Mark + Melissa reacted to Harpa Timsah in Citizenship Denied
Good, I am glad they discovered his lie. Depending on the details, his whole immigration file was based on fraud (he lied and said he was not married when he was), and they can revoke his Greencard and deport him.
Without the details, no one can help you. No on is going to help cover up fraud, however.
He either was not eligible for his family category by being married (maybe he came in under an unmarried child category), or he used this lie for some other reason.

Mark + Melissa reacted to ca_babe in is he lying or is the USCIS messed up?
This is the person that you are going to marry. You should be able to ask him if he really submitted it or not.

OK...I don't care if I get thread banned. Cases like this are the reason immigration is so difficult for people with BONAFIDE marriages and relationships to get through this broken system of ours. I will be the one to pass judgement. You just withdrew a petition for K1, now you're in "love" with a woman who has barely been married on a k1 to a different man and you want advice from those of us who would do anything to have our SO with us??? Those of us who have done everything legally, who love and miss our SO. Who have been separated for months, some couples for years. Couples like my husband and I, who did everything by the book, went through the entire process start to finish only to be told that we are in the black hole of administrative processing, we have to wait until the process is done. It has already been 2 months since we have been put in AP, and it could be months and months more before his visa is issued, we just don't know. We have spent thousands upon thousands of dollars on travel expenses for me to go to see him every 3 or 4 months just so we can spend a few weeks together as a married couple in the same country, countless hours on skype and msn, phone and texting. the list goes on and on. I wouldn't trade one minute of it, because my husband and I know in the end we WILL be reunited, that we have a real and true marriage and we love each other, and that all of the stress and pain and worry of being apart will have been worth it. Your whole story is a hot mess and exactly the reason it is so difficult for the rest of us. I said what a lot of people here are thinking. Sorry for the rant people, I am just so tired of reading these stories, I really really am.

Prepare yourself for a long, long but LONG battle with Immigration, add to this lots of money to spend with lawyers. Are you ready to spend time, effort and money with someone that just a few months ago was in LOVE with other guy and suddenly had a change of heart?.

She can only get a green card through her husband who filed the K-1 for her.
It would be fraud for her to get a green card at this point as she no longer has a bona fide marriage.
She needs to get a divorce.
She needs to return home.
You need to file for a K-1 fiancée visa.
There is no way for her to become legal by staying and marrying you. She can only become legal through her K-1 petitioner husband.

Mark + Melissa reacted to Harpa Timsah in just found out that AOS got denied..
Look...
1. Any of the reasons listed above would result first in a RFE. Failure to properly respond to a RFE is a common reason for denial. But, the OP said they got no RFEs. So, that is not the reason.
2. Bad fingerprints do not lead to denial. If, after the second round, they still do not have good prints, they would send out a RFE for a police cert from the US. That did not happen, so that is not the reason.
The OP has not yet had an interview, so anything about bona fide marriage is not even yet in play. Any denial at this point would be procedural. Or, the OP is a criminal or has been banned from the US prior, or is already married or something in the background check does not fit (pretty rare chance since the OP obtained a K01 visa, and these problems should be vetted before). A procedural problem is more likely.
The OP has stated that they filed, and got 2 biometrics appointments, and nothing else happened. There is no way to know what the problem is. Mail problems are a good guess, but the OP refuses to wait on hold to speak to someone to get some information.

Mark + Melissa reacted to elmcitymaven in Ideas to Improve VJ? Outside of the forums :).
Steven, I don't add much (or ask for much) in the upper immigration forums at the moment. I do help out in other areas, particularly in the UK forum on burning issues like where to locate PG Tips and tinned custard, and how to make a decent Yorkshire pudding using American ingredients. However, later this year I will be asking questions about naturalization, as my ex has hit the 5-year PR mark and has asked me to go back on VJ to ask advice. Do I have nothing to add? If you didn't know I would be back in the upper forums later this year would you suggest I be banned?
I think the line from admin has been that no one has the right to tell another member to get off the site because they're done with immigration. I have been on the receiving end of that comment more than a few times, as have others. However, there are plenty of members on here who are done, but continue to post and no one takes issue with them remaining on here. Ultimately, it gets down to personalities. If you're one of the tall poppies, you're going to get people who want to mow you down. If you're just the grass, well, no one seems to notice.

Oh, now I understand.
The OP does not want advice or suggestions on how, if possible, to fix the relationship.
She wants confirmation and approval to show disrespect to her SO, as he has done to her.

