    Morocco is a very hard embassy to get a tourist visa from as it is a high visa fraud country. Her best bet is strong ties to the country through real estate, bank accounts with sizeable balance, acceptance letters to a good university in Morocco, perhaps marriage invitations for her. Most females in Morocco don't meet these requirements unless they are from an affluent family. I can tell you the immigration officer would be very curios as to why an engaged woman is traveling across the world to visit another man. If she can get passed all this their is still no guarantee. Having gone through Casa with my husband I saw first hand people leaving the consulate in tears. It is a long shot but if she thinks she can swing it then it is up to her.

    It is odd to me that this happened and anyone can question if they can file a complaint. First find out what procedures that company follows, example I am in a job where Human Resources publishes the openings but the department does the interviewing process along with selectons. So find out if the person you spoke to was actually from HR or just a department representative in charge of doing the interview. I am in the process of hiring 70 employees, and we are prohibited from asking a person's age or legal status. What we do tell them is you are required to be at least 18 years old, be able to legally work in the US (we verify by SSN and state license because they only issue those documents after verification of legal status) but we can not ask because of Equal Opportunity. Once selected for employment then the HR personnel verify their age, legal status, etc... If it is listed on the application then we can ask so we ask about their education, experience, ask situation questions to guage their qualification and experience but we cannot in any shape or form base our questions on age, sex, marital or legal status. If the applicant opens any question based on those things then we can inquire or if they listed a reason for leaving on the application and it pertains to lets say they left the job to take care of their children. We can inquire what they have done to fix that situation so if they are selected for employment we don't run into the same problem.
    Food for thought, in the future you can be just as patient but refuse to answer their questions. My first question would be what exactly does that have to do with the requirements for this job? It is not that serious there are plenty of jobs, in due time we all find the right one.

    The address is used not just to forward mail but to do physical checks if the applicant is placed on AP. I recommend you read the K-1 application instructions to see what is acceptable. Never met anyone that applied with a PO Box but call USCIS and ask. Also, it is up to you to explain anything that may generate an RFE or worse cause the petition to be returned or rejected. I explained everything that could be questioned in the cover letter and numbered all the attachments plus I referenced each enclosure in the cover letter.
    What address is on his ID it has to match where the packet is going otherwise he will not get the notifications. I have travelled to Morocco 5 times and have yet to see small towns or villages not have a cyber cafe, western union or a post office and mail in Morocco is slow as molasses. They may also drop off a notice at any rural area and he must go to the designated post office to get the mail piece. In our case my husband was told to report to Rabat with his ID.
    Lastly, I got notified about the entire process via email not courier mail.

    Great pics by the way, make sure he has copies of pics of your family's visit to Morocco or UK not sure where they were taken but either way have them available. You have made alot of trips and it has also included your family which is always a plus but with Casa it can always be tricky. Just make sure he has all the proof of those trips. Ensure you documented your time with him over the summer. I always say you can never be too prepared for Casa, he needs to know your childhood, your boyfriends, your jobs, your school history, bestfriends, your children (if applicable) any and everything you can imagine to include financial standings. Your goals, habits, hobbies, lol I have to laugh everytime I tell the story of drilling my husband like he was going to a promotion board in the Army. In our case they asked about my ex-husband, my children and their girlfriend and boyfriend's names and their hobbies.

    Ok I had time to regroup after reading the questions. I suppose the part that will be fraud and a crime is when you sign the visa application based on a bonafide marriage and have intent to arrive and get divorced that is visa fraud. You may have had a valid marriage at first now you don't therefore coming here on that pretence is illegal. Noone is trying to give you a hard time, just informing you to give you a better opportunity to be with the one you love the girlfriend I suppose. If you intent to be with her then you have to first get divorced, then start over prove that you have a valid relationship with the girlfriend. Good luck on that considering you met her while married.
    Just food for thought but the COs do have access to these same forums, if you put it on the internet it is public information.

