USCIS issued us a 10-year Green Card after AOS in Nov 2019, but should have issued a 2-year conditional GC (K1, marriage May 2018). We have just learned that we need to have them fix this error using an I-90 submission. Will this timeline jeopardise our ROC submission window, which is quickly approaching?
Timeline:
April 2018 - entered on K1 visa
May 2018 - Marriage
Nov 2019 - AOS interview
Nov 2019 - received 10-yr GC (a few days later)
Feb 2021 - Just realised it needs to be fixed and changed to a 2-yr CGC
Aug 2021 - ROC window starts
Nov 2021 - deadline for ROC
How are the I-90 timelines for fixing a USCIS error, given the pandemic?
If the corrected GC is not received in time, do we submit anyway for ROC with copies of the I-90 submission and NOA attached?
