Good evening:

My mother-in-law will be filing her I 485 shortly on a family based application. She will be adjusting status in the US. I had a question on the EAD. If she babysits our child, and is paid for it, do we need to file an I765? Annualized, it would be less than the IRS requirement to file a tax return.

Anybody have experience with *possible* expired visa? Situation:

Visa approved now - expiration April 2021...i know it's 6 months from now but looking for info

Trying to get her on a flight hopefully before December but people talking about country is going back into lockdown including Public transportation and Flights.

What if Covid shuts everything down passed April?

1. Do we have to start the process over again?

2. is there some special form we have to fill out and go back through the embassy and interview process to get it extended? Is it difficult?

3. does she have to do another medical Exam?

Can't seem to reschedule the Visa Interview

Greetings fellow sufferers. Its been quite some time since I last checked in.

Ok, here we go...

Our package was sent to Kyiv in Jan (2020) and in Feb/Mar received the email that the interview was scheduled for mid July.

PROBLEM: We were In So. Africa visiting our daughter, due to return the end of Apr. THEN they locked us down end of Mar.

So, we had to cancel the interview and told that I had to reschedule online or through the Consulate call center. Call center was useless, she only gave me the email that told me to call in. We finally escaped the end of July and I've been hitting the same wall ever since I got back to Maine.

So, I've been trying to get on the scheduling page only to get a lot of "No appointments are available at this time" then a couple of months ago it changed to a page loading error. Feedback emails have not resolved anything.

Does anyone know (actually know) what's going on in Kyiv?

I can't find anything on the Kyiv Consulate site (ustraveldocs) that says whether they're interviewing at all right now.

I have a situation and I need some help. I want to say that vj has been really helpful and I appreciate that. I hope someone will help me with this. Here is my story. My wife was denied entry to the US at the airport and was removed from the country. She had a tourist visa at that time. Right after that we got married and filed i-130 in march 2020. then we realized she will need i-212 to re enter the country. so we filed i-212 in june 2020. Our i-130 is still at Uscis in Texas. We just received denial notice of i-212. The reason for denial is : "A review of USCIS and U.S. Department of States records show that you don't have a pending visa petition." "You don't qualify for an approval of an I-485 adjustment of status, because you do not have an available visa or petition. Therefore, USCIS denies your form I-212". Correct me if I'm wrong, but it seems to me that we filed i-212 too early? Does USCIS consider pending i-130 as a petition? if so, there is an error on their side. They are giving us option to appeal to AAO or submit a motion to reopen or reconsider. I would like to hear from people what our options are. Should I submit a motion to reconsider and explain that we are still waiting on our i-130 to be approved. I have 33 days to respond, otherwise case will be closed. We have waited over 4 months to hear back and we were given denial. I don't want to submit new I-212 .
