Hello everyone!

My husband and I submitted form I-485 on July 1st and unfortunately we got a RFE for the Affidavit of Support.

The situation is like this:

My husband changed to being a full-time student and we are using a joint sponsor for the whole process. The sponsor is his dad who is self-employed and also meets the 125% of federal poverty guideline.

What documents are necessary in order to have all that is needed to support the Affidavit of Support? Will the fact that the joint sponsor is self employed affect the case?

What is my husband's current status? We've been having issues and received questions when showing my husband's entry/exit I-94 form (when requested) at, for example, the DMV and to Health Insurance Marketplace. They sort of freak out when they see the "admit until" date being past due (Aug 24) and assume he's out-of-status or overstayed.

He entered the US on May 27. We married within the required 90 days. We have filed for AOS. We have confirmation from USCIS via NOA/I-797 for the AOS packet.

So then what technically is his current status as he seems to be "in between" statuses (K1 and AOS) in most situations?

Atlanta Field Office joint I-751/N400 Interview Experience

Hi everyone, just wanted to share my experience at the ATL field office today.

I applied for citizenship in Oct 2020 based on the 3-yr rule. I had a pending I-751 at that time and today's interview was a joint I-751/N400 interview.

My appointment was for 12:55PM. My husband, 2yo son and I arrived there at approx 12:40, went through security (bags, belt and watches go through the scanner), then we went up to the check-in area, presented my interview notices and they took my picture and fingerprints. We were then told to go to the third floor.

We entered a large waiting area where there were approx 30-40 other people. Every once in a while an immigration officer would come out and call someone's name. I waited about 1h20 mins until my name was called.

The IO called my husband and our son in as well, but after a brief chat with him, he asked my husband to leave because he had enough proof that we both had entered the marriage in good faith.

He then asked me for my interview notices and my green card and told me that he was going to start the test portion of the interview. He asked me the following questions:

1. Why did the colonists come to America?

2. What is the highest court in the US?

3. Name one of the authors of the Federalist Papers

4. Name 3 of the original colonies

5. What group of people were sold as slaves in America?

6. What is an amendment?

Once this portion was done, he asked me to read something off the tablet that was on his desk - "What state has the most people?" and asked me to write "California has the most people" on the same tablet.

He then asked me the eligibility questions and I was done! He said he approved my application and that I was going to receive an Oath Ceremony notice in the mail.

He did not ask me for any of the documents I had prepared, probably because he didn't actually conduct a I-751 interview. I came prepared with tax returns, bank statements, life/car insurance, photos, son's birth certificate etc etc.

Overall, the experience was pretty good (except for the wait - getting a toddler to sit still for more than a few minutes is nearly impossible).

I'm so excited to be almost done with my immigration journey!

Hello everyone,

My wife has two kids, one is my daughter and another is my stepdaughter. They all live overseas. I also have two boys (14 and 7) from previous marriage. I filed two separate I-130 petitions. one for spouse and another is for stepdaughter. I am preparing two separate I-864. What would be household size in my case?

Looks like on spouse I-864 is 5 but on stepdaughter I-864 is 6.

Am I correct?

DFC with children than need to start school?

Hello,

I am looking for some input to our situation, which is:

I initially entered the US, got married on the K-1 visa ( didn't get to apply for adjustment of status and etc) I was in the US for 4 years, we had 2 children in the last 2 years there, my husband retired from the Army, and since my RO passport was expiring, we decided to see if moving to Romania was a better lifestyle change for us. But fast forward, my husband hates it here and he s been wanting to go back for a while now.
Our oldest son is 5 years old now , so he needs to start school this year too, which makes it all so much more frustrating. My husband has been trying to get a hold of the US embassy here, but they never picked up the phone.
My husband( and me) wants to move back, get a house and put the kids in school. I know Romania s Embassy doesn't have a DCF, so all this ordeal has to be filed under special circumstances, but they don t specifically say anything about children issues in their list of dire circumstances to file for DCF. Would it be safe to try and go this route since our son needs to be in school this fall, or we need to make another plan?

The CR-1 route sends us to DCF, since we are both in Romania along with our children.
I am trying to get as much insight possible since my husband just gets bummed out every time he thinks about the whole process.