Mark + Melissa got a reaction from Harpa Timsah in Abusive relationship
Rephrasing that a bit for clarification: Yes - you have to be married to your wife, and proving a relationship for AOS. Doesn't sound like you have what you need to prove a relationship, and if you don't prove relationship, you cannot stay. If you do not have the money to file for AOS, you will have problems as your status will expire, and you will then be illegal. If you do not stay with her, you cannot adjust status no matter who pays for it, and again, you will be here illegally.
As to your other points:
1) You are not in prison - walk out the door to a shelter, embassy, police office, social agency, fire station, grocery store, gas station.. anywhere.. and ask for assistance
2) Discrimination does happen - but I strongly doubt that everyone you meet is discriminating against you as people in the south are generally very friendly - haven't you heard of southern hospitality?
You need to think about what you're going to do next. If I were a case officer, based upon what you've revealed here, I would assume you thought you had an easy in to the states with this woman as easy prey, now you are not pleased with her lack of funds, which would lead me to think visa fraud. Add to the pot that you have 'friends' willing to do a VaWA and help you get adjusted, and you just want to stay . Sounds very much like you've been getting coached, but its not working quite as you wanted. If this is NOT the case, then you need to man up, and deal with the situation. Either work it out with her, or return, but quit stating you are in prison. <br class="Apple-interchange-newline">

Mark + Melissa reacted to Caryh in She wants to go back Home (Philippines)
She's been here a bit over a year and she's having this reaction. Make's me wonder what her underlying reasons for feeling this way are. Homesickness, no work, not fitting in, feeling like a nanny and not a wife, she is responsible for the home and kids but not in control of the kids, etc... Could be lots of reasons this is coming up, I'd assume you've seen the warning signs before now. I'm guessing this lashing out and demanding is because she does not feel she has a life here. Its not her kids and a big fear she'll not have her own children. No work, so she has no pride in what she can bring home economically, something that bothered my wife a lot, your wife may fear she'll never have work here. Even now that's she's working, she fears her work isn't stable and she may be out of a job again. Fear is a big driver that can bring out this type of reaction and make her want to change everything or run away back home.
I'll assume, there I got again assuming but you haven't given us a lot to work with, that you love your wife and want to build your life with her. Start trying to find out what her fears are. Try to reassure her about them and help her to find the solution to them. Try to find out what she's really missing in life here, its not easy to build a life in America, and it could be she feels she's getting swallowed up by someone else's life. I know some women are not the best at explaining where their fears are coming from, they just react and lash out when they feel them. But if you work at it, you can find most of them. I have to deal with my wife's fears to, she'll say things she doesn't really mean also. Not really the best way to deal with it, but hey some people react that way. She's learning better ways as we work on her fears and the things that brings up her homesickness bouts. Your wife might say she wants to return home, she may say to send the kids to their mother so you two can start your own family, but I think they are only surface reactions to things going on underneath that you'll need to find and work on.
Good luck, I hope you and your wife can find what's truly bothering her, find solutions and keep your marriage and love alive.

I guess I shouldn't hold my breath for even one (1) of the folks to come back and apologize to the OP for the unwarranted, mean spirited character attacks. When all she wanted was patience, understanding, information and guidance.
It's refreshing to know that things are better for you and moving in the right direction, keep your head up. Military justice is different from civilian justice in that, some of his behavior was no big deal in the civilian world, but the military's view of his behavior will be less than admirable. His command will not be very amused once they read any reports and statements regarding your treatment over the last 2 years.
A CO or XO worthy of the brass emblems worn on his/her collar would not tolerate a wife and child being mistreated and abused. That service member is paid an allowance (BAQ & COLA) to care for his family, there's no excuse for not having food in the house, period.
For the VJ member that doesn't feel any UCMJ violations took place, try Articles; 107, 132 and 134, section 2, just for starters.

You're saying for that for 5 years he illegally worked, and knew it was illegal, and received no pay so now he's "hiding" from this family he was supposed to marry into because he had NO friends, no family, and no knowledge of laws? He was illegal for more than 5 years, and didn't know what to do?
I'm sorry but I don't believe it. Immigration has been such a hot topic these last several years there is NO WAY he didn't know what to do. In order to survive as an illegal in this country, you HAVE to have friends who help you hide, get false documents etc. How did he EAT for 5 years if he received no money, and was in hiding? How did he get clothes? LIVE somewhere? He KNEW he was illegal, and he made no attempt to return home. All he had to do was walk to the nearest police station, and he would have been deported back to his home country, to the loving arms of his family at no expense to himself, while getting free room and board waiting for the proceedings to complete.