    National Visa Center will contact you to proceed with the next steps:
    Your husband will be asked to appoint someone in the states to act on his behalf for the paperwork, ideally he appoints you. Once appointed they will ask for payment of AOS, then payment of visa with all supporting documents for him translated to English.
    Once they get all the documents and payment they forward the packet to the consulate and request an interview date. It took about two months for the entire process and another 45 days for the visa interview date in our case for example we received NOA2 on 15 Feb and we got a visa date of 26 May 2011.
    All the paperwork you do with NVC he will be required to have for the interview to include any additional conversations since you frontloaded the application.
    Lastly, they will issue you a letter that he will need the day of his interview.

    My husband was on AP for 65 days, initially they never said approval or denial just that they had to review all the chats and supporting documents. The CO told my husband, "I will call you back in one week or two the latest." He gave him the 221g stating reviewing the application. We called back after 10 days and they said, "he is still reviewing the application but he will call when it is complete." after 14 days I emailed the Embassey and got no response. I finally called DOS after 40 days and was informed we were under AP that went on til the end of Jul when they called him back for a second interview. He was approved and he came home one day after he got the visa.
    I met many people on Vj some with shorter AP and many longer wait time. Some they did not keep the passport others they did. All except one of those I met on AP got approved. Try not to worry, I looked at it this way. My husband has a clean record, is well respected in his cimmunity, we knew we were in a legitimate marriage. We provided proof of mortgage, insurance, joint accounts, joint tax return, visits, lol his cat loves me but beats up on family and friends this really pleased the CO, pics with extended family they all love me and the feeling is mutual. We hated the wait but I did not worry I knew they had to do their job and regardless of their decision they could never change the fact that he is and will continue to be my husband. Even though it would not be ideal we were ready to sacrifice either being apart a bit longer or my family relocating to Morocco. Either way we are and will be husband and wife. Keep positive thoughts it will be over soon.

    I suppose no one really answered your question, what will happen now is they will send her the petitioner a form so you can register as your agent so she can respond to all document requests. I filled out the form they gave me and then sent a digital copy to my husband in Morocco. He printed it, signed it and scanned it and sent it right back digitally. NVC accepted the digital copy from there I dealt directly with NVC on my husbands behalf. Next they requested I submit the affidavit of support and an $88 processing fee, lastly they requested all his documents To include the visa application and the $404 visa fee. At this state my husband had expressed all his documents to me original and translation of his birth certificate, police report, court report, the list of required documents is on the department of state website. We gave them all originals because most documents in Morocco have a 90 day expiration date and depending on the interview date you may have to redo them again if 90 days have transpired. My husband kept the original marriage certificate and he got the physical done there so he added those documents before the interview. Remind her to print and forward to you all documents she submits to NVC. Most importantly the receipts for payment of the AOS and visa and all tax documents she gives NVC. After she meets all document requirements the NVC will forward the packet to the Embassey and forward you an instruction letter with your interview date.

    No the tail light was not broken, they had just purchased the vehicle from a dealership only two days before they pulled him over.
    An update on the case he,was transferred to the county jail, his wife posted bail and he was released today at 5:00 p.m. ICE was there when they posted bail and they handed him over to his attorney with the agreement that his wife secured the attorney's services and all necessary paperwork will be processed through USCIS etc... The attorney will fight to get the only charge he got for SSN fraud dropped because he has had the card all these years and never used it. It was his first offense and has been a law abiding citizen, is married to an American citizen and has a child with special needs.
    They dropped the no license charge since he could not renew it as a result of his expired status. There is a light at the end of the tunnel for them.

    I have been on VJ for several months and I have read over and over again, "I cannot visit my husband/fiance etc. because I do not have reliable child care." It would be nice to see people come together and by city, state, or region make friendship/bonds/relationships that could lend themselves to assisting with taking care of children for short periods of time to allow single mothers opportunities to visit their loved ones.
    I am not by any means saying leave your children with unknown personnel, but can relationships be fostered in your area for personnel in need and anyone who is willing to give there time to assist.
    Example at hand, I met a young man who was a friend of my husband (I met him on all three trips) and his visa was denied because his wife was not able to come see him from the time they married to the time he interviewed. The CO told him why has she not returned to see you? In their case, she made enough money but had no assistance with her three children while she left the area for 8-10 days. They are now going through the entire process again. In that case, it was the summer time and I expressed to my husband I would not mind meeting her and forging a relationship and assisting them but it was just heartbreaking that she had no family support.

