Hi All,

I have a question you may be able to answer for me.

My partner and I have been in a relation for over eight years, I live in Ireland and she lives in the US. Next month we intend to start the K1 Visa process.

We are currently putting together the proof of relationship package and I have a question with regards to this...

My partner is not great with computers and technology and would prefer me to compile the social media aspects or our proof, such as Facebook, Messages, Texts, plane tickets.

My question with this is, if I'm the one that puts together this information from screenshots from my accounts and emails then is that okay as they will see the information from my side, the beneficiary, and not my partner... Will this matter?

Hi all,

My husband and I got married within our 90 day window for his k1 visa. Unfortunately with an unexpected move and loss of a job and then covid and nother loss of a job, we were unable to file due to not having the financial backing to say I could support him and our son.

Our AOS is in route to the lockbox and should arrive on Tuesday, however we are hoping to be able to travel within the united states after receiving the i-797. He has not worked, we have not travelled and I am hoping that his overstay is not going to be a huge deal, however I do know that he is way out of status. Has this happened to anyone else? I am curious to see what the outcome was? We have been together for 6 years and have a 5 year old together that was born in the US.

I have all the proof needed to show that I have not been able to prove my finances to be above the required amount over the last 2.5 years. We now have a cosponsor since I didn't make enough in 2020 and 2021, our cosponsor is my father who qualifies x100 but I am nervous about what will happen if anything at all.

We would also like to see if we can expedite his EAD, not sure if that's even possible.

Hi everyone,

My husband and I filed the AOS package on the 2nd March with NOA1 being received ( 10th of March) and my biometrics appointment is scheduled also. I set up my uscis online account and unfortunately seen I had received an RFE. This is the RFE that I received. I would appreciate if I could get advice on submitting our RFE. I have asked number questions relating to each RFE that I would like advice on.

Why We Are Writing You
On March 2, 2022, you submitted your Form I-485. We are writing to inform you that we need more information from
you to make a decision on your case. Please read this letter carefully and follow all of the instructions below.
What You Need To Do
You must provide the following information in order for us to make a final decision on your case. Please include a
copy of ALL pages of this letter with your response.
You have submitted Form I-864, Affidavit of Support, from the petitioning sponsor, (removed) We are unable to process the I-864 because it has one or more deficiencies. In order for us to
process your application further, you must:

Q1 :

  • Submit a completed and signed Form I-864, Affidavit of Support, from the petitioning sponsor. All

pages must be present and of the latest edition date.

  • Provide the petitioning sponsor's Social Security Number on Form I-864.
  • Provide a complete and correctly calculated household size for the petitioning sponsor on Form I-864.
  • Submit a complete copy of the petitioning sponsor s Federal income tax return, including all supporting

tax documents (W-2s, 1099s, Form 2555, and tax schedules) filed with the return, for the most recent tax
year.

The petitioning sponsor, (Removed)on Form I-864, Affidavit of Support, must be a United
States citizen, United States National, or Lawful Permanent Resident of the United States. Submit evidence of
the petitioning sponsor s status.
Evidence may include:

Q2:

  • Birth certificate issued by a civil authority showing birth in the United States (must be a long-form birth
  • certificate which lists at least one parent's name)
  • Puerto Rican birth certificate (must have been issued on or after July 1, 2010)
  • Biographical page of unexpired United States passport
  • Certificate of Naturalization
  • Certificate of Citizenship
  • Department of State Form FS-240 (Report of Birth Abroad of a United States Citizen)
  • Copy of Form I-551, Permanent Resident Card

Q3:

  • Submit a copy of the marriage certificate between the K-1 applicant and the I-129F petitioner showing the date of the marriage within 90 days of the K-1 s arrival into the United States. The marriage certificate must be issued by the government agency authorized to issue the document. For immigration purposes, the marriage must have been registered with the government agency authorized to register marriages from the location where the marriage took place. The marriage certificate must have the seal of the issuing office, the date of registration, and signature of the registrar. Any foreign language documents must be accompanied by a complete English translation.

Q1 : Here is the checklist for our I 864 form

Form G1145 E-Notification of application/petition acceptance

Copy of federal income tax transcripts for 2020, 2019, 2018

Employment Certificate

Copy of pay stubs from previous six months

Copy of sponsors bank statement

Copy of sponsors stock ownership and value

Copy of U.S. spouse passport page

Copy of principal immigrants bank statement

We submitted the tax transcripts for 2018, 2019 and 2020 (2020 being the most recent) should we just send the tax return and the documentation such as W2s for 2020? We are using my husbands assets to meet the poverty guidelines. I also included my savings from my foreign bank.

Q2: I submitted both a photocopy of my Husbands passport and a photocopy of his birth certificate. Should I just submitted one and does the birth certificate need to be a certified copy rather than a photocopy?

Q3: I did not submit a copy of the marriage certificate for the I- 864 form ( I thought it was only necessary for I 485, I 765 and I 131.

Visiting US while waiting for I-130 approval

Hello,

My husband and I are in the process of submitting our I-130 paperwork, but we are wondering if he would still be able to come visit me in the US for a family event once we are waiting for the I-130 to be approved. He is from a visa waiver country (Ireland) so we are unsure if we should wait to submit the paperwork until after the event in May so that he can come visit for a week or two or if we should go ahead and submit the completed paperwork and still book a flight for him for that date. Does anyone have any experience with this? We want to submit the paperwork as soon as possible to get the process started, but we also don't want to spend all this money on a flight if he won't be allowed to fly. I hope this question makes sense. Thanks!

Hi everyone! After a bit of back and forth we finally got our NVC approval letter We went ahead and scheduled the medical, but the first appointment wasn't available until May. I know it's become the case where the interview date occurs before the medical is complete - but I just had a few questions..

  • Roughly how long does it take for the NVC to come back on a confirmed interview date?
  • If the interview is before the medical appointment, does the embassy hold onto your passport?
