My wife is filling it out the N-400. She is applying under the "3 Year Rule" based on her marriage to me (U.S. citizen), and is applying within the the 90 days before 3 years since she became a Permanent Resident (beginning of August will be the actual 3 year point). For Part 1, Question 1, should she select B. Have been a lawful Permanent Resident of the United States for the last three years, or should she write into Other and explain that she is within the allowed 90 day window of the 3 years since she became a Permanent Resident (90-Day Early Filing Provision (INA 334) I think is what it's technically called)? My assumption is that B is still acceptable and that they won't have trouble with that, but I could see a small argument that Other might technically be more correct. I imagine the Immigration Officer would sort it out anyway and it wouldn't be an issue, but I'm curious if others felt differently.

Hello! I'm working on the DS-260 for my father-in-law's IR-5 and was wondering about the "ever been arrested" question. He was never arrested in his home country (Vietnam) and his police record came back completely clear. However, several (~3) years ago, while fishing (his former job; he's retired now) he and the whole crew were arrested by Malaysian police and ended up spending about 9 months in jail in Malaysia. The charge was either fishing in Malaysian waters with an expired permit or no permit at all - can't remember exactly (regardless, they always fished exactly where the owner told them to). They were eventually all released when the owner of the fishing boat paid a certain amount of money - a fine, I suppose. I'm not sure exactly how it was all worded, or if there was ever a conviction per se as opposed to just being detained that long, but anyway he got out and went home and retired. I'm assuming I should put all of this, in as much detail as possible? My wife thinks maybe we don't need to since it wasn't in Vietnam, and he probably wouldn't be able to get any kind of records from Malaysia if he needed to. Thoughts? And if fully disclosed, what are the chances a type of arrest/imprisonment like this would hurt his case? Would he be asked to provide some kind of hard(impossible? to obtain records from Malaysia? Thanks for any and all help and advice!

Hello, I received word back from my senator after he contacted NVC and the US Consulate in Frankfurt. I was advised to contact NVC about withdrawing the my petition while the I-130 finishes its final stage of processing at the consulate. Question: How do I contact NVC and request my petition/application be withdrawn?

Hi everyone, I (US citizen) am currently preparing form i-751 for my wife (conditional resident), I am filling out the form for my wife, should I list myself as the preparer and sign part 10 of the form? This would mean I will be signing both part 8 and 10. I'm not sure if I should sign as a preparer since we are filing jointly. If I should sign part 10 of the form, should I also fill be my name in Part 7 (Part 7 is for the petitioner, my wife) item 2 where it says "I have requested services of and consented to, ___My Full Name___ who is not an attorney or accredited representative, preparing this petition for me." Thank you!
