I will say this. Yes, there is some pretty unique situations where you will need a lawyer by your side. Having said that, I think people don't have to spend a fortune on lawyers. There are several very good fee based lawyers online where they answer your questions immediately.
Before I started my K1 journey, I contacted a lawyer online used the service, got my answers, and did the rest. Cost was like 100 bucks. But it was assuring to know i was going on the right path. Then, happened to find this site, which, in m opinion is amazingly helpful. Example Forms, Timelines, and fellow VJ'ers, probably more valuable than a lawyer.
If your case is simple, and cleancut, you can file yourself.
If your case involves, an RFE or complications which are delaying your case, definitely seek professional advice.

Not to mention possible influx of hostile immigrants who will gladly get their green card for 500 000$. Man.. sometimes I'm so pissed that I didn't have the opportunity to experience post WW2 USA in it's hay day when it stood tall and proud, ideas like this would be ridiculed away and not proposed from actual senators
sorry buddy, if you read the conditions for the visa, it's very strict and USCIS will do the same or even stricter background search on potential immigrants before a housing visa is granted. So, the 'hostile' immigrants are likely not eligible financially or will be screened out. Most likely rich Chinese, Indian, European, and Latin investors seeking to buy properties in the USA will apply.

I called the NVC today and they said that they received my case but is not in their system yet, that it may take 3 to 4 weeks to be processed.
Is 4 weeks their realistic time frame in to process or is just their script answer?
( this one is an obvious one but just in case) So I get the visa # when they finally process everything and is sent right?

Congrats, good thing is NVC has your NOA #2 in their system. Should not take 4 wks from my personal experience. My case got assigned a case number relatively very fast.
The number is a three letter prefix (City of Embassy- number) i.e. ISL - XXXXXXXXX . they can provide this number to you over the phone, once they have it processed. It takes them 2 to 4 days to send the paperwork to the appropriate embassy via DHL. If are signed for automatic notifications when applied for i-129F, then, NVC will send you an update to inform you, case number assigned, and papers off to Embassy. From that point, the US embassy and beneficiary are in contact to complete the k1 process.

Are you the petitioner or the beneficiary? The US Citizen (petitioner) located in the United States can call and get email notifications from USCIS regarding K1 statuses.

First of all, that really sucks to hear. Talk about bad luck. Yes you need the original NOA 2 document. Utmost importance to have on file.
I would advise the petitioner to file a Police Report. This way a proper acknowledgement of theft is recorded by the police for recordkeeping.
State to the cops what was stolen, contents.
Once you have the Police Report, contact USCIS and explain them the situation. If they require the Police Report you will have it.
Hopefully you guys can get a new NOA1 and NOA2 very soon. It's already in the system, just a matter of printing new copies and sending them to you

Documents just arrived PK Embassy today. My fiance should be getting her papers from embassy by end of next week. Frankly I have been very happy w/ VSC and their response time to my questions
Do this.. send a scanned copy of your NOA2 to the following address:
NVCResearch@state.gov
provide Beneficiary Name / DOB
Your Name / DOB
Ask them to investigate where in NOA 2 approval in the system
Will get an answer to you.

Yes we are an inter-racial couple and we know that we are going to need to submit a lot more evidence because of that as well as India is more strict about the visas as well.
We actually opted not to have an engagement ceremony when I was in India as we did not want there to be any question or doubt that it was too extravagant and think that we got married. We just did a very small engagement party once we got back to the US.
I'm feeling pretty organized because I've been saving so much stuff but I definitely want to make sure everything is aligned to try to make this as smooth as possible (which will still be bumpy, I'm sure... ;-)

I made that mistake also. When i realized the proper consulate was in another city, I called the USCIS number, spoke to a live person, explained to them what happened. The proper course of action is to mail a letter to the CHANGE of ADDRESS -- address provided on the 1-129F form. Explain to them the mixup in writing.
I received a letter in the mail -- NOA 1 update to inform me, the correct city was now on the file for the application.
Total time - 3 days

Call them, speak to a live person.. They can instantly tell you when your NOA 2 reached NVC and what the case # is. Their email automated system is running a week behind to notify petitioners.

My fiancee had an interview today at the US Embassy in Cairo visa denied due to our age difference....Did anybody have the same problems because of age difference they have to deny his visa? They told him to marry a woman in Egypt. Why do they have to question him like this. This is not the interviewer business to ask him just because of our age difference. What is the next step I could do if his visa is denied? He answered everything right, paperwork is all correct but WHY the interviewer do this to him.
Sorry, but, the embassy has to side of caution, as there are many many sham marriages which take place. I would also advise getting married in Egypt, as it would legitimize your marriage and provide a better case for spousal visa.
If you don't want to go that path,maybe hire a lawyer in the US, and seek some advice.
None of us are experts here, just trying to provide some reasonable alternatives.