    You are now considered residents of the state of Texas. Your husband filed a Department of Defense Form 2058 changing his legal residence to Texas. You are not suppose to do that simply to avoid taxes, however; it is common practice among service members. Effectively, the form is used to tell the government what state he plans to return to after retirement. This does not change his "home of record" he has to change that when he is due to reenlist otherwise he is only entitled to ship his household goods to CA upon retirement.

    The I131 does not guarantee reentry, the 180 day or short trips can be problematic if the IO perceives the person has no intent to make the US their resident. In his case he is talking about a 2 year absence anything over 180 is what raises eyebrows at reentry. It is not about being right or wrong, I am trying to provide him with an accurate answer thus the post.

    USCIS website to avoid, misinterpretation:
    Does travel outside the United States affect my permanent resident status?
    Permanent residents are free to travel outside the United States, and temporary or brief travel usually does not affect your permanent resident status. If it is determined, however, that you did not intend to make the United States your permanent home, you will be found to have abandoned your permanent resident status. A general guide used is whether you have been absent from the United States for more than a year. Abandonment may be found to occur in trips of less than a year where it is believed you did not intend to make the United States your permanent residence. While brief trips abroad generally are not problematic, the officer may consider criteria such as whether your intention was to visit abroad only temporarily, whether you maintained U.S. family and community ties, maintained U.S employment, filed U.S. income taxes as a resident, or otherwise established your intention to return to the United States as your permanent home. Other factors that may be considered include whether you maintained a U.S. mailing address, kept U.S. bank accounts and a valid U.S. driver’s license, own property or run a business in the United States, or any other evidence that supports the temporary nature of your absence.
    What if my trip abroad will last longer than 1 year?
    If you plan on being absent from the United States for longer than a year, it is advisable to first apply for a reentry permit on Form I-131. Obtaining a reentry permit prior to leaving the United States allows a permanent or conditional permanent resident to apply for admission into the United States during the permit’s validity without the need to obtain a returning resident visa from a U.S. Embassy or Consulate abroad. Please note that it does not guarantee entry into the United States upon your return as you must first be determined to be admissible; however, it will assist you in establishing your intention to permanently reside in the United States.     If you remain outside of the United States for more than 2 years, any reentry permit granted before your departure from the United States will have expired.     My intent is not to pass judgement actually just stating what will be obvious to the IO officer. The unfortunate events in her marriage does not change the fact that she choose to date and live with another man while married. This is why the recommendation of getting an attorney was given. Her situation was bad I get that, she is making it worse for both of you with her current living conditions.
    She needs to get a divorce, then work on your relationship doing both at the same time only raises red flags of visa fraud.
    Good luck but I would say untangle the situation first them focus on your relationship you cannot do one without clearing up the first.

    I had to provide a police report on the applicant but not on the petitioner. The USCIS I am sure will find this out during their processing of a K1 or Cr1. Either way be ready to explain the situation and get a copy of court papers. What you don't want to do is wait for them to mention it or wait to see if it is a problem and then appear to be hiding the facts. Be honest if the form does not require it then don't address it but be ready to answer questions about it and provide proof if requested. Putting your head underground will not make the facts go away.

    This is the information I had given Jaime&Khalid if they got approved today then it helped.
    I was reading through the IRS website and found the following link that covers Social Security Income, it maybe helpful in your case:
    http://www.irs.gov/p...s-pdf/i1040.pdf pg 8 has a chart that stipulates who has to file tax returns this along with the sponsor's 1099 form from SSA and a copy of the Retiree Account Statement should be enough to prove the sponsor is exempt from filing taxes. Now you will have to get your fiance to be able to understand all this and how it relates to his visa request. He will be the only one talking to the CO or you could send the embassy a detailed email with the chart and and supporting documents.

    Key note to remember if between his retirement and social security the sponsor makes more than $25,000 he or she will still be required to file taxes unless it is SSI in which case those monies are tax free.
