Got an RFE on my husband's submitted I-485, specifically the I-864 that I submitted. I am the USC, he is the immigrant. I am sole sponsor, make well over poverty and have for 11+ years with same employer. Filled out I-864 completely, current form as of 3/10/21. Form is signed, includes my SSN, lists 2 as the number in our household, and included 3 years of IRS transcripts, 3 years of W-2s, letter from bank, letter from employer, balance statement of 401(k). We got the attached RFE today and I am totally confused as we submitted all of this, and, I scanned the entire packet before we sent it so I have an actual PDF of exactly what was sent so I know what we sent. Any suggestions? What am I missing here? I know this one is a big deal so I do not want to get it wrong. RFE I-485 Redacted II.pdf

My wife came from Mexico and we got legally married October 24th here in Minneapolis MN, her 90 days ends on December 16th. It has been over 5 weeks and we still haven't gotten our certified copy of our marriage certificate and we are trying to figure out the best course of action, and below are what it sounds like are the normal answers. Is there another route I don't know about? Any other benefits or drawbacks I am missing? It really seems like the process should have better answers for this extremely common situation. 1: Apply with what we currently have, and best case scenario she will either get an RFE which we can respond to with the certificate, and worst case scenario, she gets denied and we have to reapply and lose on on a chunk of money. But she would be legally here the whole time. Is it better to wait until the very last day to send it just in case we do get the certificate? 2: Wait for the certificate, which should in theory arrive soon, and apply the moment we get a certified copy. She would have a gap in her legal stay, which from what I have heard wouldn't necessarily affect her visa process, but could be bad if for some reason we bump into ICE in that time period. One other specific detail, we have a family trip planned to Texas in January where we would be flying domestically. Any reason to think that would call scrutiny to her current status?

My spouse was finally able to get an appointment and talk to a live human being at Social Security. She has an appointment on Dec 10th to get her maiden name changed to mine. We filed for ROC in July 2020 & the 18 month extension letter expires in early April. After changing the name will USCIS put the new last name on her new green card if she calls USCIS to let them know of the update? We still don't have the new green card nor an interview for the ROC. We entered the US through Juarez consular interview.

On the K-1 timeline, it says that we should be applying for a SSN before submitting the I-485 and getting a work authorization. Is that correct? We just got our marriage license in hand yesterday, we made an appointment with the SSA for next week, and we still have not sent in the I-485 (will do that soon). Do we need to have a work authorization in order to get a SSN? Just wanting some clarity on the sequence of these steps. Also which name to we put on the SS-5? We already have our marriage license with her married name, but her passport is in maiden her name. Also what kind of additional ID or paperwork would we need to show for the SSN appointment? The list of items in the SS-5 instructions includes a bunch of US issued identifications, which of course Cintya does not have yet. Thanks! Aaron and Cintya.
