I have been informed from the USCIS that my wife will have a biometric appointment soon and I was wondering if it necessary to change the name in her passport. As of today, her passport shows her last name while her AOS, employment authorization, and travel documents show her married last name. Does anyone know if this going to be an issue?

    Thanks!

It's not required.  My wife can't renew her passport until it's comes close to expiring.

I'm living here in PH with my Filipina fiancé. We submitted our initial K1 docs on March 27 2021. There's lots of talk, and I've seen the stats, shows CR1 visa interviews moving along much faster than the K1's.

Can anybody give advise on this?

A few other potential benefits of marriage now are easier tourist/digital nomad style visa's to other countries in the world. If this Delta thing doesn't get over the top crazy everywhere, we could at least do some traveling while waiting to enter the USA together later on.

I realize there are a few other question on this forum similar to my questions, however, usually the couple is not living together or able to marry in-person which really changes the dynamic of the question.

    Thanks in advance.

It really all depends on each couple's situation.  Realistically, CR1 are moving faster than K1 at this moment, so if it's something you thi k will benefit you, then go for it!  Plus, it's more beneficial.

We got an RFE for the 2 year meeting requirement. As it's our only chance, I want to make sure we do this right. Bit of context, my fiance (petitioner) and I met in a third country. Spain. I soon moved into his apartment but we don't have a rental agreement with both our names on it. I do have a census document with the same address along with a residential card, however they rejected it as the lease was signed by him before the qualifying period. We didn't require visas for the places we travelled to, therefore we don't have any passport stamps to show, and didn't think of keeping the airline tickets/boarding passes. What we have are :

One previous airline receipt with both our names on it

    Social media pictures with dates

Airbnb booking history ( but I have to manually add the guest's name so not sure how valid this is )

iCloud pictures showing the place and date

I am kicking myself thinking we should have recorded something more while we were together, but we left due to Covid in a messy state and living together made us believe that we had enough.

Do we send all this and hope for the best?

Airline tickets, passport stamps, hotel receipts, all strong sources of evidence.

    Hello,

Not 100% sure if this is the correct section to post this question on or not. I am petitioning for my wife for a CR1 visa for marriage based greencard. I filled out the timeline and VJ is giving me an estinated approval date of )ctober 2021.

Our PD is only April 14th of 2021 so this seems very inaccurate considering that our processing center is Potomac which is a minimum 13.5 to 17.5 month estimate on USCIS website. Is this something that anyone else is experiencing? Are cases processing that much more quickly for recent petitioners even though the USCIS website is saying much longer? Attached is a screenshot

It really all depends on each individual case.  This all depends on the I puts from everyone's own timeline, in which case gives you the "estimate"

Got approved for K1 earlier this year, fiance entered and we're now married. I'm just about ready to submit the whole AOS packet for her (485, 131, 765, 864) but I haven't been able to find an adequate answer to this question. If she's allowed to be in the US for 90 days, what has to change to allow her to stay? Will they process her work authorization that quick and will that give her the authority to stay? Or do I need to file something else?

Sorry if this is confusing, seems like a donut hole you don't want to get caught in.

Your spouse will be considered "out of status" regardless, but once you do file the AOS, consider it the "safe zone" as long as they dont get into serious trouble, like arrest or anything. Just have to wait for a final answer once AOS has been submitted and approved.

And man, someone needs to post a content warning before Angela and Michael sexy times. Some of us may have just eaten our dinner

I couldn't believe they spent an entire moment filming Michael about never masturbating before.  I was thinking "is it really that important?!"

I received my K1 and I am now preparing to move and get married.

We are looking at the AOS process...specifically the I-864.

The USC filed his 2020 taxes in April but still has not received anything. Therefore, no transcript is available yet.

In this case, all he has is copies of the 1040 (3 pages), form 8888, and his W2s.

Will this be enough to send with I-864 or will we get an RFE? Obviously we cannot submit the transcript since it's not available yet.

Is there anything else that they would need other than what I listed above?

The transcripts from the IRS website only cover the 1040 section, so you will be fine with just either or.

    Hello All,

I finally got my US citizenship and I'm very excited to apply for a K1 visa for my fiancé 😊. I've been reading the guides on this site and they were very helpful, but i still have a few questions. A little background first...

