I am new to this forum. I just filed marriage based AOS this week. I am the beneficiary. Visajourney guides as well as individual members on this forum has been extremely helpful. They gave me confidence and knowledge to file my case myself.

Creating this thread for all September AOS files to share their journey as we go through the process and next few months and years. Good luck everyone.

Hi,

I received a 10 year greencard instead of a 2 year greencard when I came to the USA. My marriage at that time was under 2 years. I called USCIS and they told me since my visa, passport and greencard ay IR1, my greencard is good.

I am going to file for ROC next month just to be on the safe side.

Is there anyone who has gone through the same thing and what did they do to resolve?

I am filing an AOS this week. I am on H1B and spouse is USC by birth. Here is my checklist. Please review if you can:

Envelope 1: I-130

  1. A check for the amount of $535.00 to cover the filing fee;
  2. Form G-1145 e-Notification of Application/Petition Acceptance
  3. Form I-130 Petition for Alien Relative;
  4. Form I-130A, Supplemental Information for Spouse Beneficiary, for the beneficiary;
  5. Two (2) photos of the petitioner and two (2) photos of the beneficiary;
  6. Petitioner s U.S. birth certificate;
  7. Petitioner s U.S. passport;
  8. Divorce decrees of petitioner;
  9. Beneficiary s birth certificate;
  10. Beneficiary s current passport;
  11. Marriage certificate of petitioner and beneficiary;
  12. A letter I wrote about prior biometric appointment (In 2019 I got a biometric exam done at USCIS office for a travel visa for another country) <----------------------- I am hoping this gets my biometric exam waived
  13. Various Evidences of bona fide marriage.
    1. Four affidavit letter of supports vouching for our marriage;
    2. Bank statement from a joint bank account which is primarily used for our wedding expenses, and the renovation/remodeling expenses of a new home we purchased together;
    3. Purchase and mortgage documents for our current residence that we purchased together
    4. Purchase and sale document of a lot that we purchased together in 2017 and sold in 2019
    5. Beneficiary s health insurance document showing coverage for petitioner
    6. Beneficiary s life insurance document showing petitioner as the beneficiary (of life insurance)
    7. Photos of beneficiary and petitioner taken during 2016-2020 documenting their life and travel together, and wedding.
    8. Nine hotel receipts of trips the petitioner and beneficiary have taken together during 2016-2020.
    9. Four flight receipts for trips the petitioner and beneficiary have take together during 2016-2020.

  • Question: Should I include I-94 in I130 packet?

Envelope 2: I-485, I-765, I-131

I485:

  1. Check for $1,225 (Filing fee + biometric fee)
  2. 2 passport-style photo (name and A# on the back)
  3. G-1145 Form- e-Notification of Application/Petition Acceptance
  4. I-485 Form
  5. Evidence for exemption from filing form I-864 (I am exempt from filing I864 as I have earned 40 quarters of Social Security credit)
    1. Social Security Statement (primary evidence)
    2. IRS Wage and Income Transcript for 2019-2010 (additional evidence)
  6. Copy of applicant s Birth Certificate
  7. Copy of marriage certificate
  8. Copy of Divorce Decree for petitioner (US citizen spouse)
  9. Evidence of Continuously maintaining lawful status since arrival in USA
    1. Current passport with bio, visa, and stamp pages
    2. Latest I-94
    3. Expired Passport #1with bio, visa, and stamp pages
    4. Expired Passport #2 with bio, visa, and stamp pages
    5. I-797 for I-140 approval <-------------------- I have an approved EB2 petition from 2010. Since my prority date has never been current (I am Indian ), no I485 was filed. But I have used that pending petition for last 2 H1B extensions. So I feel this needs to be included.
    6. Various I-797s for H1B approval for 2010-2022
    7. OPT EAD Card
    8. Various I-20s for 2003-2009
  10. A letter I wrote about prior biometric appointment
  11. I-693 completed by a Civil Surgeon <---------------------------------------- I am hoping if our interview is waived due to pandemic, submitting this now will make the process faster

I765:

  1. 2 passport-style photo (name and A# on the back)
  2. G-1145 Form- e-Notification of Application/Petition Acceptance
  3. Form I-765 Application for Employment Authorization
  4. Evidence of Continuously maintaining lawful status since arrival in USA
    1. Current passport with bio, visa, and stamp pages
    2. Latest I-94
    3. Expired Passport #1with bio, visa, and stamp pages
    4. Expired Passport #2 with bio, visa, and stamp pages
    5. I-797 for I-140 approval
    6. Various I-797s for H1B approval for 2010-2022
    7. OPT EAD Card
    8. Various I-20s for 2003-2009
  5. Copy of marriage certificate
  6. A letter I wrote about prior biometric appointment (I got a biometric exam done at USCIS office for a travel visa for another country)

  3. Form I-131 Application for Travel Document (Advanced Parole )
  4. Evidence of Continuously maintaining lawful status since arrival in USA
    1. Current passport with bio, visa, and stamp pages
    2. Latest I-94
    3. Expired Passport #1with bio, visa, and stamp pages
    4. Expired Passport #2 with bio, visa, and stamp pages
    5. I-797 for I-140 approval
    6. Various I-797s for H1B approval for 2010-2022
    7. OPT EAD Card
    8. Various I-20s for 2003-2009
  5. Copy of marriage certificate
