Background:

I (US citizen) applied for husband's I-130/AOS petition in 2018 and interview was scheduled in May 2019. We withdrew the application prior to interview with written notice to USCIS.

Husband and I moved to his home country and re-applied I-130 online with consular processing in May 2020.

I am in husband's home country on a spouse visa and unable to work, therefore I have been unemployed for over 1 year. I filed 2019 tax returns with half year employment and every year prior. My husband and I have sufficient funds in savings/ CD's to meet the requirement.

Questions:

1. When do we explain the reason for I-130 application withdrawal. Should it be during the interview or should we write an explanation and attach it to our online application?

2. With USC petitioner being unemployed, will it be necessary to obtain a joint sponsor, or can savings/ CD funds from husband and wife be used to prove financials?

3. Which I-864 form would we submit with our situation? We were thinking EZ, but wanted to ask.

If anyone has gone through a similar situation of I-130 withdrawal and reapplication, we would love to hear your story.

Sister-in-law lost all NOAs - how bad is that?

Hello - we used my husband's sister's address as our mailing address on all our AOS forms (my husband is in the military and we knew we'd be moving to a new state soon after filing and I didn't want things getting lost!). My sister-in-law received the papers back in September but did not forward them on to us. After we moved into our new home I updated USCIS (both mailing and physical address) and asked my sister-in-law to forward the NOAs to us. She just told me that she lost them and can't find them anywhere. I have photos of the NOAs that she sent weeks ago when the NOAs first arrived in the post, but I'm not going to have the physical notices.

Here are my questions....

- How bad is it that I will only have copies of my NOAs, rather than physical notices?

- Are you required to take physical NOA notices to biometrics and I-485 interview?

I will try and call USCIS to see if they can be re-sent, but I know that it is proving difficult to get through to a live representative at the moment!

Hi All! We submitted our K1 packet and delivery was confirmed via FedEx on 10/30. I included the G-1145 form as well for electronic notifications, but I haven't received any notifications yet. I know things are very slow these days; however, pre-COVID timelines were averaging 7 days until first NOA1 per this website, so I'm trying to gage at what point I should start asking questions.

Should I be worried? How do I follow up? Any one else having the same experience with recent submissions?

GC Interview scheduled in older Field Office despite address change confirmation

My Marriage based AoS interview has been scheduled, but I moved to a different state almost 5 months ago. I had submitted paperwork from both my side and my USC sponsor wife's side to USCIS about our address change.

We even got a confirmation from USCIS that they had changed the address and then I also called them to confirm and they said they had the newest address on file.

However, when the interview letter came in, it has the older FO listed there.

I'm just concerned that their systems - as usual - might mess up something when we go there for the interview. Would the interviewing officer say that we are not supposed to interview at that office and that we now have a newer FO?

Does it matter where the interview is even conducted after change of address?
