Marriage Based Green Card/F1 OPT Pending (merged)

Hi all,

New here and looking for some advice. My husband and I will soon be filing for his marriage-based green card. He is a graduating PhD student on an F1 visa, with OPT pending (we re hopefully expecting OPT approval in the next month or so).

The international student advisor at his university said we should wait to file our marriage-based green card application until his OPT is approved. Our lawyer however said that it doesn t matter and that we can file for the green card whenever.

Any advice? The university advisor was concerned that filing the green card app now could jeopardize his pending OPT, and this is obviously our concern too. He is beginning employment on July 1, so imperative that his work authorization isn t compromised.

Is it safer to just wait for the OPT to be approved before we file?

Thank you!

Hi all,

Would love to get a review of the cover letter and packet contents for my husband and I. I am the US citizen, he is French adjusting from F1 OPT. We will be filing I-130 online and mailing the rest. My employer switched their HR company halfway through the year so I have 2 W2s, but they are for the same employment I have held for 1.5 years. I easily met the support level for 2021, but received a raise for year 2022 which is why I am including the compensation letter since that is my stated annual income on the I-864.

NVC skipped one of my documents?

Hey everyone!

I am in a bit of a weird situation and I wanted everyone's take on it.

I submitted all of my documents to the NVC in January. They were reviewed last week. I received 2 rejected documents, which I quickly corrected and re-submitted. However, one of my documents wasn't reviewed with the rest of my documents last week. It was submitted at the same time as the other documents, but I guess it was skipped. It did not get rejected, or accepted. It was the Exchange Visitor Documentation (J1).

I am nervous that this document will get rejected too when they finally review everything in 3 months, and then we will have to wait 3 more months again after that.

Has this ever happened to anyone before? any advice??

Thanks so much!

Hello,

i could really use some help with my case.
i was denied entry on ESTA for seeking immigration benefits without an immigrant visa. I was told I could come back on a visa.
I requested my FOIA and it shows things on the sworn statement that were not said to me. And all paper work says I need a waiver. It says I must obtain a visa with waiver for future entries. But I wasn t accused of anything, when I try to get a waiver none of the subjects apply to me.
Every lawyer I ve spoken to has told me I should not need a waiver.
but then why does this paper work say I do? Which waiver category do I need?

Re-submitting document before review NVC

Hey everyone!!

I had a quick question/wondering what other people's experience has been with this.

My partner and I submitted all of his documents to the NVC mid-January, meaning we are expecting a review sometime in the next month/few weeks or so. However, I was looking over his paperwork again this week to prepare for his interview, and I found a strange glitch on one of our documents. For his birth certificate, I merged a pdf of the translation and of the original birth certificate. The first 2 pages of the document are the translation, and the last page is his original birth certificate. When I open up what I submitted on a web-page, the last page (the original birth certificate) is blank! If I open it using "system viewer" on my computer, the last page is there. If I open it on my phone, the last page is also there.

I am nervous they will open it just using the webpage and therefore see a blank page. So I am wondering, should I re-upload another copy of the birth certificate? I have read anytime you re-submit something, it sends you to the "back of the line." We have just a few weeks of waiting left, so it kills me to think we would have lost all of this time. But also, maybe they will open it just fine and there will be no problem?

I have also read that if you submit something before they start to review, it doesn't send you to the back of the line. Do people have experience with this?? I am not sure what the right thing is to do.

Any advice is greatly appreciated!! Thanks in advance.
