I'm very confused about the right process to be able to return to the US.

Here is the situation :

I married an american citizen in 2018 following the K1 process. I got a conditional green card in March 2019. My wife and I lived in the US for more than 2 years. We had to come back to France last february (before my green card expired in March 2021) in order to work several months to get retired, that was impossible staying in the US. I didn't know exactly how long I had to work. Today all is ok, I am retired and have a pension. We want to go back to live in the US. In theory I'm eligible to get a 10 year green card since we are married, I never overstayed in the US, and we came back to France for good reasons. But I don't find any application matching this case and I couldn't get information very clear from the ambassy.

My kids went for interview at US embassy in france on july 1st,My ex took them for the interview

Their application was filed by my USC spouse..they have all the checkilst documents ask for documents ourside the checklist, to my suprise the visa officer didnt approved the visa said they need a consent letter from me and my EX even with ex having our child supprt aggreement which states our custody agreement and also ask of my original country birth passport photo page,which have my Green card and spouse passport page.

Immediately i wrote a consent got it notarised and also my ex wrote one too send in my passport photo page..instructions say 10 to 12 days..you should get a reply

No response from them yet..

Does anyone been through this before..i need something to cool my nerves..

Please advice

N400 90-day early filing and moving to another State

Hello everyone! Hope you are doing well. It's almost time for me to file my N400 as I am close to my 5th year as LPR, however there is something not clear to me and I was hoping to find someone with a similar experience.

I'm about to move to another State and I know that USCIS requires you to live in the State or Service district for 3 months before applying (see below)

A. Three-Month Residency Requirement (in State or Service District)

In general, an applicant for naturalization must file his or her application for naturalization with the state or service district that has jurisdiction over his or her place of residence. The applicant must have resided in that location for at least three months prior to filing.

However, section D also states the following:

D. 90-Day Early Filing Provision (INA 334)

In cases where an applicant has filed early and the required three month period of residence in a state or service district falls within the required five-year period of continuous residence, jurisdiction for filing will be based on the three-month period immediately preceding the examination on the application.

So if I read this correctly, it's my understanding that if someone moves to another State let's say 100 days before the 5th anniversary as LPR and then files the N400 in the new place of residence using the 90-day early filing provision, the applicant's jurisdiction would be the new place of residence, even if they lived there only 10 days at the moment of filing. So as long as when USCIS examines the application (interview) you spent at least three months in that jurisdiction, you should be fine.

Hope to get more clarifications from you all in case I'm missing anything here.