Having a K1 visa issued means you will be fine in transit as long as your end point destination in your trip concludes in the USA.
Most flights out of Asia have a stop over somewhere, so, I am sure others have gone through this and shouldn't be a problem.

Not to be picky and have nothing against foreigners (I was/am one once), but your #2 seems to be saying that foreigners applying on a H1-B are given more priority than a USC??
Is the government so blantantly stating (with those priorities) that money trumps their own citizen population?
Since when money is more important than a future spouse and a person?
I guess the protesters at Wall Street are right after all (because the main beneficiary of H1-Bs are the companies sponsoring those persons)
Sadly, I believe the comment about higher revenue generating cases .. It's not right, but, H1-B are money makers for the govt. and possibly get faster processing. The government is losing money and if that means generating income by putting a class of visa ahead of others, this may happen.
However, I happen to think each and every case is unique and we have dozens if not hundreds of cases on this forum where the K1 total time took less than 7 months, which is quite good in my opinion.

In some countries, the burden of proof becomes more of an issue for interracial couples, thus, I would put forth as much evidence as i could to leave no question in the examiner's mind about the relationship.
-Pictures of you too. Include family members if engagement took place. VERY IMPORTANT to show family members in pictures, clearly demonstrates family involved.. good thing for reviewers.
-Plane ticket stubs
-Passport stamps from entry/departure points
-Hotel receipts
-Engagement ring receipts
-Phone records (skype logs, calling card logs, etc..)
If you such information detailed, your chances are much higher for approval. All the best

K-3 is more expensive and takes longer. It is closed at the NVC.

i mean she gonna stay with me in algeria only 8 days and she will go back to usa , because her work didn't allow her to stay more did those days enough to get married and gone to the embassy ??

If she's an American, and you will be marrying her in Algeria, she is NOT allowed to file K1 visa on your behalf.
She must file K3 visa -- non-immigrant visa is for the foreign-citizen spouse of a United States
Tell her to start reading up on the rules, forms, which can be found on this site or the state department website.

Am I not sure why this is so confusing for you..
Proof of engagement and proof of evidence of support is required by the EMBASSY as part of the DS-156K Form. When a form says, please attach to this form, you should attach supporting documents. If you don't attach what they asking you.. You will delay your interview.
Also, make sure you have the original supporting documents with you for your interview. They may ask for it. May not. But be prepared.

here's what happened:
my friends'brother's visa was approved last week by the US embassy in manila(phils).
now they got a call fromt hem yesterday asking her brother to go back there & submit the affidavit of support papers, paystubs & tax documents which i believe they FORGOT to collect. they kindof revoked the visa & told her brother that his petitioner shouls get a job for at least 3 mos before they can process his visa.
but WHY? that's why they have a CO-SPONSOR right?
anyone pls enlighten us.......let's help them fellow VJ'ers
If the co sponsor don't have steady and stable track record of income.. The US Embassy may want job history more than 3 months for each co sponsor. If it's less than 3 months, may be the issue.. not sure. Such decisions are independent of each embassy and how they view financial support requirements.

thanks all for your replies what ever documents my fiancee sent to USCIS including tax papers and Affidavit of support and all the documents i have all the copies with me here in Pakistan i made all the copies to be on the safe side now my question is Proof of engagement and proof of evidence of support needs too be submitted with packet 3.5 and send back to embassy or i have to take these documents on the day of interview please clarify me this cos i have to send all DS forms including police certificate and birth certificate copies please help

Hello everyone my name is Poonwattie, I am finacee of Mohsin, In his D-156 form they are asking for eveidence of engagement,
now i knw that would be engagement pictures etc, and also they are asking for eveidence of support, now I am the petitioner
and i cant give evidence of support, because from my understanding, they want to knw how he is supporting himself now, not when
he comes to USA, cuz if thats the case then they would ask for affidavit of support, which was provided to usics already, now
they cant expect me to support him in Pakistan at this moment, so how can I give evidence of support??However i will contact
my lawyer tomz.But ur imput will b highly appriciated.Thanx for ur time.
There is a DS-156K Form which must be filled out the BENEFICIARY. The supporting documents requirements are :
- Evidence of Engagement: you should have tons of pictures, emails, chats attached.. This is considering on-going relationship.. after the submission of i-129F application.
- Evidence of Financial Support: This means you the petitioner will need to provide i-134 form and supported documents as attachment to this form..
- Police Certificate:
- Divorce Decree (if any)
- Birth Certificate
You as the USC should have complied a list of supporting documents and signed i-134 form, and mailed them to your beneficiary in PK.

The sponsor should have send the i-134 form filled out properly, signed and supporting documentation to the beneficiary. This is a REQUIREMENT and without this, K1 will not be issued.

If it's a difference of say 10 yrs .. I don't think it should be an issue.
However, if you are like 50yrs and she's 25yrs.. That's pretty much gonna raise red flags, guaranteed.