Me and my fiancé  have been in a relationship for 9 years, way back when i was still living in the Philippines. Our family moved to the United States 5 years ago and we've been in a long distance relationship ever since. I was able to visit her back in May 2019, and was planning to come back in 2020 to formally engage to her. Unfortunately the COVID-19 pandemic happened and i wasn't able to meet her in 2020. Also, i left my job around January to continue school, but i have relatives that are willing to sponsor the application since they also want her here as soon as possible. I have more than enough cash to shoulder the costs of the visa application, and i'm expecting to be employed by the end of 2022. Given these, here are some things i need to clarify:

    - Is meeting in person within the past 2 years an ABSOLUTE requirement? It's been more than 2 years since i last visited her although we have plenty of photo evidence and letters proving our relationship way back 2012.

    - Is it necessary to provide proof that you were engaged? (Photo of engagement ring etc.)

    - Should i have a certain amount of money in my bank account to be approved?

If you have other advice let me know too....Any help is greatly appreciated!

    1. Absolutely!  Visit her at least once before filing.

    2. No

    3. No

    4.  Be patience during the waiting period.

I have my interview tomorrow at Nepalese Embassy. I am really nervous, I don't do very good in interviews in general. If anyone has some words of advice or wants to share thejr experience, that will help a lot. Thanks in advance.

Perfectly natural to feel nervous, especially at this stage of the visa process, the one that will seal the deal, but remember, confidence is key!  Go in there, head up, be truthful and you will do fine!

🤣  🤦‍♀️.  I get it, I drove there for a month when I was only visiting! Though I will say at least it's slower in WA than some states, especially when it's still on the "wrong" side of the rode for me (my slow-driving sensibilities cannot handle CA!!)! 😄

O for sure.  I'm originally from CA.  The best way I describe the difference between the two states is, when WA state apped limit is 60, people drive 45.  In CA if it says 60, people drive 85 haha.

Hi everybody am seeking advice for green card. Me and husband got married in Oct 2018 and we applied for the IR1 visa. I got my visa 10th March 2020 when covid hit. So I moved to California 12th of July 2020 and received my greencard date 07/12/20 through 07/12/30 which is 10yrs. I was thinking when you apply you get 2yrs then you apply again before the 90 days anniversary. So should send the paperwork again in April or if the greencard shows 10yrs am good .My friend from same country same amount of time she got a Conditional green card whereas I got a different. So my biggest issue is since I moved here I've been going through lots of emotional abuse as my husband has drinking problem. I had to leave the house and stand on the road couple of times as am scared he might hit me.. i had to go through counseling. We are not compatible at all so we might go for a divorce. What are my rights. Am not working I go to  school and I have no savings. I can't pay a lawyer. Will i lose my green card status?

Thank you for helping me out

Sorry that you're going through this.  I will admit my wife and I are on the rocks now because of the same situation.  Trying to make it through though.  Anyways, I hope everything works out for you!

    Good morning everyone,

Just had a quick question finally got our interview notice after waiting 1 year. Had a following question

"A complete copy of your adjustment of status application package. In addition to Form I-485, have available any other forms (e.g. I-130, I-130A, I-864, I-131, I-765) you may have submitted."

When we submitted our form i-485,  We filled it out and sent the original I cannot find the copies of the form, but I do have the other supporting documents since we did not send originals. Do i just fill a new form I-485 for the interview?

    Thanks for the help

They will have the application already at the interview, so it's not required.

    Hi,

My case is at NVC. I found out my fiancé cheated on me and used for money and K1 visa? How can I cancel our case ? Can I file a legal suit against him in Dominican Republic ?

    thanks

Sorry to hear about this, but contact both the consulate and NVC and tell them you'd like to withdraw your application.

My son arrived in the country almost a month ago with an immigrant visa and am a us citizen. My son has been enrolled in one of the Elemantary schools in my city. My question is can I apply a US passport for him with his immigrant visa since I don’t know when the actual green card will be in the mail ?

Unfortunately, only U.S. citizens can get a U.S. passport.

    Hi there,

Since the COVID stuff they emailed my medical results to the consulate directly, but gave me an unsealed envelope with my vaccination record and xray CD, is that okay?

Also should I bring the envelope with me to the consulate for the interview?

    Thank you.

That's normal.  Do bring to interview.

I've received an RFE for my I-485 requesting for birth certificate, which I did send along with the translated version by a certified translator.

However, I am wondering if there is an expiry date on the translated copy? I have attained the translated version in Nov 2019 when I needed it for my K1 visa.

Is that why they requested for my birth certificate again?

Even for a translated version, there isn't a validity date
