State and I got their reply today. They gave me a history of our case and said our petition was reaffirmed and sent back to Islamabad Embassy and received there on June 28th, 2012. Right now our case is currently pending under Section 221(g) of the INA.

I wasn't sure what date our case made it back to the embassy so they gave me some information I didn't know. It made me feel better to write to the President and see what their response would be. So don't be afraid to write to the President you might just get some important information about your case.

    caroyln:

It's important to understand INA Ineligibility Rules and what they mean.. i am sure u have reviewed them as well, but here's what i found

    ==

If a consular officer finds you are not eligible to receive a visa under U.S. law, your visa application will be denied (refused), and you will be provided a reason for the denial. There are many reasons a visa applicant could be found ineligible for a visa. These reasons, call ineligibilities, are listed in the Immigration and Nationality Act (INA) and other immigration laws. Some ineligibilities can be overcome, either by you, the visa applicant, or the U.S. petitioner, in certain immigrant visa cases. Other ineligibilities are permanent. This means that every time you apply for a visa, you will be found ineligible under the same section of law, unless a waiver of that ineligibility is authorized by the Department of Homeland Security. Learn about waivers of ineligibility.

Here are some examples of visa ineligibilities, with INA references, which are explained further below.

    The visa applicant:

    • <LI jQuery1348856198056="77">Did not fully complete the visa application and/or provide all required supporting documentation - INA section 221(g)
    • Did not establish eligibility for the visa category being applied for or overcome the presumption of being an intending immigrant - INA section 214(b)
    • Was convicted of a crime involving moral turpitude – INA section 212(a)(2)(A)(i)(I)
    • Was convicted of a drug violation – INA section 212(a)(2)(A)(i)(II)
    • Has two or more criminal convictions for which the total sentence to confinement was 5 years or more – INA section 212(a)(2)(B)
    • Did not demonstrate proof of adequate financial support in the United States; therefore denied under public charge - INA section 212(a)(4)
    • Misrepresented a material fact or committed fraud to attempt to receive a visa – INA section 212(a)(6)©(i)
    • Previously remained longer than authorized in the United States - INA section 212(a)(9)(B)(i)

Is there something I can do about a refusal under section 221(g)?

If your application was denied because documentation or information is missing, you can provide the missing documents or information as soon as possible. After submitting the documentation, your visa application can then be processed to conclusion to determine whether you qualify for a visa. You have one year from the date you were refused a visa to submit the additional information. Otherwise, if you do not provide the required additional information within one year, you must reapply for the visa and pay another application fee.

If your application requires further administrative processing, this takes additional time after your interview. Processing times can vary based on individual circumstances. For more information, review Administrative Processing.

** I suspect if you have provided all the required documentation and they have confirmed this, then, the only possible reason they have your spouse/husband on AP is background checking.

With the issues impacting Pakistan and anti-US sentiment from radicals, it's VERY unfortunate most Pakistani males are put through exhaustive background checks..

    Wish u all the best

  9. Oh wow 6 years of waiting you two must love each other very much. My husband and I have been trying to get our visa for 3 years. People like you let the rest of us know to never give up. I admire you so much and I hope you will get your visa soon.

Wow, 6 yrs of waiting!! amazing. If this happened to me I would likely leave USA and join my fiancee or re-locate to a country like Turkey and start a new life. There's a limit to each person's tolerance and threshold, but I salute the both of you for having the patience and endurance to wait it out for six years..

  10. Well i sent with my packet 3. cosponsors i-134, three years tax returns, her job letter and thats it.

BUT AGAIN THE I-134 FORMS I SENT WITH PACKET 3. MY FIANCES MOTHER CHECKED ITEM 11 THAT SHE DO NOT INTENT.

i 80% BELIEVE THAT THIS IS CAUSE OF THE SECTION HE PUT ON US!!!

    Any thought boss?

Update the I-134 form and update #11 with the correct answer. In addition, submit a written attestation (proper letterhead) signed by co sponsor stating she INTENDS to take financial responsibilty for you and you won't become a burden to the state.

This way the embassy has a record of the correction and hopefully this helps you.

    Good luck

  11. i had a interview today. here is a review guys.

I arrived Islamabad a day before my interview. On the day of interview I booked a cab 5;50 I was at the shuttle service in 30 mins I purchased a ticket for U.S embassy for 500 rupees. And Sharp 7am shuttle coaster started to drop me within 25 mints and i waited outside of the embassy for 15mins after that I was at the embassy gate. The guard directed all of us to make two lines 1 for immigrant and 1 for non immigrant the guard looked at my passport and matched my name written on the interview letter. Then I went through immigration line for some security checks afterward a guard told me to have a seat. I was the first who went to have finger prints. They took my finger prints I have given my appointment letter then she told me to go to window 7. On window 7 a Pakistani male asked for the medical report and character certificate after reviewing my medical he asked for my passport and handed me over an instruction sheet on which a pink token is attached for the collection of passport from Speedex Peshawar then he said in which language you want to be interviewed I said English and 8.25am and from window 5 called my name a Pakistani lady told me to pay the fee so i paid it in dollars, I gave 240$. At 9am a male counselor officer almost 40 plus called my name I went to window no 3 he said hello then asked me to take oath after oath he asked me some questions which are mentioned below.

