What to do after J1 Hardship Waiver denial

My husband applied for a J1 Hardship waiver for a 212(e) requirement based on his USC spouse (me), but we got denied roughly 2 1/2 years after filing (USCIS found hardship but DOS denied. Not financed by a US gov't agency). He hasn't been able to work for over a year.

Living in his home country is not a viable option for me (I have a career here and family caregiving obligations) and we don't want to be separated because we are planning a family.

So we're looking at other options to stay in the US together. One option is to apply for a Conrad-30 waiver position (this is for physicians to practice in an underserved area). The other is to litigate with the AAO to challenge the USCIS decision. (I know the denial letter says you can't challenge it, but there are some loopholes to the statute).

It's very frustrating. Is anyone else going through something similar?

My father had an interview in Feb 2022 in Islamabad along with my mother according to the visa officer his visa was approved but my mother was given a slip and long form of family history info and was put under AP. we submitted the form in a week time since then both parents status was as reject. At the time of interview Visa Officer asked my father if he would like he can issue his immigration visa but my father says he will wait for his wife visa and if both visa could be issued together so visa officer said that's fine ever since both of their status showed reject, to day I notice my father status say expiring soon and mother status still says reject. what to think of it

Your application may be reinstated and any petition revalidated if, within one year, you can establish that your failure to pursue your immigrant visa application was due to circumstances beyond your control. Please provide a written statement to the Embassy or Consulate outlining the circumstances beyond your control and noting that you still wish to pursue this visa petition.

Hi,

I am planning to file for Spouse visa for my wife who is from Pakistan. I know the visa process take long. I was thinking to bring my wife first to Mexico through temporary residency (I already got my temporary residency visa and will soon file for her) so we can live tighter until her US immigrations process is completed. I work remotely so I can work from anywhere, so I was thinking to work from Mexico while her visa is still in progress.

The question can I start spouse visa process while she lives in Mexico and once, she gets to the interview stage can she has her interview in Mexico or she would have to fly back to Pakistan.
