US Immigration from United Kingdom

Myself & my wife (who is American) are about to submit our I-130 application. We've been married for almost 2 years now and when she filed for her taxes after our marriage she still put that she was "single" because her finical advisor advised her too as I don't live in the United States yet.

After reviewing many forums online it states on some of them that it would look "suspicious" if we're married but she still filed her taxes as "single". We have spoke to the her financial advisor and they told us that it's possible for us to change it but we're not sure if that would look even more "suspicious" if we change the status right before submitting our I-130 application. Therefore, what would people advise to do? Would it be better to just leave how it is or should we change it and submit the application. Bearing in mind we're trying to get this application submitted before Trump goes into presidency as we've heard he's going to be changing the application process.

For everyones reference below is what the finical advisor stated in the email when we asked about changing the status from "single" to "married".

"On the tax side, we can amend the return to show you as Married Filing Jointly (MFJ) or Married Filing Separately (MFS). You are allowed to MFJ with your non-resident spouse, but they will need an SSN or an ITIN. You can get an ITIN through the state of Colorado. If they don t have an SSN or ITIN, we ll have to file as MFS. This might affect your overall tax liability slightly, but at least you ll be in the correct filing type. Let us know if you have any other questions."

My fiancee (US citizen) and I (Australian/EU citizen) are planning to move to the US next year from the UK.

We will be getting married in April. I am applying for a job that will start in June and will give a J1 sponsor visa in medical research (no post-graduate training), and my fiancee is also applying for a job in the US. Our goal is for me to get a greencard that would require us to not have to leave the US.

My question is if by taking the J1 visa, I would be subject to the 212 e rule and have to return to country of origin for 2 years. From my understanding, both of my citizenship countries are above 9K and 15K median GDP per capita requirement and not on the skills page.

I want to know if it is possible to go J1 visa, then do adjustment of status via I-130 and I-485. My only concern is that the J1 is a non-immigrant visa, and given that I would be married to a US citizen prior to applying/entering country, I may run into trouble in the future.

The alternative would be to apply for DCF through the UK.

Please let me know if my thinking is correct.

I have my SSN appointment at our local SSA Office on the 23rd December 2024 as I want to get my SSN before getting married (as that seems to have been the best option recommended rather than get married first and then apply for the SSN), however, I was just wondering whether after applying for the SSN whether I need to physically receive it in order for us to get married? Or would it cause issues if we get married after applying for it but while it is being processed and before being delivered?

As I know that sometimes from some posts on the forum there have been issues with the SSN when applying for it after getting married first.

Apologies but this is something I have only just thought of so any advice or knowledge that anyone has on this would be greatly appreciated. We will more than likely wait until I have physically received the SSN but I just wanted to ask that was all.

Parents got their interview scheduled for Feb 5 next year.

What date is acceptable to do the medical - is that decided upon Knightsbridge? i.e i read 5 days PRIOR to the interview, so can they not have it any earlier than 5 days before the interview?

My wife and myself, wish to visit my wife daughter (Russian) who lives with her American husband in Florida.

I am British and have been a number of times to US on a ESTA.

My wife is Russian Citizen, but living in Scotland in the UK with me for 3 years ( we are on the route to gain Citizenship for her in the UK, it takes 5 years)

I am looking for advice on what kind of VISA to apply for. ( maybe B1, but I am not sure) please can some one advise me