CO: who is calling you to America?

    Me: my fiancé

CO: is it a arranged thing or love?

    Me: Love sir

    CO: Is she your relative?

    Me: No

CO: why do you want to have a wedding in America?

Me: I gave him the reason and he said ok.

CO: How did you guys meet?

    Me: We met online

    CO: how?

Me: we met on facebook sir.

    CO: how old is she?

    Me: 23

    CO: how old are you?

    Me: 26

CO: So she had been born in ……. City and her name is (where CO was reading her name)

Me: I said her name is ……..

CO: oh so she is Muslim??

Me: Yes sir she is born Muslim.

    CO: oh that's good

    CO: what does she do?

Me: she just graduated from collage and looking for a job sir.

    CO: what do you do?

Me: I am …. At …….. And recently I got promoted and got a raise and now my title is changed.

    CO: do you have children?

Me: I have never been married before sir

CO: Have you ever been arrested or charged?

    Me: Never sir.

CO: So you have pictures here. (Which were sent from uscis). He looked at them and said you can have them.

    Me: ok thank you

    CO: you're welcome

    Me: smile

CO: let's see you have a lot of receipts from the hotel of emirates Concorde (while he was reading the name of a hotel I completed the name of hotel and told him where it was)

CO: How did your wife manage to have trip to Dubai since she hasn't got a job?

Me: I corrected him saying... My fiancés mother financed the trip.

    CO: ohh okay.

Me: he said several times your wife but I was keep correcting him and saying my fiancé.

    CO: ohh yes your fiancé.

Me: I don't know whether he was saying a wife by purpose but every time he mentioned wife I corrected him to my fiancé. His facial expression were saying that he consider fiancé and wife the same MAYBE.

CO: so your fiancé doesn't make enough money and you are likely to become a public charge. She has to have a job that makes at 21000$ annual in order to overcome this and to issue you a visa. (thats where I realized that he is going to say something bad)

Me: But sir we have a cosponsor which makes way more money per annum

CO: See in K1 visa we don't allow or accept ( I don't remember which word he used) Cosponsor.

Me: and I was like (WTH) so I said what's the way out?

CO: He said there is no other option she has to overcome this in order to issue you a visa and we also have to do little bit of a administration process.

Me: So are you going to send our case back to Uscis?

CO: no its staying here and while you can send us proof about her job or any document that helps.

Me: ok So can I have a payment receipt?

CO: you need a payment receipt?

Me: yes sir because the lady from window 5 said you can ask for receipt if the consular forgets.

CO: okay here you go. ( he gave me a receipt )

Me: I said thank you and he said welcome.

He didn't ask for any other evidences that I took with me.

At last he give me bluish kinda paper where it marked to sections

    1. Section 221 (g) which prohibits the issuance of visa to anyone whose application doesn't comply with the provisions of the immigration and nationality act or regulations issued pursuant thereto. The following remarks apply to your case:*

Before a visa can be issued, your case requires additional administration processing, we will notify you when the review is complete, as it may take several months to complete. Its your responsibility to keep the embassy updated pf any address or phone number changes for you. And contact every three months to ensure your case is moving forward.

    2. section 212(a)(4) which prohibits the issuance visa to anyone likely to become a public charge

The overall experience was not bad and CO was polite and answered all my questions.

PLEASE GUIDE ME GUYS WHAT I CAN DO ABOUT IT?

Knowing your fiancee isn't able to financially support you or financially viable as a sponsor, she should have known this issue would come up. If her mom filed as a Joint Sponsor w/ all supporting documentation, then, the interviewer should not have said K1 doesn't allow it.

So, question is did her mom file as Co-Sponsor (show tax returns, written attestation, bank account statements) to prove she would be financially responsible for you if and when you enter USA?

Hopefully your financee in USA can provide all the supporting documentation and your case should be processed fast..

    Good luck

  12. Congrats to you

Can you please tell what they ask your wife and with you in interview .. Did they ask u marriage documents like pics , nikah forms or just they have seen US marriage certificate.

Thanks if you could tell me

    Thx

Yes, they did ask for marriage document (official marriage certificate), pictures from wedding reception in USA with both families, both myself and wifey.. and i also provided joint bank and investment statements to show

joint accounts, and honeymoon pictures after marriage

  13. Congrats on KI

    1. Once you fiancee arrives in USA, go get a court marriage ASAP.

    2. Take documentation (I-94), marriage certificate to SSN office. Get SSN (2 wks for arrival). When asked do a name change at this time, and make sure you have your last name documented on SSN. This will

serve the main document for further name changes.

    3. File for AOS. See instructions on this forum. Very easy to complete.

    4. Start documenting your wife and your communal assets (bank account, real estate, etc) for AOS interview.

    5. You will receive AOS reply for USCIS. Get biometics done. and wait

    6. You will receive AOS interview date.

    7. Get Green Card for wife.

  14. Why is there more pictures needed at the interview. I understand one may be needed for the visa. Does spouse maintain her country passport or will also the United States issue a blue passport

To validate the marriage is real and not a sham.. To USCIS, they need to make sure people are legit in their intentions, and having proof like pictures is one very good example, along with joint bank, credit card, and other forms of joint proof.
